HomeMy WebLinkAbout1959 City Council Minutes1 1 December 16, 1958 continued Mr. French requested that the Council give their permission to publish a call for bids to be opened at 2:00 p.m., January 5th for fuel oil and gasoline and also for bids covering the City's liability insurance on all equipment. The Council agreed to grant his request. The City Manager asked the City Council for permission to take a vacation the 2hth and the 26th of December, 1958. Permission was granted. The report of claims against the City for the first half of December, 1958 was read to the Council and hearing no objections, Mayor Pro -tem Berentson referred them to the Finance Committee. Upon favorable report by the Finance Committee, a motion was made by Mr. Strom and seconded by Mr. Bernard, that the claims be allowed and warrants drawn in favor of same. Roll call. Ayes: Ness, Antonius, Fosse, Berentson, Bernard, and Strom. Motion carried. Councilman Strom requested the Council to consider some action in regard to the bad lighting at 35th and Commercial where the highway intersects with Commercial Avenue. The City Manager agreed to take the matter up with the Highway District asking for proper lights as well as traffic direction at this point. The City Water Superintendent, Mr. F. E. Clark, advised the Council that there had been a rupture in a 24 inch transmission line and that he was asking the City to curtain th$ use of water for at least 10 to 18 hours in order to make necessary repairs. The pulp mill had agreed to shut down their operations as well as the two refineries who were curtailing their operations also. MUSTACICH, MAYOR 7 CITY CL January 6, 1959 A regular meeting of the City Council for the City of Anacortes was called to order at 7:30 p.m. with Mayor Mustacich presiding: The Invocation was given by Reverend William Graler. The roll was called with Ness, Antonius, Mustacich, Fosse, Bernard, and Strom present. The minutes of the previous meeting were considered and Mr. Fosse called the Council's attention to the fact that a typographical error was made regarding the R Avenue vacation. This error was so ordered= corrected. After hearing no further corrections or alteriations, Mr. Strom moved and Mr. Bernard seconded that due to the fact that each Councilman had a copy for study and that copies were available at the City Clerk's Office upon request, the minutes be approved as if read. Roll call. All ayes. Motion carried. , The,City Clerk read a letter -from Coderts Heating & Appliance requesting the renewal of the Television Cable Contract with the City. The letter asked that the contract be renewed extending the present terms and conditions to a 10 year period. Mr. Strom moved and Mr. Ness seconded that the renewal be granted. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, Bernard, and Strom. 'Motion carried. The City Clerk read a letter from Henry Biesheuval of the Marine Club Tavern asking for a dance license at a fee of $25. Mr. French stated that he had checked with the Chief of Police who informed him that it would made no difference regarding police control than any other establishment. Mayor Mustacich stated that he had investigated this business and considered it orderly. After more discussion, Mr. Strom moved and Mr. Bernard seconded that the license be issued to Mr. Biesheuval. 22 January 6, 1959 -continued Roll call. Mr. French informed the Council that sealed bids had been opened January 5th for gasoline, fuel oil, etc., and recommended that the low bid fdr each item be accepted. Lour bids were as follows: Shell Furnace Oil $0.1119 Standard Auto Diesel Fuel $0.135 Texas Hi -test Gasoline $0.2345 Island Transfer Fuel Oil $3.74 per BBL Union Regular Gasoline $0.2024 Union Stove Oil $0.1257 Mr. Bernard moved that the recommendation of the City Manager be accepted. Mr. Ness seconded the motion. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, Bernard, and Strom. Motion carried. Mr. French informed the Council that bids had been received on the Blanket Liability Policy for the City. The bid of General of America, bid through Francisco -Webber, was $3,793.58 and the bid of Northwestern Life Insurance, bid throught Scott 0. Richards was $3,030.59. Mr. French stated that he felt the Liability should be increased from $50,000--$100,000 to $100,000 to $300.000 because of the tendencies toward higher damage claims. He also stated that Mr. Richards had informed him that an additional charge of $112 would have' to be made for the increased coverabe. Mr. Webber stated that Generales charge would be about the same. Motion was made by Mr. Mustacich and seconded by Mr. Bernard that the bid of Northwestern be accepted. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, Bernard, and Strom. Motion carried. Mr. Clark stated that some money had been budgeted by the Water Department to take care of smaller claims resulting from water damage. A motion was made by Mr. Strom and seconded by Mr. Fosse that we extend our liability limit=from $50,000--$100,000 to $100,000-4300,000 and include the added premium in the bid price. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, Bernard, and Strom. Motion carried. The City Manager asked for permission from the Council to call for bids on the following: Police Car Hydraulic Backhoe, with loader budket Printing calculator 1511 water meter for the filter plant Mr. Bernard moved and Mr. Strom seconded that the City Manager be given permission to call for the bids. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, Bernard, and Strom. Motion carried. Mr. French informed the Council he felt that a more comprehensive plan was needed for the various insurance policies of the City. He stated Mr. Webber had offered to contact an engineer of his insurance company to make a study and report to the Council. Mr. French recommended that this study be made. Nr. Ness moved to accept the recommendation of the City Manager. Mrs. Antonius seconded the motion. Roll call. Ayes: Nesq, Antonius, Mustacich, Fosse, Bernard, and Strom. Motion carried. Mr. French asked the Council for permission to change the prior service record of Mr. J. B. Goff from 10-3-46 to 1-1-42 in regard to his Statewide Retirement Status. Mr. Fosse moved and Mr. Ness seconded to grant permission. Ro-1 call. Ayes: Ness, Antonius, Mustacich, Fosse, Bernard and Strom. Motion carried. The Council asked that Mr. French contact the officials of West Coast Telephone Company to set a date for a meeting to discuss the proposed business and occupation tax further. The report of claims against the City for the second half of December, 1958, was read to the Council and hearing no objections, Mayor Mustacich r6ferred them to the Finance Committee. N X a 1 Ll 1 - I 23 January 6, 1959 continued Mr. French reported on the Civil Defense Meeting he had attended in Everett last month. Representatives from nearly all cities were present and it was stressed the need for preparedness for every kind og emergency. He also stated that there was available to every city, surplus equipment at a great reduction. Mr. French informed the Council that Mr. Oliver Hauge's name had been submitted as purchaser of any needed items. Mr. French informed the Council that a meeting would be held in connection with the 17th Street Improvement District on January 16,1959 at 7:30 p.m. Mr. French reported on the Legislative Sub Committee 040 District meeting which he had attended. He emphasized the high caliber of our local legislators. He stressed the importance of citizens contacting their legislators on various issues. Mayor Mustacich stated that at the next study meeting the Civil Defense matter would be taken up by the Council. MUSTACICH, MAYOR January 16, 1959 A regular meeting of the City Council for the City of Anacortes was called to order at 7:30 p.m. with Mayor Mustacich presiding. The Invocation was given by Reverend Splawn. The roll was called with Ness, Antonius, Mustacich, Fosse, Berentson, Bernard, and Strompresent. The minutes of the previous meeting were considered. Mr. French stated that the low bid of the Texas Company was listed as Ethyl Gasoline and should be listed as High -Test Gasoline. The minutes were so ordered corrected. After hearing no further corrections or alter- ations, Mr. Berentson moved and Mr. Bernard seconded that due to the fact that each Councilman had a copyfor study and that copies were available at the City Clerk's Office, upon request, the minutes be approved as if read. Roll call. AyeS: Ness, Antonius, Mustacich, Fosse, Berentson, Bernard, and Strom. Motion carried. The City Clerk read a letter from Foster and Kleiser requesting the location of a sign at 21st and Commercial. Mr. French advised the Council that it was not an additional sign but a relocation and the Planning Commission had recommended that Foster and Kleiser be allowed to erect the sign. Mr. Strom moved and Mr. Fosse seconded that the relocation be allowed. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, Berentson, Bernard, and Strom. Motion carried. The West Coast Telephone Company Franchise was then discussed. Mr. French stated that he had been advised by a Bellingham City Official that the City of Bellingham was still negotiating with Pacific Tel and Tel regarding their franchise. He stated further that he felt the City should give the City of Bellingham support in their negotiations. Mayor Mustacich advised the Council he would contact the Mayor of Bellingham giving them full support from the City of Anacortes. Regarding the City's negotiations with West Coast Telephone, the City Attorney advised the Council to hold the negotiations in abeyance until further work from Bellingham. The City Manager asked the Council's permission to call for bids for printing and tires for various City Equipment. Motion carried. The Mayor recommended the following appointments to the History Board: Lloyd Foster, 1 year; C. F. Stafford, 2 years; Wallie Funk, 3 years; Martin Miller, 4 years; and Ann Beesner, 5 years. Mr. Ness moved and Mr. Strom seconded the appointments be made. Mayor Mustacich recommended the History Board be commended for the work they had already done. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, nBerentson, Bernard, and Strom. Motion carried. Mayor Ylustacich recommended that Sargeant Ernest Brooks be appointed to fill the vacancy of Glade Cain, in Civil Defense, who was no longer a resident of Anacortes. Mr. Bernard moved and Mr. Ness seconded that the appointment be made. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, Berentson, Bernard, and Strom. Motion carried. It was decided that the Civil Defense Unit of the City be expanded and this action would be discussed further by the Council at a study meeting. Mayor Mustacich informed the Council that the terms of Don McDugle, Iran Antonius, and Bill Little had expired on the Board: -of Adjustment. The Mayor recommended their re -appointments. Mr. Ness moved and Mr. Berentson seconded that the recommendation be accepted. Roll call. Ayes: News, Antonius, Mustacich, Fosse, Berentson, Bernard, and Strom. Motion carried. Mayor Mustacich informed the Council that the terms of Bill Turner, Steve Dunthorne, and R. E. Smith had expired on the Planning Commission. The Mayor recommended their re -appointments. Mr. Fosse moved and Mr. Ness seconded that the recommendation be accepted. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, Berentson, Bernard, and Strom. Motion carried. Mayor Mustacich informed theCouncil that the terms of Irvin Rydberg and Dr. Tom Brooks had expired on the Park Board, However, he stated that Mr. Rydberg did not wish a re -appointment. After some discussion it was decided that this matter would be taken up with the other members of the Park Board and considered at a later Council meeting. Mayor Mustacich informed the Council that the term of Mr. L. Truleon had expired on the Library Board and recommended the appointment of P. E. Malson. Mr. Bernard moved and Mr. Strom seconded that the recommendation be accepted. Roll call. Ayes: Nest', Antonius, Mustacich, Fosse, Berentson, Bernard, and Strom. Motion carried.. Mayor Mustacich informed the Council that the term of Fred Brokens had expired on the Cemetery Board and recommended his re- appointment. Mr. Ness moved and Mr. Berentson seconded that the recommendation be accepted. Roll call. Ayes: Nesp, Antonius, Mustacich, Fosse, Berentson, Bernard, and Strom. Ilotion carried. Mayor Mustacich recommended that Charles Williams be re -appointed to the Civil Service Commission since his term had recently expired. The City Attorney read an ordinance amending the pease lties affecting the traffic ordinance. Mr. Ness moved and Mr. Berentson seconded that the ordinance be adopted and assigned No. 1253 and that the Mayor and City Clerk be instructed to sign and publish same. Roll ca11. January 16, 1959 continued The Treasurerts report for the month of December, 1958 was read to the Council and ordered placed on file. Mr. French discussed the Legislative Bulletin he had received from the Association of Washington Cities. He discussed Senate Bills No. 25 and No. 51 which were now up before the Rules Committee. He stated he had talked to 11r. Floyd Jennings and that he hopedthe Council members would convey their opinions to the Legislators on the two bills. Mr. Bernard moved and Mr. Strom seconded that telegrams be sent. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, Berentson, Bernard, and Strom. Motion carried. Mr. French reported on the work that the Citizen's Committee were doing on the Storm Sewers. He said that they are doing a tremendous job. The City Manager reported that he had contacted the State Highway Commission regarding the traffic control sign at 35th and Commercial. Mr. Roy Nesbitt, of the State Highway Comm-.ssion, had made a survey and reported that the Department would paint a wide white line and relocate existing signs marking Highway 99 further north to give tourists a more advanced notice of the highway. He also stated they would erect an overhead sign. Mr. French stressed the feeling that there would not be much hope of getting a more suffieient lighting system on the approach of the new highway. The City Manager reported that he had made a study of the total revenue taken in during the free -Christmas parking. He estimated a loss of $106 for the 6 days, the average being $18 per day during the extension of the meters over the Holidays. Mr. French stated that the petition for paving J Avenue was being circulated and so far 67% of the benefitedproperty owners had signed. He also stated that the water lines and storm sewers and sanitary sewers would have to proceed any paving and that the City Engineer is proceeding on the design for the sewer. Mr. French reported that he had met with the 17th Street Improve- ment District to explain what was involved to get views of the benefited property owners. They are still working bh..the petitions. The City Manager stated that certain phases of our Plumbing Code were obsolete. He and the Plumbing Inspector had made a study of the code to find one that would be more advantageous to the City. Mr. French recommended the Council ask the City Attorney to prepare an ordinance adopting this new Plumbing Code with certain reservations. Mr. Bernard moved and Mr. Berentson seconded to accept the recommendation of the City Manager. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, Berentson, Bernard, and Strom. Motion carried. The City Attorney stated that Ray Robinson, 3rd and T Avenue, had contacted him regarding the utilization of T Avenue. The Attorney requested the Council's permission to notify Ames Wrecking Yard to clear T Avenue so that the full utilization of T Avenue may be affected. Mr. Berentson moved and Mr. Ness seconded to give the City Attorney authority to contact Ames Wrecking. Roll call.. Ayes: Ness, Antonius, Mustacich, Fosse, Berentson, Bernard, and Strom. Motion carried. The City Attorney presented the Council with an agreement between the City of Anacortes and Vance Coder regarding the television cable. He recommended that the renewal be allowed as soon as the extension was bonddd and liability insurance was received by the City. The minutes of the previous meeting were considered and after hearing no corrections or alterations, Mr. Ness moved and Mr. Fosse seconded that due to the fact that each Councilman had a copy for study and that copies were available at the City Clerk's Office upon request, the minutes be approved as if read. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse Berentson, and Strom. Motion carried. The City Clerk read two letters from Senator Martin regarding House Bills No. 25 and No. 51. The Council instructed the City Manager to keep in contact with Martin regarding these two bills. The City Clerk read a letter from the Boy Scouts requesting free use of the City Hall Dining Room. Discussion followed after which it was decided to deny the request inasmuch that all other requests of that'.nature had beendenied. Roll call. Ayes: Ness, Antonius, Mustacich. Fosse, Berentson, and Strom. Motion carried. The City Attorney read a Resolution regarding the City's participation in exchange of employment between various public agencies of the State of Washington without loss of service credits earned by such employees in the various pension or retirement systems. After some discussion, it was referred to a study meeting for further contemplation. The City Manager advised the Council that bids had been received on a 16" open -flow meter. The only bid received was from Sparling Meter Compare* in the amount of $956.50. The City Manager recommended that the bid be accepted. Mr. Ness moved and Mr. Strom seconded that the recommendation of the City Manager be accepted. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, Berentson, and Strom. Motion carried. The City Manager informed the Council that he received a bid on a printing calculator for the Engineering Department from Bellingham Business Machines in the amount of $697.50. Mr. French recommended that the bid be accepted. '.Mr.: Fosse moved and Mr. Berentson seconded that the recommendation of the City Manager be accepted. Roll call. The City Manager reported to the Council that he had been studying the sewer charge for connections to the sanitary sewer system. He stated that heretofore a $15 fee had been assessed to persons connect- ing to the sanitary sewer. He also stated this policy had been in force since the adoption of the sanitary sewer system in 1953• He stated that he would recommend a $50 fee to be assessed to those people connecting to the sanitary sewer. After further discussion