Roll call The city council of the City of Anacortes met in regular session with Mayor Brooks presiding and Councilmen Dwelley, Fulton, Howe , Peters and McCallum responding to roll call. Absent , McCracken _and Olson. Minutes ap.)roved The minutes of the previous meeting ';:ere read and motion :passed adopting same. Report of City .Treas . Report of City Treasurer for .the month of December was presented and motion referred passed referring report to; Committee on Finance. Annual report of Pol. Annual report of Police , ustice was presented and on :.lotion referred to the Justice Committee on Finance. • Annual report of Fire Annual report of Fire Department was presented and read. Motion was passed Dept . adopting same. Communicationfrom Communication from Elmer Ellsworth Hoffman, maker of Government standard Elmer Hoffman re grant powders , asking for grant of land knownas Cranberry Lake reserve for the of land to manufacture purpose of erecting building to manufacture powder, was read and on motion of explosives Councilman Dwelley, seconded by Howe , placed on file. Motion carried. Mayor gives outline Mayor Brooks gave a brief outli::e of the work he hoped to see accomplished of work for year 1928 during the coming year, by the city council , especially the paving of Fourth Street between Commercial and ( Avenues , with a twenty foot strip , the full width to be done later if the property owners desired. Also the paving of Ninth Street from Commercial to E Avenue , and K Avenue from 8th to 17th streets. Jail roof leaks The jail roof was reported as in a leaky condition. A motion was made by Councilman Howe , seconded by Dwelley, referring the matter to the Committee on Building and Sewers. Motion carried. Street signs The matter of street signs was discussed by the city council, and on motion of Councilman Dwelley, seconded by Howe , the Committee on Streets and Parks was authorized to proceed with the placing of signs of the principal streets in the city. New hose for fire dept . Fire Chief Carter addressed the city council, stating that his department was in need of 500 ft. of additional fire hose . Upon motion the City Clerk was instructed to call for bids on fire hose , to be opened the first meeting of the city council in February. New road to Iapp- Valley Councilman Fulton called the attention of the city council to a request for from Whistle Lake road cooperation between the city and county in the securing of a right of way for a new roadwhich would afford a new outlet for the people living in Happy Valley. • This road would proceed along the southern boundary of the city limits from:.the ;Thistle Lake Road in a westerly direction to 0 Avenue , the county to secure the right of way on the south side of the road and the city on the north side. On a motion of Councilman McCallum the Committee on Streets and Parks was in- structed to ascertain if the right of way could be obtained by donation from property owners. Motion carried. G The city council of the City of Anacortes met in regular session with Mayor Brooks presiding and Councilmen Dwelley, Fulton, Olson, Peters and Howe , responding to roll call. Absent, LicCallum and McCracken. The minutes of the previous meeting -,. ere read and motion passed adopting same . . I/ Annual report of Healta Officer, as follows , was presented and read : Your Health Officer submits the following report for the year ending December 31st , 1927. The following contagious diseases were reported during the year: Chickenpox 10 Diptheria 25 .dhooping cough 3 Measles 5 Smallpox 4 Besides the diptheria cases noted above there were 26 aarriers , , school children , who were picked up in an examintation of the ':fliitney achool. In .all cases there were 500 shcool children examined. As you are probably well aware this is the largest number of diptheria cases ever reported in this city, in the sane length of time . In fact • it is more than has been reported in the entire time since the health office ha skept any record. I wish to take t._is opportunity to most earnestly urge that all parents have their children take toxin anti- toxin, before another so.lool year begins, as we are liable to have . a more sever epidemic in the future if this is not done . " Motion as passed to accept and place the reaort on file . • Annual report of the Park Board was presented to the city council, and being read a motion was passed to accept and place the repprt on file . The matter of building shed for protection of the police car was brought to the attention of the city council by councilman Howe , who presented plans