DocuSign Envelope ID:3F814DEF-C77E-4A6A-A3D0-0F026D008DBF <br /> RESOLUTION 3031 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANACORTES, <br /> WASHINGTON, authorizing the purchase of Foxboro instrumentation for use at <br /> the Anacortes Wastewater Treatment Plant and pump stations, and waiving the <br /> competitive bidding requirement due to a single source of supply, pursuant to <br /> RCW 39.04.280. <br /> WHEREAS, RCW 39.04.280 provides that the City, by resolution, may waive <br /> competitive bidding requirements when a purchase is clearly and legitimately limited to <br /> a single source of supply, or when the purchase involves special facilities or market <br /> conditions. <br /> WHEREAS, the City currently has several Foxboro flowmeters and instrument <br /> transmitters throughout the Wastewater Treatment Plant and pump stations. They are <br /> designed to measure flow in a variety of process application and report flow information <br /> to the plants SCADA system; and <br /> WHEREAS, components of flow measuring devices and transmitters are only <br /> designed to work with their manufacturers system. For instance, a flow tube from one <br /> manufacture would not work with a transmitter from another; and <br /> WHEREAS, installing a different brand would require a full modification of the <br /> entire flow metering and instrument transmitter components throughout the plant and <br /> pump stations; and <br /> WHEREAS, Engineered Process Controls, LLC is the only Authorized <br /> Manufacturers Representative for the Foxboro branded Schneider-Electric Process <br /> Instrumentation and SCADA& Telemetry products in Washington and Oregon; and <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br /> Anacortes, Washington, as follows: <br /> Section 1. The City Council of the City of Anacortes finds that purchasing the <br /> Foxboro instrumentation that meet the City's current flowmeter and instrument <br /> transmitter requirements and installed components at the Wastewater Treatment <br /> Plant and pump stations, clearly limits the City of Anacortes to a single source of <br /> supply from Engineered Process Controls, LLC, justifying the waiver of <br /> competitive bidding requirements. <br /> Section 2. The City Council of the City of Anacortes hereby waives the bidding <br /> requirements for the purchase of Foxboro instrumentation for use at the City's <br /> Wastewater Treatment Plant and pump stations, and authorizes sole source <br /> purchasing from Engineered Process Controls, LLC. <br /> Section 3. Any actions of the City or its officers prior to the date hereof and <br /> consistent with the terms of this Resolution are ratified and confirmed. <br /> Section 4.
