DocuSign Envelope ID:624ECF73-511C-41A9-B517-49F26BBFB1FF <br /> RESOLUTION 3037 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANACORTES, <br /> WASHINGTON, authorizing the purchase of 271 Multi-port Service Terminals <br /> (MSTs) for the City's Access Fiber Project from Millennium, and waiving the <br /> competitive bidding requirement due to special market conditions, pursuant to <br /> RCW 39.04.280. <br /> WHEREAS, RCW 39.04.280 provides that the City, by resolution, may waive <br /> competitive bidding requirements when a purchase is clearly and legitimately limited to <br /> a single source of supply, or when the purchase involves special facilities or market <br /> conditions. <br /> WHEREAS, the City's Fiber Department requires Multi-port Service Terminals <br /> (MSTs) in order to have a functional fiber system; and <br /> WHEREAS, past orders were placed with Graybar Electric Company under a <br /> contract resulting from a competitive procurement run by the City of Kansas City, <br /> Missouri (EV2370 Master Agreement); and <br /> WHEREAS, the City has an active contract with a contractor who is in mid- <br /> installation of the fiber project throughout the City; and <br /> WHEREAS, unexpected market conditions for MSTs due to the COVID <br /> pandemic, and a significate increase in nationwide demand for the product, has resulted <br /> in a delivery delay of nine to twelve months for MSTs ordered from Graybar Electric <br /> Company; and <br /> WHEREAS, a delivery delay of that magnitude would prevent all currently <br /> planned fiber installations, resulting in extreme financial impact for the City; and <br /> WHEREAS, Millennium has an estimated delivery time of 84 MSTs by mid-July <br /> 2021 and 187 MSTs by mid-August 2021, which would allow the City's contractor to <br /> proceed with work uninterrupted; and <br /> WHEREAS, City staff could not find another vendor who could meet the <br /> estimated delivery times of Millennium; and <br /> WHEREAS, the Administrative Services Director and Fiber Department <br /> Manager believe purchasing 271 MSTs from Millennium is necessary for the <br /> continuation of the Access Fiber Project and may not be available after the time <br /> necessary to comply with formal bidding requirements; and <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br /> Anacortes, Washington, as follows: <br /> Section 1. The City Council of the City of Anacortes, Washington, finds that the <br /> purchase of 271 Multi-port Service Terminals (MSTs) for the City's Access <br /> Fiber Project from Millennium clearly limits the City of Anacortes to special <br /> market conditions,justifying the waiver of competitive bidding requirements. <br /> Resolution 3037 Page 1 <br />