for the building. As the cost of the shed would be more than the amount allowed in budget for city- hall expenditures , a motion was made by Councilman Dwelley, seconded by Olson, that the matter be left in the hands of the Building and Sewers Committee for further consideration. Councilman Peters submitted samples of forms for plumbing regulations .. . A motion was made by Councilman Dwelley, seconded by Olson , that the City Clerk be instructed to have the necessary forms printed. . Motion carried. Report of Committee on Fire , :Ater and Light , to thom was refrred the matter of street lightest the corner of 28th and R Avenue , and ene-at-the-eePHep-ef 4th and Q Avenue , recommending that the lights be installed, was read and on motion _. dopted. Councilman McCallum entered the council chamber and the Mayor ordered his name placed ucon the roll. Resolution endorsing the project of the unification of the Great Northern and the Northern Pacific Railway systems , as follows , as presented by ';:. V. 'dells , was read and on motion adopted. WHEREAS, the railway companies which are heavy tax payers are meeting with shapr competition from the motor stages and the motor truck and under conditions that to the said railway companies are unfavorable , and , as a result, are necessarily suffering losses . As an example , there are to and from Anacortes , a city of approximately 7 ,000 people , six round trips daily and on tow days of the week seven round trips made by motor stages , and the passenger train service has been completely wiped out ; and 7I-f REAS, we be- lieve that if said railways can find means for retrenchment. without injury to the public , no obstacle should be placed in their my; a DHEIEA3, if the Great Northern Railway Company and the 'Torthern Pacific Railway Company, through' a consolidation of their systems , can, by eliminating duplications , e tc . , make an economic saving of a'r-)roximately ten million dollars per annum, as it is represented , we believe it is the duty of the said companies would owe to the people throught those territory their lines traverse , as well as to their own stockholders , to effect such a consolidation ; TIDIREFORE, BE IT RES LVED BY.THE l,L'YOi AND CITY :C)UNC IL 02 TEE CITY OF ANACORTES : That we favor and give our endorsement to the project Of the unification of the Great Northern andthe Northern Pacific Rail way systems. Fire Chief Carter asked the city council for lumber and nails to repair the floor of the fire department , stating that his men would do the work. Motion was made by Councilman Olson, seconded by Dwelley , that the matter be referred to the Com:.iittee on Buildings and Devrers . Motion carried . Purpose of meeting The purpose of the meeting was to pass a resolution authorizing and instructing the City Attorney of the City of Anacortes to file a petition in intervention • in the 2:1tter of the application of the Great Northern Pacific ' Railway Com- pany, Northern Pacif is Railway Company, andthe Great Northern )ailti:ay Company for aquisition of control by the former company of the two latter companies through lease and stock ownership, praying for the granting of the said ap- plication. Resolution The resolution was read and on motion of Councilman McCracken, seconded by adopted Olson, the-Eeseltat es was adopted. Roll call : Ayes , Fulton, ucCal1ura, Mc- Cracken and Olson. Hartmann, City Clerk By Deputy Resolution RPSOLUTICN. .7HERLAS, at a regular session of the city council of the City of Anacortes , held on the 17th day of January, 1928 , resolutions were passed by the Mayor and city council favoring and endorsing the project of the uni- fication. of the Great Northern and the Northern Pacific Railway Companies; and .iHIA3, said city , because of its many industrial institutions and its large shipping interests , is vitally interested in the unification of the said railways , and is asking to have the a_:plication of said railway companies for permission to consolidate which is filed with the Interestate Co• .,,erce Commission granted; and is also desirthus of having the privilege to appear before said Commission a t its hearing on said application to urge the granting of said application: TITEREFOITE BE IT ITESOLVED, by the Mayor and city council of the City of Ana- cortes in session assembled: That the City Attorney of the City of Anacortes be auto o.,.ized and instructed to file a petition in intervention in the matter of the application of the Great Northern Pacific Railway Company, Northern Pacific Railway Company and the Great Northern :railway Company for