DocuSign Envelope ID:538D2D57-F21A-40133-1315A-1097FD2E6566 Ordinance No. 4029 An Ordinance Setting Closing Hours for City Parks and the Anacortes Community Forest Lands ("ACFL") Whereas the City Council has adopted rules for City Parks and the Anacortes Community Forest Lands (ACFL),now codified in AMC Chapter 8.10; Whereas the City Council desires to amend those rules to set hours of operation for all City parks; Whereas it is also necessary to provide the Director of Parks and Recreation with the authority to open or close parks and the ACFL to accommodate special events, construction,trail overuse,and other circumstances; Now,therefore,the City Council of the City of Anacortes does ordain as follows: Section 1. New section AMC 8.10.030 is adopted to read as follows: 8.10.030 Park and ACFL Hours A.The ACFL and all city parks, except the campground and boat launch at Washington Park,are open to the public only from 5:00 a.m.to 10:00 p.m.,unless otherwise posted by the Director of Parks and Recreation. B. The Director of Parks and Recreation may close any section of a park or the ACFL at any time by posting notice in the closed section. C.A person may not enter or remain in a closed section of a park or the ACFL without written permission from the Director of Parks and Recreation. D.A person who violates this section is subject to a class 2 civil infraction per Chapter 7.80 RCW, carrying a maximum penalty and a default amount of$125.00,not including statutory assessments. Section 2. Consistent with RCW 35A.12.130,this ordinance takes effect five days after passage and publication. Section 3. Within 120 days of the effective date of this ordinance,the director of the City Parks and Recreation Department is directed to erect and maintain permanent signage at all City parks noting the restriction contained in this ordinance,the amount of the penalty, and reference to AMC Chapter 8.10. 1
