CITY OF ANACORTES
RESOLUTION NO. 1951
A RESOLUTION of the City of Anacortes, Washington, relating to public works; making fmdings
pursuant to RCW 39.04.280; declaring an emergency and authorizing the Public Works Director
and Finance Director, under the supervision of the Mayor, to repair damage to the 36" main
transmission waterline at 10859 Drawbridge Lane, without solicitation of bids; and authorizing the
Public Works Director, Finance Director and Mayor to carry out this authorization.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANACORTES,
WASHINGTON, AS FOLLOWS:
Section 1. Recitals and Findings. The City Council of the City of Anacortes hereby makes the
following findings:
1.1 On night of March 3, 2016, City Water Maintenance was notified of a line break that
occurred on the redundant 36" water transmission line. On the morning of March 4, 2016
the City restored water service for those homes effected by the break. The water force from
the break eroded a hole over a 10-feet deep and the capacity of the City's equipment wasn't
sufficient to dewater the site and make the repair. On March 7, 2016, the City contacted a
local contractor to provide the necessary equipment to assist the City to repair the pipe.
1.2 The originally install 36" water transmission line provides a redundancy to the City's water
system and until the line is repaired the City operates without redundancy; a potential for
total failure causing property damage and becoming a risk to human health.
1.3 Repairing the damage to the 36" water transmission line is "public work" as defined by
RCW 39.04.010 (4).
1.4 RCW 39.04.280 provides that the City, by resolution, may waive competitive bidding
Page 1of2
Resolution No. 1951
requirements for public works in the event of an emergency. For purposes of RCW
39.04.280, an "emergency" is any unforeseen circumstance beyond the control of the
municipality that either (a) presents a real, immediate threat to the proper performance of
essential functions; or (b) will likely result 'in material loss or damage to property, bodily
injury, or loss of life if immediate action is not taken.
