DocuSign Envelope ID: BED111F3-3BEA-413F-A299-30F453E8B78B <br /> RESOLUTION 3019 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANACORTES, <br /> WASHINGTON, authorizing the purchase of CRALEY FibreTM M-Series, an <br /> ANSI/NSF certified micro-duct system, for the City's gigabit passive optical <br /> network ("GPON"), and waiving the competitive bidding requirement due to a <br /> single source of supply, pursuant to RCW 39.04.280. <br /> WHEREAS, RCW 39.04.280 provides that the City, by resolution, may waive <br /> competitive bidding requirements when a purchase is clearly and legitimately limited to <br /> a single source of supply, or when the purchase involves special facilities or market <br /> conditions; and <br /> WHEREAS, the City has used other CRALEY ANSI/NSF certified micro-duct <br /> systems which uses Craley proprietary pipe in pipe technology to build out portions of <br /> the City's telemetry system, and the excess capacity from that system forms the <br /> backbone of the City's fiber-optic based internet network; and <br /> WHEREAS, the City now intends to provide service to customers who cannot be <br /> connected to the City's internet network by aerial lines or underground lines due to <br /> restrictions in the Anacortes Municipal Code and the topography of certain areas of <br /> Fidalgo Island; and <br /> WHEREAS, the City therefore has to use the Craley proprietary technology <br /> micro-duct products to provide internet connection to certain customers through their <br /> water lines using the only product that is compatible with existing infrastructure; and <br /> WHEREAS, Craley Group Limited of Farnborough, Hants United Kingdom, a <br /> company that institutes an ISO 9001-2008 quality management system, is the sole owner <br /> of the patented CRALEY FibreTM M-Series, an ANSI/NSF certified micro-duct system <br /> which allows a hollow micro-duct to be used as a conduit for the City's GPON; <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br /> Anacortes, Washington, as follows: <br /> Section 1. The City Council of the City of Anacortes finds that purchasing the of <br /> CRALEY proprietary technology FibreTM M-Series, an ANSI/NSF certified <br /> micro-duct system for City's gigabit passive optical network ("GPON"), clearly <br /> limits the City of Anacortes to a single source of supply from Craley Group <br /> Limited,justifying the waiver of competitive bidding requirements. <br /> Section 2. The City Council of the City of Anacortes hereby waives the bidding <br /> requirements for the purchase of CRALEY FibreTM M-Series, an ANSI/NSF <br /> certified micro-duct system, and authorizes sole source purchasing from Craley <br /> Group Limited. <br /> Section 3. Any actions of the City or its officers prior to the date hereof and <br /> consistent with the terms of this Resolution are ratified and confirmed. <br /> Resolution 3019 Page 1 <br />