it was referred to a study session before taking further action. Mayor Mustacich advised the Council that he had contacted Mr. Irvin Rydberg and Mr. Rydberg did not wish to be reappointed to the Park Board. The re -appointment was referred to a study meeting. Mayor Mustacich informed the Council that he had been advised of a State Law stating that a Councilman be appointed to the Civil Defense ADjustment Board. Councilman Strom volunteered. The Council was much in favor of Mr. Strom holding this position. The report of claims against the City for the second half of January, 1959 was read to the Council. The City Attorney stated that he had been in contact with the City Attorney of Bellingham but that the latter had been so busy with other affairs of the City that he had not had time to pursue the City's action regarding the gegotiations with Pacific -Tel and Tel. He stated he would contact 1 I� 1 27 February 3, 1959 continued the Bellingham Attorney and report to the City Council at a later date. Mr. French asked for the Councils support on House Bill No.296, which provides that cities shall receive 10% of the States sales and excise taxes. Mr. French informed the Council that he had talked to Mr. Jennings who was at the Legislature and Mr. Jennings reported to him that there would be a discussion at a later date regarding this bill and he would notify Mr. French who would in turn notify the Council so they could make plans to attend. Mr. French stated that he had received a communication from the State Highway Department notifying him that an engineer would be% in Anacortes to survey the route for the highway to the new ferry terminal. Mr. French stated that work was continuing on the J Avenue project and that the Engineering Department was working on actual cost of water and sewer lines. Mr. French advised the Council that the fill had been completed on Oakes Avenue and that the paving was yet to be started. He also stated we had hired equipment and men at cost from the County. The Council then discussed the sewer, south on 22nd Street, whichhad failed to carry the load of surfacb water in the recent rain. It was decided no action would be taken at this time due to the fact that a storm sewer study was in progress. Mr. French informed the Council that a spring weed survey would be starting soon. He stated that the new ordinance regarding weed abatement would be in effect and he would make a survey to ascertain which streets needed TJeed removal. Mr. Berentson moved and Mr. Ness seconded that the weed survgy be made. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, Berentson, and Strom. Motion carried. Mr. Clark requested the Council to establish the policy of making water main extensions provided the property owners would bear the entire cost of installation plus the regular $60 tap charge. Mr. Berentson moved and Mr. Ness seconded that this charge be made. Roll call. Ayes: Ness, Antonius, Mustacich, Fosse, Berentson, and Strom. Motion carried. Motion carried. 9 February 17, 1959 continued A letter was read from Ray Robinson of Robinson Marine Ways requesting the City to write a letter to Bert Cole, Department of Natural Resources giving the City's approval of Mr. Robinson obtaining a 10 year lease on the Harbor area lying directly north of the north line of U Avenue which is approximately 75 feet deep by 80 feet wide. Mr. Strom moved and Mr. Bernard seconded that the City Manager write a letter to Mr. Bert Cole. Roll call. Ayes: Antonius, Fosse, Berentson, Bernard, and Strom. Motion carried. A letter was read from Mr. Earle Tinius of Statewide Retirement regarding the reciprocity agreement between the City of Anacortes and various other City and State agencies. After discussion, the Council' requested Mr. French to contact Mr. Tinius to get more information and the matter will be taken up at a later date. The City Clerk read a letter from Bob Pleas requesting a dance license to hold dances in the City Hall Gym. A discussion followed the reading of the letter, after which Mr. Fossemoved and Mr. Bernard seconded that the request be denied due to the age of the applicant and that the applicant should be advised to contact an organization or a group of parents to sponsor the dances. Roll call. Ayes: ANtonius, Fosse, Berentson, Bernard, and Strom. Motion carried. Mr. Harley Sutt spoke from the audience requesting an advance of $500 for garbage collection. Mr. Bernard moved and Yr. Strom seconded that Yr. Sutt be advanced the $500 which will be deducted from his payment for the first months coll.ectiom of Rocket Sanitation Company. Roll. call. Little requesting the use of the parking meter in front of Western