DocuSign Envelope ID:6A5BB29B-26AF-4AAD-90A8-66DCFDB82C1E <br /> Ordinance No. 4025 <br /> An Ordinance Amending the Critical Area Regulations Contained <br /> in Anacortes Municipal Code Chapter 19.70, 19.70.235.F.5 and <br /> Article III, Fish and Wildlife Habitat Conservation Areas, to <br /> address Riparian Management Zones <br /> Whereas, on July 18, 2016, the City Council adopted Ordinance 2982 adopting a new Comprehensive <br /> Plan pursuant to the City's periodic Growth Management Act Comprehensive Plan amendment and <br /> update process; and <br /> Whereas,the Anacortes Comprehensive Plan provides guidance for amending the Anacortes Municipal <br /> Code (AMC) development regulations and official zoning map to implement its land use, housing, <br /> economic development,transportation, environment and conservation, and other goals and policies; and <br /> Whereas,the proposed amendments to the development regulations and official zoning map were <br /> initiated by the City in accordance with the requirements of the Growth Management Act and AMC <br /> 19.16.030(B), subsequent to the adoption of the 2016 Comprehensive Plan; and <br /> Whereas,the City Council adopted Ordinance 3040 adopting new Development Regulations July 22, <br /> 2019; and <br /> Whereas,the City Council adopted Ordinance 3064 updating the Critical Areas Regulations July 26, <br /> 2021; and <br /> Whereas,the City Council desires to amend certain sections of the Critical Area regulations as depicted <br /> in attachment A to address Best Available Science; <br /> Whereas,the amendments to the Critical Areas regulations are in the best interest of the City Of <br /> Anacortes residents; and <br /> Whereas,the amendments to the Critical Area Regulations set forth herein have been processed, <br /> reviewed, considered, and adopted in material compliance with all applicable state and local procedural <br /> requirements, standards and requirements, standards, and criteria, including but not limited to the <br /> requirements of Chapter 36.70A RCW and WDFW confirmation of consistency with Best Available <br /> Science. <br /> Whereas, a public comment opportunity was provided for certain changes to Critical Area Regulations <br /> Chapter 19.70 , 19.70.235.F.5, and Article III Fish and Wildlife Conservation Areas, 19.70.330 at the <br /> September 28,2022 Planning Commission meeting ; and <br /> Whereas, the City Council considered the Planning Commission recommendation at a meeting on <br /> October 17, 2022; and <br />
