DocuSign Envelope ID:538D2D57-F21A-40133-1315A-1097FD2E6566 <br /> Ordinance No. 4029 <br /> An Ordinance Setting Closing Hours for City Parks and the Anacortes <br /> Community Forest Lands ("ACFL") <br /> Whereas the City Council has adopted rules for City Parks and the Anacortes Community Forest <br /> Lands (ACFL),now codified in AMC Chapter 8.10; <br /> Whereas the City Council desires to amend those rules to set hours of operation for all City parks; <br /> Whereas it is also necessary to provide the Director of Parks and Recreation with the authority to <br /> open or close parks and the ACFL to accommodate special events, construction,trail overuse,and <br /> other circumstances; <br /> Now,therefore,the City Council of the City of Anacortes does ordain as follows: <br /> Section 1. New section AMC 8.10.030 is adopted to read as follows: <br /> 8.10.030 Park and ACFL Hours <br /> A.The ACFL and all city parks, except the campground and boat launch at Washington <br /> Park,are open to the public only from 5:00 a.m.to 10:00 p.m.,unless otherwise posted <br /> by the Director of Parks and Recreation. <br /> B. The Director of Parks and Recreation may close any section of a park or the ACFL at <br /> any time by posting notice in the closed section. <br /> C.A person may not enter or remain in a closed section of a park or the ACFL without <br /> written permission from the Director of Parks and Recreation. <br /> D.A person who violates this section is subject to a class 2 civil infraction per Chapter <br /> 7.80 RCW, carrying a maximum penalty and a default amount of$125.00,not including <br /> statutory assessments. <br /> Section 2. Consistent with RCW 35A.12.130,this ordinance takes effect five days after passage <br /> and publication. <br /> Section 3. Within 120 days of the effective date of this ordinance,the director of the City Parks <br /> and Recreation Department is directed to erect and maintain permanent signage at all <br /> City parks noting the restriction contained in this ordinance,the amount of the penalty, <br /> and reference to AMC Chapter 8.10. <br /> 1 <br />