acquisition of control by the former company of the two latter companies through lease and stock ownership, praying for the granting of the said application. D. #104 , made the following lots in Block 25 report: Pursuant to directions of the council sona. time ago , foreclosure Bowmans CSE..F Plat was had upon Lots 1 , 2 , Block 25, Bowman' s Central Ship Harbor '.rater Front Plat L. I .D. yr'l04 of the City of Anacortes, a:agi t County., Washington. Subsequent to the city' s foreclosure the county likewise foreclosed upon this prooerty for general taxes , legall44.y probably eliminating the city' s claim thereto . The county officers are prepared to offer this property for sale and have tentatively agreed t&-c�sfer-t}.1iV- Fel44vtyt-fo-p-sake-; a c?-hwve-teiaba.b vely-e?g?'ee4 with me • that they would be agreeable to accepting an offer of 3100 for their interest . A proposed purchaser has offered to purolia.,e the same for 3300, thus allowing the county 3100 for their interest, it would make a recovery of 3200 for this district by the city. This sale would have to probably be made on a partial payment plan with fifty per cent cash ana the balance in a fear months time. City Attorney on City Attorney , Ben is riftmier , also nude the following report upon Lots 11 and Lots 11 and 12 , 17 , Block 31, Original Plat of the City of Anacortes : Pursuant to directions Block 31, Original of the city council somtianeago , foreclosure we had upon Lots 11 and 12 Plat, reconL_iending Block 31, Original Plat of the City of Anacortes , Skagit County, Washington. quit claim deed Subsequent to this foreclosure the county likewise foreclosed on the same L. I .D. ,f1O4 property for general taxes, thus possibly eliminating the legal claim of the city thereon . The county recently sold this property and the purchaser at the county sale has tendered me the sum of 400 for a quit clim deed from the city in order to clear his title . I would recommend the acceptance of this offer and recomai nd the iatyor and Clerk be authorized to execute a quit clim deed therefor. Motionadopting the report was passed. City Attorney on City Attorney, Ben Driftmier reported as follows on Lots 1 , 2 , 3, and 4, Block • Lots 1,2 ,3 and 4 5, Hensler' s Second Addition: Above property was subject to a 20th street • Block 5, Hensler' s improvement L. I .D. constructed in 1912 , District No . 77 . Sometime Second Add, recommdnd- thereafter, I believe in 1917, the county foreclosed upon this property ing quit claim deed. becoming the purchaser for general taxes, thus possibly eliminating the city' s L. I .D. ;199 and 77 claim thereto , with no possible chance of recovery on behalf of the city. Since that time the city has constructed the south side sewer district, assessing this property for the proposed cost amounting to approximately 240. A proposed purchaser has made to me the following proposition: That if he becomes the successful purchaser from the county of said lots he will pay the city )1.00 Baer lot for a quit claim deed so far as the same is effected by the L. I .D. as. essment of 1912 and will promptly pay the principal of the sewer district assessment . In view of the condition of this title and the connty6 ownership thereof, I would recommend the acceptance of the offer and recommend . that the Mayor and Clerk be authorized to execute the necessary instruments to effect the negotiations. I.D. s Nos . for property outlined 104 and 17, for the recovery of approximately 3604.00. by city attorney Pursuant to published call for bids on 500 ft. of 2" fire hose , bids from Call for bids for 500 G. W. Shannon & Co . , Eureka Fire Hose Mfg. Co . and the American Rubber ft , of 2- " D. J. fire Manufacturing Co . , were submitted. On notion of Councilman Olson , seconded hose by Howe, the City Clerk was instructed to open the bids . Motion carried and the following bids were read: G. W. Shannon & Co . Anacortes : 500 ft. LIotion carried. Conncil reassembles After due consideration of the bids and various samples of hose presented , the city council reassembled . McCallum enters council Councilman McCallum entered the council chamber and the Mayor Pro Tem ordered chamber his name placed upon the roll . Bid award to Eureka Motion was made by Councilman Fulton , seconded by Olson, that the bid of the Fire Hose Mfg . Co . Eureka Fire Hose Mfg . Company for 500 ft. of 2z" Red Cross fire hose 31 . 30 for 500 ft. of fire per ft. be accepted as the best bid. Roll call : Ayes , Dwelley, Fulton, hose Howe, Olson Peters and McCallum. Nays , none . Bids for city printing Bids for city printing were submitted from the Anacortes American and Mercury-Citizen. The city.