Based on the information you provided to us, Nationwide Permit (NWP) 3, Maintenance (Federal Register December 27, 2021 Vol. 86, No. 245), authorizes your proposal as depicted on the enclosed drawings dated 24 September 2021. In order for this authorization to be valid, you must ensure the work is performed in accordance with the enclosed NWP 3, Terms and Conditions and the following special conditions: a. In order to meet the requirements of the Endangered Species Act (ESA) and the Magnuson Stevens Fishery Conservation and Management Act (MSA), you must implement and abide by the applicable terms and conditions to implement the reasonable and prudent measures that are associated with "incidental take" and the applicable Essential Fish Habitat Conservation Recommendations as set forth in the Salish Sea Nearshore Programmatic (SSNP) Biological Opinion (BO) (National Marine Fisheries Service (NMFS) Reference Number WCRO-2019-04086) dated June 29, 2022. The specific General Construction Measures, Project Design Criteria, Essential Fish Habitat Conservation Measures, and monitoring and/or reporting requirements applicable to this permit are identified in the enclosed Notification Summary Sheet dated October 17, 2022 (NMFS Reference Number WCRO-2019-04086) and SSNP verification email dated October 27, 2022. USFWS will be informed of this permit issuance. Failure to comply with the commitments made in this consultation constitutes non-compliance with the ESA and your U.S. Army Corps of Engineers permit. The USFWS is the appropriate authority to determine compliance with ESA. c. In order to meet the requirements of the Endangered Species Act you may conduct the authorized activities from July 16 through February 15 in any year this permit is valid. You shall not conduct work authorized by this permit from February 16 through July 15 in any year this permit is valid. Pursuant to Appendix "A" of the Shoreline Master Program (SMP) regulating critical Critical Areas areas, the subject development was reviewed for proximity to critical areas. The subject property is subject to the following: SLX-2021-0018—Trident Seafood Piling Repair Page 1 of 4 SMP A-1: Frequently Flooded Areas Based on FEMA's National Flood Hazard Mapping, the project location is within FIRM panel 5303170040A; this area is identified as Zone AE. Comment received from the City's Floodplain Administrator and Building Department states that a Floodplain Development Permit (FDP) is required for the proposed work if pilings are between low-low water mark and top of flood zone; the need for a FDP would be determined at time of building permit review; a survey with elevations would be required as part of submittal. SMP A-3: Geologically Hazardous Areas Based on the City mapping system, the project locations are in an identified area of tsunami hazard; however, the proposed pilings are to be installed waterward/outside of the identified hazard area. Therefore, this section would not apply to the proposed piling replacement project. SMP A-5: Fish &Wildlife Habitat Conservation Areas Based on the City mapping system, the project location is adjacent to identified Dungeness Crab habitat. To minimize impacts, all work would be required to be conducted during the low water window. The agent, on behalf of the property owner, has requested a Shoreline Exemption for the repair of existing creosote support pilings for the Trident Seafood warehouse structure. The proposed repairs are to occur in two phases over a period of 5 years. 1.1. Phase 1 of the project would entail the repair of 33 piles and Phase 2 would entail the repair of 44 piles, for a total of 77 repaired pilings. 2. During repair, each pile will be hand excavated to expose the timber below the mudline. Depending on the level of deterioration, the pile would be reinforced either by wrapped in galvanized wire mesh/Kevlar or cut off below the mudline. 2.1. If the existing pile has more than 50% of the original timber, the wire mesh or Kevlar would be installed to reinforce the diameter of the pile. 2.2. If the existing pile has less than 50% of the original timber diameter,the deteriorating timber would be cut off at the mudline and a new 12 in. ACZA timber pile would be installed. 3. Once the piling is reinforced, a fiberglass sleeve would be installed around the piling, approximately 2 ft. below the mudline. The fiberglass sleeve would then be filled with non-shrink grout to provide structural stabilization. 3.1. After the grout has been placed,the excavated material would be backfilled by hand around the reinforced base. 3.2. Water or debris that was displaced (trapped within fiberglass jacket) would be pumped out to an upland receptacle; no contaminated water would be discharged into the surface waters. 3.3. Once grout has cured, an epoxy seal would be installed at the top end of the pile to prevent water infiltration into the reinforced piling;the epoxy plug would be sloped to allow drainage away from the piling. 4. Piling caps would either be replaced or repaired, to secure the repaired piling to the existing pier stringers; existing stringers and decking timber would not be including in the proposed repairs. 5. The proposed work would not result in a new impact or overwater coverage. 1. The proposed maintenance project, as conditioned, are consistent with SMP 2.4(E)(2) &WAC 173-27- 040(2)(b). 2. As conditioned, the proposal is consistent with the policies of the Shoreline Management Act. 3. As conditioned, the proposal is consistent with the Shoreline Master Program. Pursuant to WAC 173-27-040(1)(e), the applicant must comply with all work as described within the provided narrative, JARPA, and site plan, or as modified by other agency requirements. 