Commercial Avenue He was informed that 5 P M an December 21, 1972 was the dead line date, and that no Council action would be taken uwtil their regular meeting on January 2, 1973 An ordinance was read to provide for changes in charges to a consumer for tapping a main and to provide for changes in the rates to be charged for the furnishing and sale of city water by the City of Anacortes to consumers outside the corporate limits of the City motion made by Mr Cook and seconded by Mr Perry that this ordinance be approved and accepted and given ORDINANCE NO 1585 Roll Ayes --Lunsford, Perry, Mansfield, Nicholson, Rice, Cook Motion carried An ordinance was read providing for charges for connecting onto the city sewer system Motion made by Or Nicholson and seconded by Mr Perry that this ordinance be approved and adopted and given ORDINANCE NO 1586 Roll Ayes --Perry, Mansfield, Nicholson, Rice, Cook, Lunsford Motion carried An ordinance was read appropriating the 1973 revenues of the City of Anacortes in thevarious departments of the City, the amount to each department as set forth and particularly designated by Ordinance No 1583 Motion made by Mr Mansfield and seconded by Dr meeting in Seattle with the Economic Assistance Authority on Wednesday, December 10, 1972, to further present the City's need for funds for water improvements He re- ported that 61 new residential building permits have been issued this past year and that 46 requests for permits have been turned down because of lack of water in certain areas ,There being.no further business to come before the called to order by Mayor James Rice at 7 30 P M on January 2, 1973 The invocation was given by Captain Gary Souders of the Salvation Army Roll call Mr Jerry Mansfield, Or L E Nicholson, Mr James Rice, Mr Clyde Cook, Mr Floyd Lunsford, Mr Gary Nelson Councilman Robert Perry was absent Mayor Rice requested the Council's pleasure on the minutes of the previous meeting held on December 19, 1972 Motion made by Mr Cook and seconded by Or Nicholson that minutes be approved as if read Roll Ayes --Mansfield, Nicholson, Rice, Cook, Lunsford, Nelson Motion carried Mayor Rice declared a public hearing to be open to consider vacation of alley in block between 30th and 31st Street and "Q" and "R" Avenues This request had been made by McNary-Schork Construction who wish to build apartments on this property There were no comments from the audience and Mayor Rice declared the public hearing to be closed Motion made by Mr Mansfield and seconded by Mr Cook that this request be granted with the understanding that utility easement over the present width of the alley be maintained, the present alley will not be built over thus covering the sewer without obtaining permission from City CounclL, and and that payment 238 Jan 2, 1973 Cont of one-half of the appraised value of the land is paid to the City and City Attorney be instructed to draw up the ordinance to cover this Roll Ayes -- old business, Mayor Rice requested the Council's decision on the re -zone request from Mr Falkenberg to rezone from R-1 to R-3, with contract, property at 1504 29th The Council had held a public hearing on,this December 19, a972, at which time one protest was given Motion made by Mr Cook and seconded by Mr Lunsford that this request be granted and the City Attorney instructed to draw up the protests had been received which amounted to 58 251% Considerable discussion took place on this L I D Some were in favor of dropping it for the present while others were in favor of going ahead with it Mr Bob Way addressed the Council and asked if they would table it until the next Council meeting on January 16, 1973, as this would give the perchants time to have a meeting to discuss this further, as he thought there had been some misunderstanding about the project Motion was made by Dr Nicholson and seconded by Mr Nelson that the Council table their decision until January 16, 1973 carried Mr David Ford, Director of Public Works, asked for Council approval and acceptance of the 24" pipe line rehabilitation, Project WS -Wash -58 Motion made by Mr Lunsford and seconded by Mr Cook that this be approved and accepted and the 30 day lien period started with $5,000 being withheld from the retainage money until such time as a few items have been taken care of by the contractor Roll Nicholson, Rice, Cook, Lunsford, Nelson Motion carried The City Manager reported that he had attended a meeting last week with the Economic Assistance Authority and that Anacortes was still on their list for funds for water improvements within the City The Manager reported that two gentlemen from the Commission had been in Anacortes today to look over the situation and while they were more interested in help for industrial and manufacturing areas, said they would go back and request the Commission to review the situation in Anacortes Mayor Rice stated that if funds were obtained for the water improvements, that some of the Federal Revenue Sharing money would be used to go along with it He also stated that the City would probably sell some G 0 Bonds and money realized from this would be used to pay off some of the outstanding debts of the City , 1 1 1 ZDV Jan 2, 1973 Cont Mr David Ford reported that the City had received their sand spreader Mr Ford also asked for Council permission to call for bids for a Comminutor for the Sewer Department, the cost of which will run between $4,000 and $5,000 and is budgeted for in the 1973 budget motion made by Mr Cook and seconded Mayor Rice called for guest hearings. There were none. Under communications a letter was read from Mr Bill Nielsen requesting vacation of 33rd and 34th Streets, between D and C Avenues, the alleys of Block's 19 and 22, and C Avenue between 33isd and 35th of the Kellog's and Ford's addition to the City of Anacortes The request did not contain the signatures of any of the abutting property owners. Motion was made by Mr. Lunsford and seconded by Mr Nelson that Mr. Nielsen be notified that he would have to obtain signatures of all the abutting property owners before any decision could be made. Motion carried A letter signed by eight property owners and merchants was read The letter stated that property owners and merchants who made written or verbal protests against LID 173, wished to assure the Council, that the primary reason for objecting was the narrowing of the sidewalks. They stated that they still have a strong feeling about this one part of the project, however, if the Council determines that it is not financially feasible to retain the wide