•clerk was instructed to open the bids, which were as follows : Anacortes American 75 cents per inch first insertion 50 " i1 C° second " Mercury-Citizen 75 " " " first " 55 " " i° second Bid of Anacortes A motion wa . passed accepting the bid of the Anacortes American as the lowest American accepted bid. Crossings on 20th Mrs . Johnson addressed the city council and stated that the street crossings street in bad shape on 20th street were in bad shape and asked if the city should put in these crossirts or if this was up to the property owhers. After some discussion the city council referred the matter to the Committee on Streets and Parks with th power to act. • Claims Claism filed against the Current Expense Fund and other city funds for the months of January, 1928, as fol _ows , were read and upon motion referred to the Co::dittee on Finance : : 1574191 Iebruary 7th, 1928, continued. The city council of toe City of Anacortes met in regular session with Councilmen D.;elley , Fulton , Howe , McCallum, McCracken, Olson and Peters respondig to roll call. Absent , none . In the absence of Mayor Brooks , Mayor Pro Tem McCracken asaumed the chair. The minutes of the previous meeting were read and on motion of Councilman Dwelley seconded by Olson, were adopted as read. Motion carried. Report of City Attorney, Ben i)rifteli -:: , on Ordinance No . 776, being an ordinance amending section 3 of Ordinance No . 596 , stating that same was correct in form , was adopted. The city Attorney stated that the ;rantinm of a new deed to Lary E. Powers for strip of land for road purposes at J7th and Commercial Avenue should be subject to information found by the Cit7 ..ir i seer. A motion was made by Councilman Dwelley, seconded by Howe , that former deed given to Mary E. Powers be ex- amined and if an error should be found in the description of the property by the City Engineer, then new deed be granted. Motion carried. The Chief of Police read his annual rei�ort, which included the following suggestions: In view of the ever increasing traffic it is recommended that the south side bus , when taking on or discharging passengers , be requested to drive all four wheels off the pavement when stops are necessary between 17th street and south terminal . With the establishing of an Arterial Highway, •.:A:ich will- include the full distance of Commercial Avenue and then to the city limits on the Marine Drive , it will be necessary for this little department to give much time to the enforcement of the ordinance regulating the traffif. I am frank to state that to do the work before us we are brought face to face with the same old story, namely, a sufficient force . It is a well established fact that most cities are undermanned with reference to the police departments . There should be one officer to each one thousand inhabitants, in the ordinary situated city. Anu.cortes must prepare to meet a situation :.'rich has been and is present . 'Jith the addition of the police auto we have been able to increase the efficiency of the department wonderfully. This car travels between fifteen and eighteen thousand miles per year . It is respectfully recommended that provision be made in the budget .11 for the next year for the addition of at least one more man to the deoartme nt . It is recommended that the school zones in our city be better marked. The Nelson school, situated as it is furnishes more than the- ordinance traffic problem. It is true that there are signs posted on both ends of this zone as required by law. However, these signs are inadequate , a nd I recommend that the pave- ment be marked ei the r by use of me tal markers or by paint ing in large letters the words "SCHOOL - GO SLO'.I" . I submit , herewith, printed natter on metal rrurkers . These metal disks are imbedded in the pavement and are very durable . A motion was passed to adopt the report . The matter of school signs was referred to the Committee on License & Police with poser to act. The street superintendent reported verbally that three or four street crossings on twentieth street had been provided . Report of Judiciary Committee on Ordinance No . '776 being an ordinance amending section 3 of Urdi nance No . 