DocuSign Envelope ID:OED2675A-D47B-4FO2-A7C8-33AO468C11DO RESOLUTION 3108 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANACORTES, WASHINGTON, authorizing the purchase of DJI Unmanned Aerial Vehicles with Axon Air and Axon Evidence Data Management System for use by the City's Police Department, and waiving the competitive bidding requirements, pursuant to RCW 39.04.280. WHEREAS, RCW 39.04.280 provides that the City of Anacortes ("City"), by resolution, may waive competitive bidding requirements when a purchase is clearly and legitimately limited to a single source of supply, or when the purchase involves special facilities or market conditions. WHEREAS, law enforcement agencies use Unmanned Aerial Vehicles (UAV) for public safety missions; and WHEREAS, the law enforcement agencies within Skagit County require UAVs with software that enables interoperability with each of the other local agencies in order to fly coordinated public safety missions and to track the UAV and its pilots for flight records; and WHEREAS, the Anacortes Police Chief has found that the only UAVs that also includes software compatible with the UAVs and software operated by Skagit County's other law enforcement agencies is the DJI brand UAVs with the Axon Air and Axon Air Data Management Systems as sold by Axon Enterprises, Inc.; and WHEREAS, the DJI brand UAV with the Axon Air and Axon Air Data Management Systems as sold by Axon Enterprises, Inc. has a current approximate cost of$23,916.51 per unit. The City's bid threshold for materials, supplies, and equipment is $7,500; and WHEREAS, Axon Enterprise, Inc. is the sole authorized distributor and repair facility for Axon brand products; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anacortes, Washington, as follows: Section 1. The City Council of the City of Anacortes finds that because (1) the Anacortes Police Department requires UAVs and software that are compatible with UAVs and software used by other local law enforcement agencies, (2) the only UAV that includes software compatible with those used by other local law enforcement agencies is the DJI brand UAVs with the Axon Air and Axon Air Data Management Systems as sold by Axon Enterprises, Inc, and (3) that Axon Enterprise, Inc. is the sole authorized distributor and repair facility for Axon brand products, that the City of Anacortes is clearly limited to a single source of supply from Axon Enterprise, Inc.,justifying the waiver of competitive bidding requirements. Section 2. The City Council of the City of Anacortes, Washington, hereby waives the bidding requirements for the purchase of DJI Unmanned Resolution 3108 Page 1
