CITY OF ANACORTES <br /> <br />RESOLUTION NO. 3085 <br /> <br />A RESOLUTION of the City of Anacortes, Washington, rejecting all bids for <br />Contract No. 20-032-SEW-009, WWTP Outfall Relocation – Upland Phase. <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANACORTES, <br />WASHINGTON, AS FOLLOWS: <br /> <br />Section 1. Recitals and Findings. The City Council of the City of Anacortes hereby makes the following <br />findings: <br />1. The City of Anacortes has an identified public works project titled the WWTP Outfall Relocation <br />– Upland Phase <br />2. The City solicited bids on February 1, 2022 for this public works project identified as Contract No. <br />20-032-SEW-009 in accordance with RCW 70.95A.020, which defines Pollution Control Facilities <br />and with RCW 70.95A.090 that provides exemption from competitive bidding for Pollution Control <br />Facilities, and on March 16, 2022 one bid was received by the City. <br />3. The lowest responsive, responsible bid received substantially exceeded the original estimate and <br />currently has not been approved by the Federal Emergency Management Agency (FEMA). <br />4. FEMA’s timeline to complete this review is uncertain. This delays FEMA project funding until <br />complete. <br />5. The State Historic Preservation office has not completed their review of rock blasting required for <br />project construction. The timeline for completion of this effort is unknown. <br />6. Pursuant to RCW 35.23.352, the City Council may, by resolution, reject all bids. <br /> <br />Section 2. Bids Rejected. Based on the Recitals and Findings above, the City Council hereby rejects all <br />bids received for Contract No. 20-032-SEW-009, WWTP Outfall Relocation – Upland Phase. <br /> <br />Section 3. Ratification and Confirmation. Any actions of the City or its officers prior to the date hereof <br />and consistent with the terms of this Resolution are ratified and confirmed. <br /> <br />Section 4. Effective Date.