sidewalks, that they are prepared to "try to live with it". The letter was signed by H L Trulson, Ralph Bryson, Robert Way, James Funk, Douglas Burton, Bill Turner, Floyd Willette, and Mable Aubert. Under old Business the Council was asked to make their decision on L I D #173, which is the improvement of Commercial Avenue from 2nd to 12th Streets. Mr Bod Way addressed the Council and stated that it was still important to the merchants and property owners to have the wide sidewalks and if there was any way possible to do this, they would appreciate it Councilman Nicholson stated that at a previous meeting he had stated that if more than 50% of the property owners were against the LID that he would vote "No" A motion was made by Mr Mansfield and seconded by Mr. Cook that the City proceed with this LID and that the City Manager call for bids. A motion was made by Mr Nelson that the City Manager obtain costs and designs for the landscaping of Commercial, costs and designs for lighting, and costs for putting in new water lines down Commercial This motion was seconded by Mr Lunsford Roll Ayes -- Lunsford, Nelson, Mansfield, Nicholson, Rice, Cook , Abstain --Perry. Motion carried. It was suggested that citizens of Anacortes turn in their ideas on what they would like in the way of landscaping and lighting. 240 January 16, 1973 Cont Two recommendations were received from the Planning Commission One for the approval of the proposed plat for Horizon Heights, and the other for the approval of the proposed plat of Meadowbrook Addition Motion made by Mr Nelson and seconded by Mr. Lunsford that the Council study these plats at their next study session and that a public hearing date of February 20, 1973 be set. Roll Ayes --Nelson, Perry, Mansfield, Nicholson, Rice, Cook, Lunsford Motion carried ` An ordinance was read which would vacate that certain alley lying within Block 4, Plat of White's First Addition to the City, provided, however, that the City of Anacortes reserve and retain for itself an easement for the construction, installation, repair, maintenance and replacemnt of public utilities and services, and that the owners of propertyabut this alley compensate the City of Anacortes in an amount which equals one-half the appraised value of the area vacated. Motion made by Mr Cookand seconded by Mr. Mans field that this ordinance be approved and adopted and given ORDINANCE NO 1588 Roll Ayes --Perry, Mansfield, Nicholson, Rice, Cook, Lunsford, Nelson. Motion carried. An ordinance was read which would vacate that portion of "N" Avenue in the City of Anacortes abutting Blocks 1 and 2 of King's Addition to the City A motion was made by Mr Nelson and seconded by Mr Lunsford that this ordinance be approved and adopted and given ORDINANCE NO 1589 Roll Ayes --Mansfield, Nicholson, Rice, Cook, Lunsford Nelson, Perry Motion carried Mayor Rice asked for Council approval of the following appointments Leonard Moore to the Civil Service Commission, Rebecca Ostland to the Citizen's Advisory Board and Mrs Don Carlson to the Library Board. Motion made by Mr. Nelson seconded by Mr. Perry that these appointments be approved. Roll Ayes --Nicholson, Rice, Cook, Lunsford, Nelson, Perry, Mansfield Motion carried. The Treasurer's report for December 1972 was presented as follows Receipts Rec and Bal Disbursements Cash Balance Investments 546,239.18 29362t564.61 1,84o,653 65 522,910 96 1,076,o83.05 The City Manager reported that he would like to have some good ideas and drawings turned in for the landscaping of Commercial Avenue. He also reported that Mr. Paul Irwin of Puget Power was working onihe lighting and that trips would be made to other cities to look at what they have It was suggested that anyone interested in this go al on the trips to other cities A letter was read from International Association of Fire Fighters, Local 1537 in which they stated they would accept the following items in their negotiotions with the City. 1--5% pay increase. 2 --Call back time to be based on lztimes the hourly wage Hourly wage be determined by dividing the yearly salary and longevity by 2080 hours. Other hourly wage be determined by dividing the yearly salary plus longevity by 2912 hours. 3 --Improved reduction in on call standby time One man to be off standby time during the night, providing that manpower is available for the protection of the City. They would also like to meet with the Council at their earliest convenience to hopefully reach a mutual agreement on the remainder of the contract. Motion made by Mr. Cook and seconded by Dr Nicholson that this be taken up at next study session Roll Ayes --Rice, Cook, Lunsford, Nelson, Perry, Mansfield, Nicholson Motion carried A motion was made by Mr. Nelson and seconded by Dr. Nicholson that the Planning Commission be asked to study a zone change for Shannon Point in the area where Western Washington College is going to build Roll Ayes --Cook, Lunsford, Nelson, Perry, Mansfield, Nicholson, Rice Motion carried Councilman Perry addressed the Council and stated that the unsigned letter in the las issue of the local paper "did not scare me off and could never scare me off". He Fr stated that the writer of the letter did not have the facts straight and that he was planning on getting an answer written to be published in the paper. Mayor Rice stated that the Western Washington College felt that they did not have to have a city building permit and he felt that they should get a permit, whether or not they paid for it, so that the building inspector could look it over. A motion was made by Mr Cook and seconded by Mr Perry that Western Washington be required to obtain a building permit. City Attorney Mansfield stated that because of State Laws a State Agency does not have to have a permit. Due to this information a motion was made by Dr. Nicholson and seconded by Mr Mansfield that the above motion be tabled so that the Council could have time to look into this further Roll Ayes --Lunsford, Nelson, Perry, Mansfield, Nicholson, Rice. E Nicholson, Mr. James Rice, Mr. Floyd Lunsford, Mr. Gary Nelson Mr. Clyde Cook entered at 7 35 P M and Mr. Robert Perry at 7 40 P.M. Mayor Rice requested the Council's pleasure on the minutes of the previous meeting held on January 169 1973- Motion made by Mr Lunsford and seconded by Dr. Nicholson that minutes be approved as if read Roll Ayes --Nicholson, Rice, Lunsford, Nelson. Motion carried. Mayor Rice called for guest hearings. There were none. I A letter was read from Mr. Stan Jewell in which he requested 30 days time in which to make arrangements