DocuSign Envelope ID:099B2730-4099-40B7-BB2E-5A92F7804413 <br /> RESOLUTION 3082 <br /> A RESOLUTION UPDATING THE WORK PLAN ADOPTED IN RESOLUTION 3005 <br /> REGARDING BONUS HEIGHT PROVISIONS IN THE R4 ZONE WEST OF THE <br /> COMMERCIAL ZONE RELATED TO ORDINANCE 4020 <br /> WHEREAS, the Anacortes City Council adopted Ordinance 3054 October 21, 2019 a <br /> Moratorium on accepting certain land use permits in the R4 Use Zone west of the Commercial <br /> Use Zone that proposes to utilize the bonus height provisions of AMC 19.42.050 C; and <br /> WHEREAS, the City Council adopted Resolution 2068 on December 2, 2019, adopting <br /> a work plan for evaluating bonus height provisions in the R4 Zone west of the Commercial Zone; <br /> and <br /> WHEREAS, the City Council adopted Ordinance 3069 on April 20, 2020, which <br /> affirmed the moratorium and extended it for an additional six months through October 21, 2020; <br /> and <br /> WHEREAS, the City Council adopted Ordinance 3076 at the October 12, 2020 meeting, <br /> which would extend the moratorium for an additional six months; and <br /> WHEREAS, the City Council adopted Ordinance 3088 at the April 12,2021 meeting, <br /> which would extend the moratorium for an additional six months; and <br /> WHEREAS, the City Council adopted Ordinance 3097 at the October 11, 2021 meeting, <br /> which would extend the moratorium for an additional 6 months; and <br /> WHEREAS, the City Council adopted Ordinance 4020 at the April 11, 2022 meeting <br /> which would extend the moratorium for an additional 6 months; and <br /> WHEREAS, the City Council desires to continue working to review the maximum <br /> building height in the R4 Use Zone west of the Commercial Use Zone with public input; <br /> WHEREAS, a moratorium is a recognized technique to preserve the status quo while <br /> new plans and regulations are developed and avoid a rush for permits whenever a community <br /> desires to change its planning ordinances; and <br /> WHEREAS, RCW 36.70A.390 and AMC 19.16.110 authorize the City Council to adopt <br /> moratoriums, interim zoning ordinances, and interim official controls; and <br /> WHEREAS, RCW 36.70A.390 and RCW 35A.63.220 require cities to hold a public <br /> hearing within sixty (60) days of the adoption of such moratoria to develop a work plan and the <br /> public hearing was held May 23, 2022. <br /> NOW THEREFORE, BE IT RESOLVED BY THE ANACORTES CITY <br /> COUNCIL: <br /> Resolution 3082 1 <br />