596 , recommending that the ordinance be passed, was read and adopted . Report of Committee on Fire, ater and Light to \Lom was referred the installation of a fire hydrant at Burrows Bay, recommending that the hydrant be installed for the sum of ,)90 was adopted. Anderson and others for street light at the. corner of 29th and Q Avenue , recommending that the light be installed as requested, also one at the corner of llth and L Avenue, was read and adopted. Petition from H. P. Christenson was read in which he asked for ";;>100 damages to his crop and land on the north shore of Lake Campbell, caused by the overflow or high water in the lake . Powers addressed the city co unci 1 stating that his mother had been unable to complete a sale of property at 37th street and Commercial Avenue due to a mistake in the legal description of the right of way deeded to the city for highway purposes , and that the error was on the part of the city. Mr. Powers asked that the city stand the expense of correcting this error. The matter was referred to the City Engineer . Councilman Fulton stated th:..t the street department vas having considerable trouble with the gasoline engine po .ier at the gravel pit . He recommended that the city buy two 40=horse power motors at the cost of 31400 to run the crusher, saying that the payments could be met by the sale of gravel. A motion was made by Councilman Dwlley, seconded by Olson that the Committee on Streets and Parks make. tentative arrangements with the power company for the motors. Gift of land for The following communication from Douglass Allmond was read ; park purposes "Accompanying deeds are for acreage and lots , the latter in Northern Pacific Addition, gifts to the city by the ' persons signing-the deeds. In making these gifts it is . the belief that if title to the property described rests • in the city, the property will be of greater value to the people than if title remained with individuals. • I/ The lands conveyed, in conjunction with the other with the other lands in sections 23 and 26 now owned by the city, make a total of nearly one thousand acres. Lying within this area is a lake that can in time be developed - • into a body of water of rare beauty; there is a mountain height from which can be had a panoramic view of the San Juan archipelago and of the mainland; there is one of the finest stands of first growth timer to be found in the entire Puget Sound region -- timber such as hovers of forestry have recently bought at a cost of many thousands of dollars and given to the State of Washington for park uses. The ultimate value to the public of this wonderland , now the possession of the City of Anacortes , depends upon its . intelligent and hohest conservation for park purposes by ., the elected officials of the city who are now in office . and those to be chosen in the years to come . One of the deeds contains a clause that the lands conveyed shall be known as "John M. Morrison Natural Park" . This • is a very small tribute to one who gave to the city most generously and unselfishly of his time as Mayor and Councilman and in private capacity wherever he thought the best interests of the city could be advanced; one whose quiet charitable work was in most cases known only • - to the beneficiaries ; one who knew and loved Washington' s woods and through whose influence and work Anacortee .now possesses a more magnificent area of park lands than any city in the northwest. Purchase of two strips The matter of the ,purchase ' of two strips Of land 20 ft. wide and 300 ft. long of land on llth st. between Commercial.and ' Q Avenue on Eleventh 'Street to make the street full between Commercial and Q width instead of 80 'ft. as at present , was considered by the city council. Ave. The strips could be bought from the Great Northern' Rialway Company for $400, to be paid out of the Filling Lowlands Fund. After some •deliberation a motion was made by Councilman McCallum, seconded by Howe , that the city purchaso this property at the price named and that deeds -be accepted. Roll Call, Ayes , Fulton, Howe, McCallu, and Olson, Nays ,. none. Motion carried, . . Bond of J. M, Post Bond of J. M. Post in the sum of one thousand dollars for printing was submitted to the city council and was referred to the Committee on Judiciary and City Attorney. Paving Mayor Brooks called the attention of the city council to the importance of paving more city streets, suggesting that a resolution be passed giving an outline of the streets most in need of paving. He ' referred particularly to Fourth Street ibetween Commercial and Q Avenue , K Avenue from '8th to 17th Streets and possibly 9th.and 10th streets. A motion was made by Councilman McCallum, seconded by Howe , that the Committee on Streets and Parks make an outline of the streets to be paved,&the City Attorney to prepare resoultion to present at the next regular meeting of the city