to move a mobile home that is parked on his property at 32nd and L. Motion made by Mr. Lunsford and seconded by Dr. Nicholson that he be given 30 days in which to move the mobile home. Roll Ayes --Rice, Cook, Lunsford, Nelson, Nicholson Motion carried. A letter was read from Mr Bill Nielsen requesting a vacation of alleys in Blocks 19 and 22 of Kellogg's and Ford Addition. He was ,joined in this request by Mr. Dean Cook. Mr. Nielsen and Mr Cook represent two-thirds of the property owners abutting these alleys. Motion made by Mr. Lunsford and seconded by Mr. Nelson that this request be turned over to the Planning Commission Roll Ayes --Cook, Lunsford, Nelson, Nicholson and Rice. The Teamster's Labor and Wage agreement and the Fire Department's Wage agreement were discussed The Teamster's Labor agreement being practically the same as the agreement with the Anacortes City Employee's and the wage increase being 5% for 1973 The wage increase for the Fire Department also being 5% for 19?3. Motion made by Mr Lunsford and seconded by Mr. Cook that the Council approve the Agreement and wage increase for the Teamster's Union and also approve the wage increase for the Fire Department. A request was received from the Urban Renewal Department for authorization of land- scaping and permission to call for bids for the landscaping Motion made by Dr Nicholson and seconded by Mr Perry that the landscaping be approved and permission be granted to call for bids Roll Ayes --Nelson, Perry, Nicholson, Rice, Cook, Lunsford Motion carried. Council permission was asked to call for bids for one new police car, two new 2 ton pick-ups, and one new tractor -mower, and also permission to call for bids on the disposa] of seven pieces of old equipment. Council permission was asked for the Telephone Company to install underground cable on city property in the vicinity of Heart Lake Road Motion made by Mr Perry and seconded by Mr. Cook that permission be granted with the understanding that their plans be approved by the city Engineering Department. Urban Renewal Director, Mr. Ken Kinzel, asked for �Oouncil permission to call for bids for sale of property in the Urban Renewal project Mr. Herb Hicks is interested in purchasing approximately 1 2 acres to be used for dry storage for small boats and for marine repair work Motion made by Mr Nelson and seconded by Mr Lunsford that permission be granted Roll Ayes --Rice, Lunsford, Nelson, Perry, Nicholson Nayes-- Cook. The City Manager reported that a cost analysis of Commercial Avenue project had been given to the Council for them to look over The City Manager reported that the Washington Survey and Rating Bureau had given the Fire Department a 5 rating and that the Fire Department was continuing in their efforts to improve The 5 rating saves about $10.00 per household in terms of fire insurance. Mayor Rice announced that there would be a study session of the Council on February 139 1973 at 7 30 P M Mayor Rice asked for Council permission to have the Citizen's Advisory Board work on a comprehensive plan for bike tiails in Anacortes, and also for them to re -draw the ward lines within the city as they are out of balance population wise Motion made by Mr. Cook and seconded by Dr. Nicholson that these projects be turned over to the Citizen's Advisory Board. Roll Ayes --Lunsford, Nelson, Perry, Nicholson, Rice, Cook. Motion carried Mayor Rice announced that in the very near future the Council would be considering raising sewer rates $1 00 per month for residents and also would be reconsidering the $500 00 hook-up charge. Mayor Rice also announced that the signal lights on 6th and on 8th would be inoperative for one week This is on a trial basis to see how it works out. Councilman Nelson asked if somewhere there was any information filed on the piece of playground sculpture that was now in place at'Storvik Park, as it is not what the city thought it would be like. He asked for an investigation on the matter, as he felt the City had been had. Roll Ayes --Mansfield, Nicholson, Rice, Lunsford, Nelson Motion carried Mayor Rice called for guest hearings Mr Brad Fisher addressed the Council and stated that the J C "s, would be holding their annual Trade Fair on April 27, 28 and 29th, 1973, and asked for Council permission to have a carnival on Commercial Avenue between 1st and 2nd Streets Motion made by Mr Mansfield and seconded by Dr Nicholson that permission for the carnival be granted subject to the approval of the Port. Roll Ayes --Nicholson, Rice, Lunsford, Nelson, Perry, Mansfield Motion carried Mrs Eleanor Douglas addressed the Council and asked questions about the bike route being put in by the State Department on 12th Street out to the State Ferry Terminal. Mayor Rice stated that it would be a 6' wide sidewalk which would accommodate pedestrians and bikes and from Commercial to "D" Avenue it would be concrete, and from "D" out to the Ferry Terminal it would be asphalt. Mrs Douglas along with others in the audience expressed their concern over what would happen to the elderly pedestrians and small children when there were large groups of bikes on the sidewalk. They also express- ed concern over over the policing and maintenance of the route Mrs. Helen Vincent addressed the Council and stated that she had been down around Green Lake in Seattle and they had no problems with bikers and walkers using the same route. Councilman Perry stated that the City would no doubt have to come up with a new ordinance to cover all problems that might come up. City Attorney Mansfield was asked to draft a preliminary ordinpnce which would be studied by the Traffic Safety Committee and the Council. 