DocuSign Envelope ID:AE818173-4843-45AF-B969-10CCF5718F21 <br /> RESOLUTION 3030 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANACORTES, <br /> WASHINGTON, authorizing the purchase of Fairbanks Nijhuis (aka Fairbanks <br /> Morse) pumps, parts, and service for use at the City's sewage pump stations, and <br /> waiving the competitive bidding requirement due to a single source of supply, <br /> pursuant to RCW 39.04.280. <br /> WHEREAS, RCW 39.04.280 provides that the City, by resolution, may waive <br /> competitive bidding requirements when a purchase is clearly and legitimately limited to <br /> a single source of supply, or when the purchase involves special facilities or market <br /> conditions. <br /> WHEREAS, the City currently has Fairbanks Nijhuis (also known as Fairbanks <br /> Morse) pumps installed at four sewage pump stations in the collection system. The <br /> Fairbanks Morse pumps are specifically selected to meet the hydraulic dynamics unique <br /> to each station to efficiently meet the pumping demands; and <br /> WHEREAS, the current discharge plumbing, controls, and hydraulic <br /> performance at the pump stations are specific to the Fairbanks Nijhuis brand of pump; <br /> and <br /> WHEREAS, installing a different brand would require a full modification of the <br /> entire pumping system at each sewage pump station; and <br /> WHEREAS, Fairbanks Nijhuis (formally Fairbanks Morse), has designated <br /> Granich Engineered Products, Inc. as the sole vendor and sole authorized service <br /> professionals of Fairbanks Nijhuis pumps in Washington, Oregon and the panhandle of <br /> Idaho; and <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br /> Anacortes, Washington, as follows: <br /> Section 1. The City Council of the City of Anacortes finds that purchasing the <br /> Fairbanks Nijhuis pumps, parts, and service that meet the City's current sewage <br /> pump station requirements, clearly limits the City of Anacortes to a single source <br /> of supply from Granich Engineered Products, Inc., justifying the waiver of <br /> competitive bidding requirements. <br /> Section 2. The City Council of the City of Anacortes hereby waives the bidding <br /> requirements for the purchase of Fairbanks Nijhuis pumps, parts, and service for <br /> use at the City's sewage pump stations, and authorizes sole source purchasing <br /> from Granich Engineered Products, Inc. <br /> Section 3. Any actions of the City or its officers prior to the date hereof and <br /> consistent with the terms of this Resolution are ratified and confirmed. <br /> Section 4.
