CITY OF ANACORTES <br />RESOLUTION NO. 1948 <br />A RESOLUTION of the City of Anacortes, Washington, relating to public works; making <br />findings · pursuant to RCW 39.04.280; declaring an emergency and authorizing the Public <br />Works Director and Finance Director, under the supervision of the Mayor, to acquire <br />replacement of damaged sanitary sewer main located in the alley between 251b and 261b <br />Streets and Q and R Avenues, without solicitation of bids; and authorizing the Public <br />Works Director, Finance Director and Mayor to carry out this authorization. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANACORTES, <br />WASHINGTON, AS FOLLOWS: <br />Section 1. Recitals and Findings. The City Council of the City of Anacortes <br />hereby makes the following findings: <br />1.1 The City's sanitary sewer system which includes over 100 miles of sanitary sewer <br />lines is the responsibility of the City's to maintain. <br />1.2 On or about January 20, 2016, a sink hole occurred in the alley between 25th and _ <br />26th Streets and Q and R A venues. <br />1.3 A video investigation was conducted which revealed that the ageing clay sanitary <br />sewer main collapsed and was significantly damaged; a state of imminent potential <br />for total failure causing property damage and becoming a risk to human health. <br />1.4 Installation of replacement pipe to repair the damage is "public work" as defined <br />by RCW 39.04.010 (4). <br />1.5 RCW 39.04.280 provides that the City, by resolution, may waive competitive <br />Page 1 of2 <br />Resolution No. 1948 <br />bidding requirements for public works in the event of an emergency. For purposes <br />of RCW 39.04.280, an "emergency" is any unforeseen circumstance beyond the <br />control of the municipality that either (a) presents a real, immediate threat to the <br />proper perfonnance of essential functions; or (b) will likely result in material loss <br />or damage to property, bodily injury, or loss of life if immediate action is not taken. <br />Emergency Q Avenue Sanitary Sewer Main