council. Motion carried. House in alley V. V. Wells was present and called the attention of the city council to a shed that extended out into the alley between Commercial and 0 avenues and Second and Third streets, making it impossible for his , tenant to get in or out of his garage, and asking that the shed be moved to ite proper place on the lots. The matter was referred to the police department . Mail boxes on 36th St. Mr. Wells also requested that the mail boxes on Thirty-sixth Street be moved to a new location as he wished to improve.ihis parking strip. On motion of Councilman Olson, seconded by McCallum, the removal of the boxes was left in the hands of Councilmen Howe and Peters of the southside. Motion 'carried. Improvement of 29th St. Virgil Smith appeared before the city council relative to the grading of to cost $400 Twenty-ninth Street between Commercial and R Avenues. The city engineer had made an estimate of coat of $400 for the work, or approximately $10 a lot. A motion was made by Councilman Olson, seconded by McCallum, that as soon as the money was paid into the' treasury• the city would proceed with the grading and gravelling of a roadway. Absent, Dwelley and McCallum. Minutes amended The minutes of the previous meeting were read. Here Douglass Allmond spoke to the city council requesting that the names of E. G. English and Alice K. English be added to the list of donors of the park lands to the city and incorporated 1/. in the minutes, stating that the deed to the property had just been received. A motion was made by Councilman McCracken , seconded by Howe , that the minutes be adopted as amended by the addition of the names of E. G. English and Alice K. English as donors of.. the gift of land park lands to the city, also that letter of thanks be sent to Mr. and Mrs. English for the deed. Motion carried. Street sign at Members of the Nelson Parent-Teacher Association asked the city council to Nelson School put addition-street sighs at the Nelson School because of the traffic and speeders on Commercial Avenue . A motion was passed that the Committee on Streets and Parks paint a sign on the pavement by the school until a more permanent sign could be procured. Improvement of • - Stanley Anderson asked for information concerning the improvement of MN' . 1T Ave. from 20th Avenue from 20th to 22nd,and was told how the residents of 29th Street to 22nd. were collecting among themselves funds for such an improvement after the City Engineer had made an estimate of the cost. Miller and twenty-one Wheeler et al against other property owners on Twentieth Street against the proposed plan for paving of 20th St. paving of said street was read, May 1st being the date of hearing of protests . for Twentieth Street, K Avenue and Fourth Street improvements. At this point Councilman McCracken entered the council chamber and the Mayor ordered his name placed upon the roll. Protest well taken The protest on Twentieth Street represented 60 lots 'out of a total of 197i A motion was made by Councilman McCracken that the protest be well taken and the street be eliminated from the proposed improvement. Motion seconded and • carried. • Remonstrance from Elsie Remonstrance from Elsie Pease Hasse , R. E. Smith, H. .E. Moore and thirty-five Pease Hasse , et al other property owners against the proposed paving of "K1° Avenue from the against paving of "K4' south line of Eighth Street to the south line of Seventeenth Street was read. Ave. The remonstrance represented 83 lots out of a total of 210. A number of verbal protests were also made by property owners present. After a long discussion a motion was made by Councilman Olson, seconded by Peters, that the protest be well taken. Motion carried. No protests against paving of 4th st. be.. There were no written remonstrances against the plan for the paving of Fourth tween Commercial & Q Ave. Street between Commercial and Q Avenues. Fred Werner, representing a majority of the property owners on this street, stated that they desired to put in the pavement themselves without the creation of a local improvement district. In order to hear from all the property owners on this street the city council deferred action until May 15th, 1928. • F. L. Christensen F. L. Christenson of Lake Campbell was present and addressed the city council asks for damages for concerning the overflow of the lake on to his land, and asked an award for reason of overflow of damages. The Mayor instructed the Committee on Fire , Water and Light and the Lake Campbell City Engineer to inspect the damage and report at the next meeting of the city council. Holes in Commercial Councilman McCracken called the attention of the city council to the necessity Ave. pavement of mending the holes in the pavement on Commercial Avenue south.' The street department was instructed to filithe larger holes with asphalt . Fire Chief asks for new Fire Chief Carter announced that a new magneto costing ¢110 was needed for the magneto for fire eng. large fire engine and that .there were no funds available in his department for the payment of it. Fire hazzard at 23rd Fire Chief Carter brought up the matter of frequent fires in the vicinity of and T Ave . 