DocuSign Envelope ID:8AEB1A01-237B-4E3C-A180-8019895A1B4C <br /> RESOLUTION 3083 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANACORTES, <br /> WASHINGTON, declaring an emergency and waiving state competitive bidding <br /> requirements for the repair of the electrical system at the Water Treatment Plant <br /> (WTP), pursuant to RCW 39.04.280. <br /> WHEREAS, RCW 39.04.280 provides that the City, by resolution, may waive <br /> competitive bidding requirements for public works in the event of an emergency. For <br /> purposes of RCW 39.04.280, an "emergency" is any unforeseen circumstance beyond <br /> the control of the municipality that either (a) presents a real, immediate threat to the <br /> proper performance of essential functions; or (b) will likely result in material loss or <br /> damage to property, bodily injury, or loss of life if immediate action is not taken; and <br /> WHEREAS, on April 6, 2022 at approximately 2300 hrs the Water Treatment <br /> Plant's intake station power tripped. Crews identified the intake station had a blown <br /> electrical transformer and the intake station operated on a rented backup generator for <br /> approximately 6 hours until a replacement transformer could be procured. Once the <br /> intake station was on backup generator, Potelco Line Contractors worked with PSE to <br /> procure a replacement electrical transformer. The new transformer caused the power <br /> source wiring configuration to be adjusted which resulted in the typical backup power <br /> supply from the plant generators to not function. Typically, the intake is provided <br /> emergency power from the WTP's emergency generators.; and <br /> WHEREAS, as part of this event, the power switching gear supplying the intake <br /> from the WTP side was damaged as well. The biggest issue with this gear failing is it <br /> rendered the backup generators that feed the plant during power outages non-functional.; <br /> and <br /> WHEREAS, without power the water intake station cannot push water to the <br /> plant, and therefore the water plant would not be able to produce water during a power <br /> outage and would not have a way to push water into the water distribution system; and <br /> WHEREAS, the WTP serves approximately 56,000 residential, commercial and <br /> industrial customers and the damage to the electrical system at the WTP causes a state of <br /> imminent potential for total failure resulting in the inability to produce potable water, <br /> which could cause property damage and become a high risk to human health and life.; <br /> and <br /> WHEREAS, repair of the electrical system is "public work" as defined by RCW <br /> 39.04.010(4). <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br /> Anacortes, Washington as follows: <br /> Section 1. The City Council of the City of Anacortes, Washington finds that the <br /> facts set forth in the recitals of this resolution are true and that the failure of <br /> electrical system at the WTP constitutes an emergency under RCW 39.04.280. <br /> Pursuant to RCW 39.04.280, the City Council hereby declares and certifies that <br /> Resolution 3083 Page 1 <br />
