WHEREAS, RCW 39.04.280 provides that the City, by resolution, may waive competitive bidding requirements when a purchase is clearly and legitimately limited to a single source of supply, or when the purchase involves special facilities or market conditions.; and WHEREAS, compaction asphalt rollers are used in road building to compress the various layers of materials required to form a road. Particles of soil or asphalt are pushed together to pack them tight to each other, which reduces the chance of shifting, crumbling or sinking.; and WHEREAS, the City currently owns a small asphalt roller which is not large enough to meet the City's needs. It has been necessary for staff to rent a larger asphalt roller on a regular basis in order to complete regular road maintenance.; and WHEREAS, Bomag BW120SL-5 asphalt rollers are a type of larger asphalt roller that has the functionality to meet the City's road maintenance requirements.; and WHEREAS, a brand new Bomag BW 120SL-5 asphalt roller costs approximately $54,650.00 each including shipping and sales tax.; and WHEREAS, Sonsray Machinery currently has a used 2017 Bomag BW 120SL-5 asphalt roller, Serial 9: 861880441215, available for purchase. The price would be $30,056.18 including shipping and sales tax.; and WHEREAS, Sonsray Machinery indicated that this deal was only available for a short period of time and would be sold to the first purchaser.; and WHEREAS, the City's Public Works Operations Manager believes the price for this used 2017 Bomag BW120SL-5 asphalt roller is a highly favorable price and would be sold to another parry before the City has the time to comply with formal bidding requirements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anacortes, Washington, as follows: Section 1. The City Council of the City of Anacortes, Washington, finds that the purchase of this used 2017 Bomag BW 120SL-5, Serial 9: 861880441215, asphalt roller clearly limits the City of Anacortes to a single source of supply and special market conditions,justifying the waiver of competitive bidding requirements. Section 2. The City Council of the City of Anacortes, Washington, hereby waives the bidding requirements for the purchase of one used 2017 Bomag Resolution 3110 Page I