23rd and T Avenue Which he believed originated from sparks from a burner at one of the mills nearby. Carter, Fire Chief, in reporting on the fire hazzard at 23rd & Ti..Avenue , fire hazzard at 23rd stated that the burner on the Western Cedar Company' s mill was too low, the and T Avenue and conveyor not properly housed in and the burner screen out of order. The mill repairing of screen company had signified its intention of putting on a new screen. A motion was on mill burner made by Councilman McCracken that the Fire Chief and Councilman McCallum ask the company to raise the burner and make such changes as were necessary. Ervine re road • "I have had my land recently surveyed and find that about 5/6 of the cemetery road is on my property. The .d ity is having continuous use this strip of land for a road and I am paying the taxes for the same . Will the city therefore take over this strip of land ; 30 feet wide, and have deed made therefor and I will sign it. Herewith is a copy of the surveyro 's description of the tract. Should the Street Committee desire to check up on this matter, I shal be pleased to direct them to the survey stakes . I shall be at home between 10 a.m. and 4 p.m. on Mondys , Tuesdays , Wednesdays , Thursdays and Fridays. ' • The city council expressed their appreciation of this communication and referred the matter to the Committee on Streets and Parks, City Attorney and City Engineer. Petition for Petition from W. R. Young, Ed Schwartz and ten other property owners for the paving of "Kr ' improvement of "K" Avenue from the south line of Eighth Street to the canter line Ave. from 8th of Twelfth Street by paving thirty feet in- width, with curbs, gutters , etc . , was to 12th sts . read. A motion was made by Councilman McCracken , seconded by Dwelley that the petition be referred to the Committee on Streets and Parks and City Engineer. Motion carried. Also a resolution for paving of 9th St. the paving of "K" Avenue from Eighth to Twelfth Streets. Motion carried. Broken sewer Mayor Brooks instructed the Street Superintendent to repair the broken sewer on pipe "T00 Avenue near the Anacortes Lumber & Box Company°s yards. Sidewalk on Cam. Councilman Dwelley reported that the sidewalk on the east side of Commercial Ave . broken Avenue was broken and the railing down over the bay. The Street Superintendent was instructed to repair the damage. Council refers Councilman McCrackenmade a motion that the council refer back to the petition back to "K" Ave , for the paving of K Avenue an order to hear any. expressions from the audience , petition if any, in regard to it. Ed Schwartz was present and stated that the majority of the property owners were in favor of the paving, although not all had signed the petition for it. (McCracken' s motion seconded and carried) . Ditch on 20th Fred Johnson addressed the city council asking if the ditch on 20th street east St, east of Com. of Commercial was ever going to receive any attention, as he had been trying to have this ditch filled for some time and it was virtually on open sewer. The Mayor instructed the Committee on Streets and Parks and City Engineer to have the ditch filled in immediately as it was in a bad condition. Street Superintend ant Lenning said a catch basin was also needed at the Glass Plant. • Eagles wish to Mr. E. M. Hearing of protests This being the day of the hearing of protests against the p 'oposed paving on 4th st. improvement of Kurth Street between Commercial and Q Avenues, the Mayor called for protests. There were no protests, either written or verbal against the proposted improvement. The Mayor declared the time of hearing of protests closed. Resolution for im= Councilman Dwelley made a motion that the resoltuion on the proposed im- provement pf 9th st. provemeht of Ninth Street by paving be held over until the adjourned meeting held over of July 6th. Motion seconded and carried. Easements at Lake City Attorney, Ben Driftmier, stated verbally that his negotions with Campbell for overflow H. P. Christenson, F. L. Christenson and Ole Burgett relative to claim for rights damages for overflow of Lake Campbell on to adjoining lands resulted in the obtaining of tentative easements from them at the following prices : H. P. Christenson ` 50.00. F. L. Christenson. 