1.1. This exemption is based only on the plans and application materials, noted within the file of record, received from the applicant. The applicant must adhere to the applicable policies and development regulations contained in the City of Anacortes's 2010 Shoreline Master Program including but not limited to those in: Chapter 5, Shoreline Environment&Associated Policies & Regulations; Chapter 6, Environmental Protection General Regulations; and other applicable provisions of the Shoreline Master Program. 3. Pursuant to SMP 2.4(B), this exemption shall expire 5 years from the above date of issuance. 4. Pursuant to SMP DR-9.5.5(d), treated wood materials may be utilized on pilings in repair projects for timber structures, provided the BMPs for the use of Treated Wood in Aquatic and Sensitive Environments, Western Wood Preservers Institute/Wood Preservation Canada/Southern Pressure Treaters'Association/Timber Piling Council, are specified and met. 5. Pursuant to SMP DR-9.5.14, if cumulative repairs to the existing structure-supporting pier over three years would make a proposed repair exceed the threshold of said section, the proposal shall be reviewed as a new pier. 6. Pursuant to RCW 27.53.020 and COASMP 6.4 for Archaeological/Historic/Cultural Impacts, if any artifacts or human remains are found upon excavation, the Samish Indian Nation; the City of Anacortes' Department of Planning, Community, & Economic Development; the City of Anacortes' Police Department; and the State of Washington's Department of Archaeology and Historic Preservation (DAHP)shall be immediately notified and the work in the immediate area cease. 6.1. Pursuant to RCW 27.53.060 it is unlawful to destroy any historic or prehistoric archaeological resources. 7. Best Management Practices (BMPs) must be implemented at all times during the proposed maintenance and repair activities. 8. All applicable local, state, and federal permits and authorizations must be secured prior to work beginning on the site. Copies shall be provided to the city. 8.1. The need for a Floodplain Development Permit (FDP) shall be determined at time of building permit review. 9. The applicant /landowner must comply with federal statutes including but not limited to: The Endangered Species Act, Clean Water Act, Marine Mammal Protection Act, and other federal statutes. 10. Pursuant to WAC 173-27-040(1)(e), a copy of this exemption and attached conditions must be kept on-site and provided to the applicant or contractor and all others working within the shoreline area at all times. The applicant, contractor, machinery operators and all others working within the shoreline area shall have read this exemption and attached conditions and shall follow its conditions at all times. Note: An exemption from the Substantial Development Permit requirements does not constitute an exemption from the policies and use regulations of the Shoreline Management Act, the provisions of the Shoreline Master Program, or other applicable City, state, or federal permit requirements. Guard Navigation(PATON) CITY OF ANACORTES SHORELINE MASTER PROGRAM SMP 2.4.E.2 - Normal maintenance or repair of existing structures or developments, including damage by accident, fire, or elements. "Normal maintenance" includes those usual acts to prevent a decline, lapse, or cessation from a lawfully established condition. "Normal repair" means to restore a development to a state comparable to its original condition within one year after decay or partial destruction except where repair causes substantial adverse effects to the shoreline resource or environment. Replacement of a structure or development may be authorized as repair where such replacement is the common method of repair for the type of structure or development and the replacement structure or development is comparable to the original structure or development including but not limited to its size, shape, configuration, location and external appearance and the replacement does not cause substantial adverse effects to shoreline resources or environment. SMP 3.3 - Nonconforming development, includes shoreline uses and structures which were lawfully constructed, established, or created prior to the effective date of the Act or the Master Program, or amendments thereto, but which do not conform to present regulations or standards of the Master Program or policies of the act. SMP 3.4.1-Nonconforming uses,includes shoreline uses which were lawfully established prior to the effective date of the Act or the Master Program, or amendments thereto, but which do not conform to present regulations or standards of the Master Program or policies of the Act.Any nonconforming use may be continued subject to the following standards: a. Change of ownership,tenancy,or management of a nonconforming use shall not affect its nonconforming status; provided,that the use does not significantly change or intensify. b. Additional development of any property on which a nonconforming use exists shall require that all new uses conform to this Master Program and the Act. c. If a nonconforming use is converted to a conforming use, no nonconforming use may be resumed. d. A nonconforming use which is moved any distance must be brought into conformance with the Master Program and the Act. e. If a nonconforming use is discontinued for a period of 365 or more consecutive calendar days,it shall lose its nonconforming status, and the continued use of the property shall be required to conform to the provisions of this Master Program and the Act.