243 February 20, 1973 „ Cont. A request was received from the Anacortes Arts and Crafts asking permission to hold the 1973 Festival at Causland Park. The Festival will be held August 4th,and 5th. They would also like to barricade 8th and 9th Streets between "N" amd "M" Avenues. It was suggested that before permission is granted that the residents in this area be contacted to see how they feel about it Mayor Rice declared a public hearing to be open to'consider the proposed plat of Ray Jones Addition which will be known as Horizon Heights. Mr Ray Jones was in the audience and pointed out the area on a map There is approximately 53 acres in the over-all plat and lot sizes would run from 7500' up to 12,0001. There were no objections and Mayor Rice declared the public hearing to be closed. A Motion was made by Mr. Nelson and seconded by Mr Perry that this proposed plat be approved plus the replatting of the area marked in red on the map. Mayor Rice asked for Council approval of the following appointments Mrs Archie Snow and Danny Coleman to the Citizen's Advisory Committee, and the reappointment of Mr Howard Beckman to the Housing Authority Motion made by Mr Lunsford and seconded by Mr Mansfield that these appointments be approved. Mayor Rice announced that the Fidalgo Recreation Committee would be holding a meeting in the Council Chambers on March 1, 1973 at 7 30 P M Mayor Rice suggested that when the bids are let for the improvements to Commercial Avenue that the construction bidders be requested to employ three or four local people who are on public assistance. Air. Albert Chonzena addressed the Council and inquired about getting water to his property at Summit Park. He stated that back in 1970 that he had been told that when 244 March 69 1973 the new line was completed that he would be able to get water to his property, but he has now been told that in order to have water that he would have to install a six inch line and the cost of the line along with the meters he would need would cost him in the neighborhood of $9,800.00. Mayor Rice explained that the City has a new policy in regards to water outside the city limits and in order 'for Mr. Chonzena to have water it would be necessary for him to comply with the regulations. A petition with 49 signatures was presented. The petition stated that the concerned citizens of 12th Street, requested that the proposed bicycle path be changed from its presently planned location as part of the pedestrian sidewalk, to a location beside the existing highway, so that the pedestrian public may use the sidewalk in safety. Another petition with 170 signatures was presented stating that they were in favor of the bicycle path as it is currently being constructed by the State of Washington. Several in the audience spoke against the path being in the location where it is an others spoke in favor of it. Mayor Rice stated that the path will be completed and if any problems develop something will be done about them. City Attorney Mansfield stated that he would like to talk with some of the people concerned before drawing up an ordinance for rules and regulations on the path. Mr. Roger Raaen addressed the Council and stated that he had noticed a couple of places creating traffic problems. One was on 12th Street from the Odd Fellows Hall out to D Avenue, as people attempting to make either left or right hand turns slowed down and even stopped in attempting to make the turn, the other problem was people making U turns on Commercial Avenue. Total cost of project is $6109586.289 with the retainage of $349075.54 to be released after the 30 day lien period, provided no liens have been filed. Mr. Joe Burger stated he was in favor of leaving ghem in a flashing sequence. Mr. Merrill Iversen, Chairman of the Citizen's Advisory Committee, said that Committee had voted unanimously to request the lights be returned to the normal red and green sequence primarily to aid pedestrians in crossing Commercial Avenue. He also spoke for the Harbor House residents, particularly the handicapped people, who are finding it very difficult to cross the streets without a light to stop the traffic. A request signed by the owners of Tracts 70 to 76 inclusive at Anaco Beach was read. They requested the vacation of an unnamed road lying within the confines of the Plat of Anaco Beach north of the above tracts between the southeasterly line of tract 70 extended northeasterly and the westerly extremity of tract 76. This request was turned over to the Planning Commission for study. A letter signed by ten property owners living in Shannon Heights Addition on 37th Street was read. They requested assistance in correcting a distracting, 111 -prepared, and potentially dangerous situation which presently exists in the cul-de-sac area on the dead-end of 37th Street west of Heart Lake Road. They stated that the property developer had started development of two home sites adjacent to the cul-de-sac approx- imately one year ago and the area had been excavated for potential home sites, but the construction area is now dormant, poorly prepared and unsupervised, and water is run- ning down the street and the excavation is continually filled with at least a foot to a foot and a half of standing water Additionally, an exposed well invites tragedy to small children playing in the area. They requested support in taking whatever action is necessary to 1. properly seal off the well, 2 safeguard the area with adequate fencing and take whatever other corrective actions are necessary to eliminate this type of activity from the area A motion was made by Mr Mansfield and seconded by Dr Nicholson that the City take immediate steps to have this situation corrected Roll Ayes --Nicholson, Rice, Lunsford, Nelson, Perry, Mansfield Motion carried. A request was received from Mr Jack L. McNeal asking permission to build a private boat dock on his lot at Skyline before the home is placed on the lot. It has been the policy of the City not allow an accessory use on a lot before a permit for the primary use is applied for. Councilman Nicholson stated that he thought a contract could be worked out to allow docks to be built and he would like to see the City work something out along these lines. Councilman Perry stated that if a person is allowed to build their dock first it would give them a better idea as to where they wished to place their home, Mr David Ford, Director of Public Works, btated that if the Council feels that the City's policy should be waived in cases where a property owner, such as Mr McNeal, wishes to build a private dock and then at a later date build a home on the lot, then an agreement between the property owner and the City should be made simting a time limit within which a home or the primary use would be built on the property At the end of this time limit, if the property owner has not begun building the primary intended use, then the accessory use (be it dock, garage or whatever) be removed at the owner's expense. A motion was made by Mr. Lunsford and seconded by Mr. Mansfield that Mr. McNeal be allowed to build his dock and that an agreement similar to the above be drawn up between him and the City. Councilman Mansfield stated that one of the reasons for this request was because Port vehicles that are not licensed are using the street, and he also stated that he didn't believe that the Port knew about the meeting of the Planning Commission. A motion was made by Dr