Il I J �- MEMORANDUM To: George Khtaian g Finance Director ' Ray Iversen, Building InspectorAV"' From: Dave Ford, Director of Public Works Re: Sewer Hookup Fees a Horizon Heights Addition Date: ,.I ay 30., 1984 As,%you may or may not be aware an agreement between the City of Anacortes and Mr. Ray Jones was taken to court to determine whether or not ,the. City had =the right to assess sewer hookup charges to all property owned by Mr. Ray Jones. The City's contention was that under the. agreement the City did 'have the right to charge sanitary • sewer hookup fees. Mr. Jones' contention was obviously just the opposite® • An interpretation of the contract against the City by a Superior Court Judge was upheld by the Court of Appeals. The ruling was that>,Mr. Jones' property is exempt from paying connection fees for. sanitary sewer.. Therefore, all properties contained within the Present Horizon Heights Additions Noe 1 & 2 and all future Horizon Heights °ad d ,ti:ons may not be charged sanitary sewer hookup fees. Mr.:-:Jones' ioperty, however, is not exempt from payment of water hookup. fees.and the $15 sewer ection fee may also be charged.