Auto Supply from January 22, 1959 through March 31, 1959 for a fee of $5. Mr. Bernard moved and Mr. Fosse seconded that Mr. Little be allowed to have the use of the meter, however, the Council instructed the City Manager to notify Mr. Little that in the future the request must be presented to the Council before the car was placed in front of the store. A discussion followed and Mr. Strom asked for an amendment to the motion, which was granted by Mr. Bernard and Mr. Fosse, that additional payment be made by Mr. Little; due to the fact that the automobile would be occupying the meter for approximately 22 months, the exact amount to be determined by the City Manager. The City Clerk read a letter from the Park Board which stated that they fully approved the type of building that the Girl Scouts are planning to erect. It was his recommendation that the bid of Swensen Motors for a 1959 Plymouth in the amount of $2294 be accepted. Mr. French also stated that he would have for his own use, the present Plymouth Police Car, thus saving the City $35 per month in mileage. The City Manager informed the Council that a bid from the Anacortes American had been received for the City's printing for the year 1959. The City Manager's Annual Report for 1958 was received by the Council. Mr. French stated that he had been advised that very few citizens were writing their Legislators regarding Legislation they wished passed by the Legislature. He stressed the need for citizens to contact their Legislators regarding Legislation they wished passed. The report of claims against the City for the first half of February, 1959 was read to the Council. After hearing no objections, Mayor Pro -tem Berentson referred them to the Finance Committee. Upon favorable report by the Finance Committee, a motion was made by Mr. Strom and seconded by Mrs. Antonius that the claims be allowed and warrants drawn in favor of same. Roll call. The City Attorney reported that he had the bond for the City Clerk and. that the bond was in proper from, however, he felt the size of the bond should be increased. The City Manager was requested to look into this matter. The City Attorney also reported that he had the Per- formance Bond for Rocket Sanitation Service. The Bond was a cash bond in Excrow at Peoples National Bank. He stated that in his opinion this bond aas as acceptable as a Surety Bond and that it met all require- ments as to form. The City Attorney requested concurrance of the Council to allow the Mayor and City Clerk to sign agreement of roadway acquisition for the \ new ferry terminal in the event that the matter came up before the next Council meeting. Mr. French stated that Mr. Prothero felt that by working an additional eight days a month he could also take care of the City Pound. He further stated that the initial cost would not exceed $750 and Mr. Escher will hharge wK0 per year on a consultant basis. The Mayor announced that it was now time for the hearing for the improvement of Q Avenge from the north line of lith Street to the south line of 9th Street; 5th Street from the east line of Commercial to the West line of R Avenue; and 9th Street from the east line of Commercial Avenue to the east line of Q Avenue. The Mayor asked if anyone in the audience had any comments. Heatinggno comments from the audience, he declared the hearing on Q Avenue closed. The Mayor announeed that the hearing for the proposed L.I.D. project on 9th Street from 0 Avenue Zb E Avenue was now open. Mr. French outlined the general aspects of the L.I.D. and informed the Council that 15% of the benefited property owners had filed protests in his office. Mr. Wells informed the Council that it was the opinion of Preston, Thorgrimson, and Horowitz that due to the fact that the percentage of remonstrations was so near the 60% limit and that there were certain legal technicalities involving changes of ownerships and whether husband or wife's signature alone were legal, which could only be solved in a court suit, they could not approve the warrants on the proposed L.I.D. Mr. Wells agreed with Preston, Thorgrimson, and Horowitz. Mr. Berentson moved and Mr. Fosse seconded that further action on the proposed L.I.D. No.151 be postponed at this time. Roll call. The City Attorney read a notice to Ralph E. knight and Jane Doe Wright notifying them that a structure on the property located at 23rd and D is a hazard and a fire risk. The attorney read a notice to Vern T. Belson and Harmah F. Beason notifying them that a structure on the property located at 1104 -29th Street is a hazard and a fire risk. The attorney further stated that he had prepared authorizations to be signed by the property