DocuSign Envelope ID:7124AC48-253A-461A-9B23-37C0B347BB15 <br /> RESOLUTION NO. 3076 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> ANACORTES UPDATING THE CONSERVATION EASEMENT PROGRAM IN THE <br /> ANACORTES COMMUNITY FOREST LANDS AND REVOKING AND REPLACING <br /> RESOLUTION 1492 <br /> WHEREAS, in December 1998, the City Council approved Resolution 1492 initiating the <br /> Conservation Easement Program for the purpose of protecting the forest lands and generating <br /> revenue for protection of said forest lands; and <br /> WHEREAS, the Anacortes Community Forest Lands ("ACFL") are recognized by city residents <br /> as an irreplaceable destination for recreation and invaluable wildlife habitat; and <br /> WHEREAS, the City and the Skagit Land Trust have worked together since the adoption of <br /> Resolution 1492 to successfully conserve over 1800 acres of forestland in the ACFL and manage <br /> the protected area for in perpetuity; and <br /> WHEREAS, City staff and the Skagit Land Trust have identified the need to update and <br /> consolidate the various easements into one document to better manage the conserved area; and <br /> WHEREAS, City staff and the Skagit Land Trust have prepared a new deed that will consolidate <br /> previous conservation easements and update language on commercial use and stewardship; and <br /> WHEREAS, the provisions of Resolution 1492 need to be updated to reflect changes in the <br /> program and updates to the arrangement with the Skagit Land Trust; <br /> NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Anacortes, <br /> Washington, that: <br /> 1. Exhibit A to Resolution 1492 is hereby revoked and replaced with Exhibit A, which is <br /> attached and incorporated by reference. <br /> 2. Council hereby adopts the ACFL Amended and Restated Conservation Easement, <br /> attached hereto as Exhibit B and incorporated by reference. Council intends Exhibit B to <br /> revoke and replace the provisions of Resolution 1492. <br /> INTRODUCED, PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY <br /> OF ANACORTES on this 21st day of March, 2022. <br /> MATTHEW C.
