RESOLUTION 1944 <br />A RESOLUTION REAFFIRMING ORDINANCE 2964 AND CONFIRMING THE 6 <br />MONTH DURATION OF THE MORATORIUM CONTAINED THEREIN <br />CONCERNING MEDICAL MARIJUANA COOPERATIVES AND ADOPTING A <br />WORK PLAN. <br />WHEREAS, the Washington State Legislature passed Senate Bill 5052 and House Bill <br />2136 in 2015, which change state law regarding various aspects of retail and medical marijuana. <br />Under the new laws, medical marijuana collective gardens are no longer allowed as of July 1, <br />2016, but new medical marijuana cooperatives will be allowed; and <br />WHEREAS, new state regulations effective January 2016 create new state requirements <br />that must be considered in preparing local rules; and <br />WHEREAS, new medical endorsements will be effective in July of2016; and <br />WHEREAS, the City of Anacortes adopted Ordinance 2964 (the "Moratorium"), which <br />removed those sections of the Anacortes Municipal Code regarding medical marijuana collective <br />gardens and established a moratorium on new medical marijuana cooperatives on December 7 , <br />2015 at a regular city council meeting; and <br />WHEREAS, RCW 36.70A.390 and RCW 35A.63.220 require cities to hold a public <br />hearing within at least sixty ( 60) days of the adoption of such moratoria to develop a work plan; <br />and <br />WHEREAS, the City Council held the public hearing on the work plan on February I, <br />2016, less than sixty (60) days after the adoption of the Moratorium, and the proposed work plan <br />attached hereto; and <br />NOW THEREFORE, BE IT RESOLVED BY THE ANACORTES CITY <br />COUNCIL: <br />1. Reaffirms Ordinance 2964 establishing a Moratorium on Medical Marijuana <br />Cooperatives; and <br />2.