owners Iif they desired the city to demolish the buildings. He further stated that if the city demolished the buildings and the property owners refused to pay the payment will be a lien against the property. The City Manager informed the City Council that the Fire Chief had inspected the -property and had informed him that the above mentioned structures were a definite fire hazard. After discussion, Mr. Fosse moved and Mr. Ness seconded that a time limit of thirty (30) days be set and that the City Clerk be authorized to serve the notices upon the property ormers and place a notice on the premises. Motion carried. The City Manager informed the City Council_ that he had met with the Park Board regarding the proposed park improvements to the caretaker's dwelling at leashington State Park. The Park Superintendent spoke from the audience iniormi_ng the City Council that he had received estimates on a gas furnace in the amount of $240.00 and a stone @12,qulating fireplace for $300.00. The City Manager informed the City Council that there uss still money in the budget for home improvement and it was the Park Board's recormgeendation that the improvements be allowed. He stated that he concurred with the Park Board. P`rs. Antonius stated that she had attended the Park Board meeting and that while she approved of an adequate heating system for the care- taker's dwelling she felt a gas furnace would be impractical for the dwelling since there are no natural gas pipe lines and that a fireplace shouldn't be needed to supplement the heating system. She further stated that she felt that the cheapest heating should be considered. Dr. Strom moved and Mr. Bernard seconded that the recommendation of the Park Board and the recommendation of the City Manager be accepted. P.J.YcKay, District Engineer, in regard to the request from the Chamber of Comrerce to have the City Council contact the state highiray department as to possible 12th street states highimy t,6 the new ferry terminal. He stated that Mr. McKay will be in Anacortes to meet reith the city officals, members of the Chamber of Commerce, merbers of the press, and local legislators on the 24th of November. The City Attorney presented the City Council with a Treasurer's notice to be published in conjunction t:� th the final assessment roll on L.I.D. #150. Mr. Bernard moved and N:r. Fosse seconded that the City Clerk be authorized to publish the Treasurer's Notice in the local paper the required amount of times. Motion carried. .The City Attorney informed the City Council that approximately three years ago there tras a hole in the Park Estates Development, After negotiations with Mr. Balch, the City Street Department filled the hole and billed I"r. Balch of Park Estates Development for the work done by the Street Department. At that time a promisory note was issued to Park Estates, however, -the City Clerk was unable to find the note. Mr. Wells,prepared a letter stating that at such time the promisory note should be found, the promisory note would be destroyed. Mr. Berentson moved and Mr. Bernard seconded that the Mayor and Cit;, Clerk be authorized to sign and return the mortgage and that the City Clerk be authorize to sign the letter. However, Mr. Fosse stated that approximately two council meet- ings ago the City Council had granted two similar requests without referral to the Chief of Police and he felt that if the Chief of Police was against the application he could so state and Mr. Fosse then moved an amended motion to grant the license on approval of the Chief of Police., and Dr. Strom seconded. Valentine in which he tendered his resigna- tion from the Library Board and the Mayor reluctantly accepted his resignation and submitted the name of Mr. E. W. Purcell to fill in the remainder of Mr. Vallentine's term. Mr. Fosse moved and Mrs. Antonius seconded that the recommendation of the Mayor's be accepted and Mr. Purcell be appointed to the Library Board. Mayor Mustacich then informed the City Council that it was time for the hearing of the vacation of ten feet from each side of S Avenue from 38th Street to 41st Street with a proper turn around on 41st Street. The City Attorney informed the City Council that the Planning Commission was at present working on the front yard and side yard set -backs and it was their desire to have uniformity in front of residents and that they have at the -present time worked on two ordinances to attain this desired end. The City Attorney stated that the planning Commission requested that they extend the hearing'of this vacation until the second meeting in January at which -time he would . have the ordinances which were now being prepared.