Nicholson and seconded by Mr Perry and Mr Mansfield, that this request be tabled until such time as the Planning Commission and Port could meet and discuss the situation. The City Manager asked for Council permission to call for bids for a water tank for the Fire Department This tank to be installed on a truck that the Fire Department has. It was announced that there would be a study session of the Council on April 24, 1973 at 7 30 P.M Mayor Rice read a ltter of resignation from City Manager Harold A. Wyman. Mr. Wyman stated that he would be resigning as City Manager of Anacortes as of May 159 1973• He thanked the Mayor and City Council for the opportunity of working with them for the future development of Anacortes and also thanked the department heads and the different boards for the unselfish time and efforts they have put in for the City. Mr. Meeker addressed the Council and asked for permission for the Meeker Shows to place their carnival on Urban Renewal property for the week of May 7th through May 12th. Mayor Rice informed Mr. Meeker that it has been the policy to have all carnivals and shows of this type sponsored by a local club or fraternal organization. A motion was made by lir. Mansfbeld and seconded by Dr. Nicholson that permission be given for the carnival providing a suitable local sponsor is obtained. A letter signed by a number of local merchants was read in which they stated that they had asked the Anacortes American if they could publish the paper one day earlier each week in order that they might take advantage of their advertising space to in- crease their sales volume. They have been assured by the American that it would be possible to do this, but the fact that the City Council meets on Tuesday would make all Council news a week late in being published They asked the Council if they would consider changing their meetings to the first and third Mondays instead of Tuesdays. The City Attorney read an ordinance which would change the Council meetings to the first and third Mondays. Two letters were read from Fire Chief Bowen in which he recommended that the Lions Club and the Anacortes Church of the Latter Day Saints be given permission to sell "Safe and Sane" fireworks. A letter was read from the Skagit County Auditor's office in which they stated that the division of population in Skagit County has become grossly out of proportion as far as voting precincts go and that a proposed re -districting has been prepared. They propose combining the existing 24 voting precincts of Anacortes into 13 precincts. This action would result in considerable saving of election expense to the taxpayers. They also called attention to the disparity in population of the three wards within the City of Anacortes. Mayor Rice reported that the Citizen's Advisory Committee has been working on a re -distribution of the Wards and recommended that this Committee 252 May 1, 1973 work with the Skagit County Auditors office on this. The improvement of Commercial Avenue from 12th Street to 36th Street was discussed. Mr. Len Clark, of Stevens, Thompson and Runyan addressed the Council and stated that with the funds that the City had available that Schedules III and'V could be done if the landscaping was deleted, and that the landscaping could be negotiated later if it was found that funds would be available A motion was made by Mr. Nelson and seconded by Dr. Nicholson that the low bid from Tri-State Construction Company for Schedules III and V, with the landscaping deleted, be accepted for the improvement of Commercial Avenue from 12th Street to 36th Street, with the landscaping deleted the amount of the bid would be $505,824.90. A recommendation was received from the Planning Commission that the request of the Port of Anacortes to vacate Commercial Avenue between 1st and 2nd Streets, and lst Street between 110" and "P" be approved, with the provision that the City retain perma- nent access to this area, that no_buildings ever be built on the property, and in case these rights of way became unnecessary for Port activity, it would revert to the City at no cost. The firm of Francisco and Webber have appraised this parcel at $1,680.00. The fee for making the appraisal is $78.00. A motion was made by Dr. Nicholson and seconded by Mr. Mansfield that the City Manager be authorized to go ahead with the sale of this property at the appraised price of $19680 00 and that the purchaser be required to also pay one-half of the appraisal fee. Mayor Rice announced that an allocation of $65,000 had been granted to the City of Anacortes by the Economic Assistance Authority for water improvements in the west end of the City Mayor Rice stated that the total cost of the water improvements would be approximately $285,000 with the City having to pay $220,000 of this and in order for this to be done that the Council would shortly be considering the selling of Councilmatic bonds which would be used for this project and also the cities share of Storvik Park and also to make up some deficits that exist in other city funds. Mr. Frank Orwige addressed the Council and stated that about two years ago a petition had been turned in for a Sewer LID which had not been approved and he asked if he could hook on to the sewer line now without having to pay the hook up charge. Free and easy access be provided each business establishment at all times by the Contractors. June 49 1973 e� If the above stated conditions cannot be met, they proposed that the work be delayed until September 19 1973, so that they would not be deprived of the tourist business Acting City Manager David Ford stated that a meeting had been held last Thrusday evening with the business people and they had been informed that every effort would be made to, keep drive ways and accesses open. Mr. Ford stated that the contractors would be moving their equipment in around June 7th and would start work about June 11th. An ordinance was read describing and setting forth the areas covered by the various wards of the City of Anacortes, dividing said wards into voting precincts, numbering said precincts, and repealing Ordinance No. 12849 and constituting Sections 1-2.01 through 1-2.03 of the Official Code. A discussion took place on this ordinance as the County wished to have the precincts numbered in non -numerical order, while the City would prefer that they be numbered numerically. It wasIdecided that the City would go along with the County for this yearts election, but later on would have a new ordinance establishing the precincts in numberical order. A motion was