775. 00 Ole Burgett 1,250.00 At such time as the city ceased to use the water from Lake Campbell the land should revert to the owners. As this was the best agreement the city had been able to obtain after months of negotiating, a motion was made by Councilman Dwelley, seconded by Howe, that the City Attorney be authorized to draw up easements and the Mayor and City Clerk to sign warrants for the respective amounts. Lease of gravel pit The matter of the purchase of approximately five acres of land or the from Clarence E. Pow- Ek of NE-4 of the NW4 of the SU-1 of Section 25, Twp. 35 N Rl E ATM, near ers 38th and D Avenue from Clarence E. Powers , for a gravel pit, for $$750.00, was taken up by the city council. It was decided to lease the property for the balance of the year for 75.00, negotiations to be completed after January 1st, 1929. A motion was made by Councilman Dwelley, seconded by McCallum, that the Mayor and City Clerk be authorized to issue warrant to Mr. Powers for $75.00, and the City Attorney draw up the necessary papers to be signed by the Mayor and City Clerk. I/ ti.e it present meter, this being made necessary because the city cut off their service from the main trunk on Thirty..eighth and W Avenue, because this line was in bad condition. The company also wished .the city to replace the water main from V Avenue to the hydrant in front of their office and change it from a six inch main to an eight inch main, they to stand all of the expense in connection with the change in size , less any credit for material that should be already' in. Allmond, Secretary, for a tele- Board for phone at phone to be installed at Sunset Beach was read and referred to the Committee Sunset Beach on Streets and Parks. Protest against Remonstrance from A. W. Smith, Hamilton, Wash. , against the proposed paving paving of Ninth of Ninth Street was read. Street Remonstrance against the proposed paving of Ninth Street by Gus Hensler, C. L. Judd and thirty-three others, stating that no public necessity existed for the pavement, that the estimated cost of the work was in many instances equal to the present sellingprice of the lots within the proposed district and that many lots would be lost to the the present owners, was read. The protest represented 59.8 per cent of the property invioved,. and while the law allowed the city council to pave over a sixty per cent protest, there was no desire to force the improvement on the property owners. A motion was made by Councilman Howe , seconded by Dwelley, that the protest be well taken. Motion carried. The council thanked Mr. Burke and granted the permission. • Street Commission- Street Commissioner Lenning reported that the sidewalk on the east side of er reports side Commercial between Twelfth and Fifteenth Streets was in sunh a delapidated walk on Commercial condition that it was beyond repair. Motion carried. Water draining Fred Johnson asked the city council if an ordinance existed which compelled off roofs into property owners to take care of the water that drainWf their roofs. Union Oil Company A representative of the Union Oil Company was present ,and addressed the city asks for vacations council, stating that the Company had purchased Block, 1084 tract 4, plate 8 Anacortes tide lands , and wished to have the alley and street vacated, the street end being under water. :The matter was on motion of Councilman Howe , seconded by Dwelley, referred to the Committee on Streets & Parks and City Attorne Fee for plumbing Councilman Peters again brought to the attention of the city council the inspector question of additional fee. for the plumbing inspector, stating that most of the inspections had to be made after regular hours,as the inspector was foreman of the water department, and was unable to leave his regular work to make • plumbing inspections during the day. Motion was made by Councilman Howe , seconded by Dwlley, that the Committee on Buildings and:.Sewers take up the matter again and ascertain if anything could be done . Motion carried. Ronneberger asks B. F. Ronneberger asked the city council to reconsider their decision concerning reconsideration of the repair of the old Rose Theatre building, stating that he thought it could be derision to repair repaired enough :.to cover the fire damage and make it usable.
