CITY OF ANACORTES <br />RESOLUTION NO. 1962 <br />A RESOLUTION of the City of Anacortes, Washington, relating to public works; making findings <br />pursuant to RCW 39.04.280; declaring an emergency and authorizing the Public Works Director <br />and Finance Director, under the supervision of the Mayor, to repair damage to the 36" main <br />transmission waterline at 10859 Drawbridge Lane, without solicitation of bids; and authorizing the <br />Public Works Director, Finance Director and Mayor to carry out this authorization. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANACORTES, <br />WASHINGTON, AS FOLLOWS: <br />Section 1. Recitals and Findings. The City Council of the City of Anacortes hereby makes the <br />following findings: <br />I. I On the evening of May 13, 2016, City Street Maintenance received a call regarding a 13- <br />foot sink hole located in the alley parallel to Commercial A venue between 24d1 Street and <br />26111 Street just east of Island Hospital. On Monday, May 16, 2016, the Engineering <br />Department contacted SRV Construction who met with City that afternoon. The morning of <br />Tuesday, May 17, 2016, SRV Construction mobilized to the site and began repair of a failed <br />I 0-inch sanitary sewer line and connecting side services and manholes. <br />1.2 The 10-inch clay sanitary sewer line installed during the early 1900's had disintegrated. <br />Failure of this section of sanitary sewer line raised potential for property damage and risk to <br />human health. <br />1.3 Repairing the damage to the sanitary sewer line is "public work" as defined by RCW <br />39.04.010 (4). <br />1.4 RCW 39.04.280 provides that the City, by resolution, may waive competitive bidding <br />Page 1 of2 <br />Resolulion No. 1962 <br />requirements for public works in the event of an emergency. For purposes Of RCW <br />39.04.280, an "emergency" is any unforeseen circumstance beyond the control of the <br />municipality that either (a) presents a real, immediate threat to the proper perfonnance of <br />essential functions; or (b) will likely result in material loss or damage to property, bodily <br />injury, or loss of life if immediate action is not taken. The collapse of the 10-inch clay line <br />in the alley (described in Paragraph 1.1 above) presented a risk to the immediate area and <br />10-lnch Sanitary Sewer Repair/Replacement located in alley between 24 SI & 26" SI east of Island Hospital