made by Mr Nelson and seconded by Dr. Nicholson to approve and adopt this ordinance and that it be given ORDINANCE NO. 1592 . Mr Ned Andrich and Mr Herb Pearson, members of the Planning Commission, both addressed the Council and stated that the Planning Commission would be in favor of this with certain conditions set forth. One of these conditions would be that in the event the Port no longer had use for this area, that it would revert back to the City. The City Attorney stated that he wassnot sure that a reversion of this type would be legal. There was also some discussion about the property that abuts this area, and about the railroad spur that goes into the Port. Motion carried Mayor Rice declared a public hearing to be open to consider a recommendation from the Planning Commission to change land use to multi -family and change zoning to R^3 in area now zoned M-2 and generally described as lying west of Anacopper Mine Road. Mr. Herb Pearson addressed the Council on behalf of the Planning Commission -and stated that the recommendation had been made so that the area would be in conformity with what is already there. Mayor Rice declared the public hearing to be closed. Motion made by Mr. Mansfield and seconded by Dr. Nicholson that this change be approved and the City Attorney instructed to draw up an ordinance to cover it. A recommendation was received from the Planning Commission that the request for vacation of the North 201 of 15th Street between I and J, and the west 101 of J Avenue lying betweej 15th Street and the alley in block 3 queen Anne Addition, be denied. The request was made by Mr. Frank Orwige and the petition was signed by the abutting property owners. Mr. Orwige made the request as he wished to put a foundation under his house and it was his understanding that the house now extends out on City Right of way approximately four and one-half feet. The Council asked the engineering department to have this surveyed to find out exactly how far the house is on city right of way. An offer was received from Mrs. Jean Main to purchase from the City the D2 of lots 33 and 34, Block 4, Hensler's 2nd addition at a purchase price of $1200.00. This parcel has been appraised at $1680.00. This request was tabled until a later date in order to give the City Attorney time to look into the matter. A request was received for the city to draft an ordinance implementing the Shoreline Management Act of 1971 The Councilmen asked for copies of this ordinance so that they could study it. An ordinance was read defining bicycle path and setting rules and regulations in regard thereto, and constituting Sections 5-2.70.1 and 5-2.70.5 of the official code of the City of Anacortes. Barrett stating that he had recently purchased 1 1 1 June 18, 1973 257 lots 69 7, and 8 of division 13 at Skyline. These lots are zoned commercial with a C-2 designation. Mr Barrett stated that he proposes to develop a "Boat -tel" on this property. This would be a combination of apartments, boats, moorages, shops and offices. His plan is to start the first of five phases of building by October 1, 1973• This would be the first of five proposed three story buildings ehich would contain apartments on the upper two floors and shops or offices on the lower floor. Mr. Barrett requested permission for a temporary conditional use permit to allow him of place upon the property a temproary office and sales facility. The temporary office would be a 14 x 70 foot trailer. The trailer would serve primarily to manage services now or soon to be available from the "Boat -tel". These would be short and long term parking for cars and trailers, rental of moorage, and leasing of boats owned by the "Boat -tel". There would also be a limited food service for coffee, hot dogs, etc The food service would basically use micro -wave cooking A motion was made by Mr Perry and seconded by Mr Mansfield that a temporary use permit be granted for one year Considerable discussion took place as to the allowing of food service out of a trailer, as there would be numerous regulations that would have to be met. Mr. Mansfield withdrew his second to the above motion and Mr. Perry withdrew the motion. Mr. Perry then made a motion which was seconded by Mr. Lunsford that a one year temporary use permit be granted with no food service to be allowed. Roll. Councilman Nelson stated that he was against the vacation and thought perhaps some other method of controlling traffic in this area could be used. Maintenance of the garbage compactor would be the responsibility of Rural Sanitation, a partnership, which partnership would be under contract with the City for said maintenance A proposed agreement between the City of Anacortes and Rural Sanitation was read, 258 June 18, 1973 which would provide for Rural Sanitation to rent the City of Anacortes a garbage compactor and container, sufficient to handle the volume of garbage to be picked up at the Ferry Terminal, and Rural Sanitation would also provide a disposal site for said garbage and provide all necessary maintenance of the compactor City of Anacortes would pay Rural Sanitation $275 00 per month as container rental and the further sum of $75.00 per pickup of garbage. Costs of the disposal program will be proportioned between the County, Cities and Towns based on the population of each It is the intent of the County to implement the State of Washington Minimum Functional Solid Waste Standards with minimal modifications, and Skagit County is applying for a matching grant of fifty pereent to the State Department of Ecology to implement the Skagit Regional Solid Waste Plan Phase II to be implemented November 1, 1973 and Phase III to be implemented by July 1, 1975 Air Johnson presented a resolution to the Council for their approval to confirm and approve this solid waste plan and application for matching funds The resolution was read by the City Attorney and a motion made by Air Nelson and seconded by Air Perry that this resolution be approved and adopted and given RESOLUTION NO 367 Roll. Partington, who are owners of approximately 500 feet of tidelands fronting on Government Lot 40 Section 269 Township 36 North, Range 1 E.W.M. These tidelands lie in front of the Anacortes City Park on Guemes Island and are being used�by the users of the Cit3k Park. The Partingtonts feel that the tidelands should be owned by the City of Anacortes. They ware willing to sell the tidelands to the City at a value to be arrived at by appraisal Another alternative would be for the City to rent the tidelands and a third alternative would be for a trade. The Partington's being willing to trade 400 feet of the tidelands lying in front of the City Park in exchange for the northerly 100 feet of the existing park. After some discussion, this was tabled until more information could be obtained about the value of the tidelands. A request was received from the Water Superintendent for permission to call for bids to remove and or demolish the house and garages that are located on water property at the treatment plant in Mt. Vernon. Numerous requests have been received from people wishing to trent the housejp�but it is in sub -standard condition and would cost to much to bring it up to standard. The City Manager reported on his recommendation on the allocation of Federal Revenue Sharing money as follows. Public Safety -- Fire $ 309000 Park and Recreation 309000 Streets 10,000 Engineering 179000 The City Manager also reported that he had performed an anlysis of the fiscal position of the City, as it pertained to Revenues and Expenditures for the period 1969-1973 This City has revenue that was not available during 1969 which is available at this time as follows sales tax, $127,000 annually, revenue-sharing approximately $87,000 annually, and utility tax on telephones which is estimated to return approximately $249000 annually This makes approximately $2489000 of revenue from sources that were not available in 1969. However, since 19699 salaries have increased by 28% resulting in a cost increase of $1279500 Eleven employees have been added at a cost of approximately $110,000. Fringe benefits have increased due to combining of the State Retirement Systems, the increase in social security, etc , to an amount of approximately $569000. Total increases amount to approximately $293,500. When subtacting the added revenue, there is a deficit of approximately $459500. In addition to this, it is likely that salary increases will 266 September 4, 1973 cost the City an additional $28,000 for 1974 and the repayment of the Council-matic bond issue will cost approximately $36,000 a year. When adding this to the $293,500 increase in expenditures, we come up with a required revenue to maintain present levels of services in 1974, plus providing for the salffiy increases and the Council-matic bond redemption, with a total of $357,000. When we subtract the $248,000 of revenues over the 1969 level, we find that in order to operate on current level, we will be $109,500 short during 1974 Various funds of the City are operating on the float created by other funds which is contrary to statutes. Therefore, it is imperative that the Council consider revenue increases The Staff will study the possibility of increases in utility tax, park and recreation fees and others, and after this study is completed, recommendations will be made to the Council The City ,Manager also reported that he and the City Attorney had met With represents tives of the State Auditor's Office and the Attorney General's Office on August 28, 1973 to discuss the City's position as it pertains to the findings contained in the audit report for the year 1971. This is principally the fact that the City is ex- periencing loss in utility revenues to a point that we are not collecting sufficient money to meet operating and debt service cost. The Attorney General's representative indicated that he would review the audit findings and point out areas in which the City must take action in order to correct the problems. Mr I{en Kinzel, Director of Urban Renewal, addressed the Council and stated that the request from Benson and Odegard to purchase additional property in the Urban Renewal l u 1 1 September 179 1973 267 area had been withdrawn, in order for them to have more time to prepare their plans. Mr. David Ford, Public Works Director, requested the Council's acceptance of the R -Q Avenue cross over paving fob. The work has been completed by Marine Asphalt Company at a total price of $10,135.80 and a 10% retainage of $19013.58 will be withheld for a 30 day lien period which will commence with the acceptance by the Council. At the end of the 30 day lien period, provided no liens have been filed and provided a release has been received from the Department of Labor and Industries, the City will release the retainage to Marine Asphalt. Their main interest is not in owning the land and buildings, but the leasing of improve- ments of this nature Mr Kinzel stated that the Urban Renewal office will continue to cooperate with this corporation, however, at this time, they have made no requests which would initiate action for the advertising of any specific parcel of land. The City Manager replied that he had held a meeting with school officials and members of the Ministerial Association and had presented a program to them for their consideration. Part of the program would be to delay the starting time of the recreation program until after the Church programs are over and also an offer to the Churches to participate with a short program if they so desired. The Manager will continue meeting with the people involved and see what can be worked out. Mayor Rice read a proclamation proclaiming Saturday, October 13th, 1973 as NAVY DAY and calling upon all citizens of Anacortes to take part inappropriate observance of this day. A motion was made by Dr. Nicholson and seconded by Mr. Perry that permission be granted to sign the final contract agreement with EAA. The City Manager gave a report on the financial conditon of the City, stating that as of August 31, 1973 the City had a deficit balance of approximately $530,000 and a projected deficit by the end of the year in the amount of approximately $600,000. He stated that present revenues of the City are not sufficient to cover expenditures and that the City must instigate programs which will rectify the financial condition. The Manager made the following recommendations 1. City impose an additional 5% utility tax upon the electric, gas, telephone and TV cable companies. Approximate revenue from this would be $105,000 annually. Cost to average homeowner would be $1.55 per month. 2. City impose a 7% utility tax on water, sewer, and sanitation services. Estimated revenue from this would $28,000 annually. Cost to averagelhomeowner would be .60¢ per month. 3. Camping fees, boat launching and trailer parking fees be increased so additional revenue would be $69000 annually. 4. Opening and closing of graves be increased by $25.00. Additional income would be approximately $2,400 annually. 5. City enact an ordinance which would impose a rate schedule on water which will provide a 1.50 debt coverage. This is the coverage used by Stevens, Thompson and Runayn in their water rate analysis. 6. City establish a standby fee for committed plant capacity to industries over and above their water usage. 7. That a 10% sur -charge be placed on all industrial water accounts outside of the corporate limits 8. That a 50% sur -charge be placed on all residential and commercial water accounts outside of the City limits. 9. City increase sewer rates so that it would be capable of funding a $1,000,000 bond issure. This would require a residential rate of approximately $4.70 per month and that all commercial accounts be charged at the rate of,100% of waer c ar es except those who can prove the water is not entering the waste disposasys�ems. October 1, 1973 269 10. City issue $600v000 of Councilmatic Bonds in order to eliminate the deficit fund balances. A motion was made by Dr. Nicholson and seconded by Mr. Mansfield that the City Attorney be instructed to draw up the necessary ordinances to cover all of the above recommend- ations. A recommendation was received from the City Manager suggesting that the Sewer connection charge of $500.00 be changed. He recommended that the Council consider amending the ordinance so that a basic fee of $100 would be required for the connection to any lines that were installed at City expense. He felt that this charge would be justified on any line regardless of when it was installed. He also recommended that the Council consider establishing a graduating connection charge equal to $30.00 a year. This money would be equivalent to the amortization costs to the current user on the proposed bond issues for the improvement to the sewer treatment facility, that the maximum accumulative charge for a sewer connection would not exceed $600 00 A motion was made by Dr. Nicholson and seconded by Mr. Mansfield that this recommend - tion be taken up at a study session. The City Manager reported on receiving a letter from Chalet Properties on behalf of Mr. and Mrs. Gibbons who own property on Weaverling Spit and are interested in selling this property to the City for recreational use. They proposed that the purchase of the land could be accomplished by funding through the Interagency Committee for Outdoor Recreation The plan being for the Inter -Agency to provide 75% of the monetary worth of the property while the City would provide 25%. As part of the transaction, Mr. and Mrs. Gibbons would donate a 25%% interest in the property to the City which the City could use its portion of the purchase price. Such a program would be acceptable to the Gibbons if the appraised value of the property was at least $500,000. A motion was made by Dr. Nicholson and seconded by Mr. Nelson that the City Manager look into this proposal a little further and bring the information back to a study session. The City Manager reported that representatives of the natural gas company had been in and discussed with him the competitive nature of the fuel business and inquired as to whether the City has considered placing a utility tax on petroleum fuel. The City Manager recommended that a tax imposed on the petroleum distributors be less than on the natural gas company as they pay 5% tax into the State for the state sales tax while the tax to the natural gas distributors is 3 6%. He suggested that an equitable tax, based on the 7% utility tax to be imposed on the natural gas customer, would be in the vicinity of 3% or 4% for the fuel oil customer. After some discussion by the Council a motion was made by Mr. Mansfield and seconded by Mr. Nelson that a tax of3 bbe set on fuel oil and the City Attorney instructed to draw up an ordinance to cover this. The City Manager advised the Council of a damage claim against the City filed by Burlington -Northern Railway and Mr. Ernest E. Jordan, Jr. The claim has been turned over to the City's Insurance Company for their consideration. Preston, Thorgrimson, Ellis, Holman & Fletcher, attorneys at law would be employed to perform the services for the sum of $1,150.00. The City Manager stated that it would be used to repair the roof on City Hall and for some painting and rearranging of offices. The City Manager stated that there were two vacations granted that have not been paid for as yet, but these two are fairly recent ones. Motion carried The City Manager stated that in the future he thought the City should have some conditions covering street vacations such as a performance bond A request was received from the First Baptist Church for the City of Anacortes to take over the operation and maintenance of a 8" sanitary sewer line located -'---- the south property line of the church, running in a westerly to easterly di: for the following reasons 1 There are presently 3 places connected to this line 2 Mr Falkenberg, located to the south of the church property has received a contract zoning to build some aprtments, this will increase the load on this line 278 December 3, 1973 3 Those presently connected to this line are paying a service charge, presumably this charge is for maintenance and operation of the Sewage Treatment Plant and Trunk lines The church would give the necessary easements to maintain this line if the City will take it over A motion was made by Mr Sortun and seconded by Mr Lunsford that this request go to the City's staff for further study and investigation. The Council turned this request over to the City staff and asked that it be looked into and see if anything could be worked out I Mayor Rice declard a public hearing to be open to consider a request from Puget Sound Power and Light Company to vacate a portion of the alley in between blocks 906 and 907 North Pacific addition, between W 3rd and 4th and Kansas and Illinois Mr. Robe/rt Miner addressed the Council and stated that he lived in this area and was against the vacation A letter from Mr Arne Rommen was read in protest of the vacation This letter was accompanied by a petition against the vacation signed by 47 property owners in this area An Engineer from Puget Power addressed the Counciliand stated that it was necessary for them to enlarge their present sub station or build another one and that it would be better looking than the one they now have. Mayor Rice asked if they could bring in some landscaping plans for the Council to look at Mayor Rice declared the public hearing to be closed Mayor Rice declared a public hearing to be open to consider a request from Cooley - Kipp to vacate the north 10 feet of 33rd street lying east of "D" Avenue.
