Mr Lunsford that this ordinance be approved and adopted and given ORDINANCE NO 1530 Roll Ayes -- Rice, mcDugle, Lunsford, Nelson, Baker, Nicholson motion carried City Attorney Wells gave the second reading on an emergency ordinance authoriz- ing the Sewer Fund to spend $11,000 00 which had not been provided for in the 1970 budget motion made by Mr mcDugle seconded by Mr Nelson that this ordinance be approved and adopted and given ORDINANCE NO 1529 Roll Ayes -- Nicholson, Rice, mcDugle, Lunsford, Nelson, Baker motion carried I An ordinance was read which would establish a revolving fund for making advance payments of travel expenses, and constituting Section 4-22 01 of the Code Motion made by Mr mcDugle seconded by Or Nicholson that this ordinance be approved and adopted and given ORDINANCE NO 1531 Roll Ayes--mcDugle, Lunsford, Nelson, Baker, Nicholson, Rice motion carried An ordinance was read adopting an amendment to the Land Use map of the Comprehen- sive Plan of the City of Anacortes The change would be from R-3 multi -Family Residential to C-2 Commercial for the following described property Lots 3 to 6 inclusive, fractional Lot 7, Fractional Lot 14, and Lots 14 to 18 inclusive, Block 1, Nelson's Addition to Anacortes, Washington motion made by Or Nicholson seconded by Mr Baker that this ordinance be approved and adopted and given ORDINANCE NO 1532 Roll Ayes --Lunsford, Nelson, Baker, Nicholson, Rice, mcDugle motion carried i Claims report for first half of December 1970 was given as follows Salaries and Wages 14,739 25 Expenses 162,676 92 Upon approval of the Finance Committee, motion made by Mr mcDugle seconded by Mr Nelson that claims be approved and warrants drawn for same Roll Ayes -- Nelson, Baker, Nicholson, Rice, mcDugle, Lunsford motion carried Mayor Rice reported that around December 26th or�27th the new filter plant would be in operation and that there might be some rust scales in the water for awhile, and asked the public to bear with it City manager Wyman asked for Council permission to call for bids on police cars Motion made by Mr mcDugle seconded by Mr Baker that permission be granted Roll Ayes --Baker, Nicholson, Rice, mcDugle, Lunsford, Nelson Motion carried carried Councilman mcDugle stated that he wished to express a personal feeling as a Councilman and felt that most of the Council felt as he did in that he was pleased with the city street crew and the work they were doing and also felt all City employees were doing a good ,fob and should be complimented Mayor Rice announced that the public hearing on the assessment roll for L I D No 166 would be held shortly after the first of the year, and due to the large number of people involved, asked the Council to give some thought to spreading the hearings over three or four days in order that all could be heard Due to a child's being hit by a car recently at 22nd and J Avenue, Councilman Lunsford asked that consideration be given to what could be done to make this a safer forner City manager Wyman reported that he had spent some time at this corner surveying the situation, and that it is 4 very bad corner for children and cars and that the cross -walks need to be repainted, and he also thought that some education for children, parents and drivers was in order, as he had noted cars that were exceeding the speed limit, and also school buses Baker, Or L E Nicholson, Mr James Rice, Mr Don McDugle, Mr Floyd Lunsford, Mr Gary Nelson Mr Robert Perry entered the meeting at 7 35 P M Mayor Rice requested the Council's pleasure on the minutes of the previous meet- ing held December 15, 1970 Motion made by Mr Nelson seconded by Or Nicholson that minutes be approved as if read Roll Ayes --Baker, Nicholson, Rice, McDugle, Lunsford, Nelson Motion carried Mayor Rice called for guest hearings Mrs Julie Moe addressed the Council and asked if something could be done to the street at 6th and T as it was in very poor condition Mrs Moe also asked if a street light could be installed be- tween her property and the property facing 6th Street It is very dark and twice lately her house has been broken into and some money stolen Mayor Rice stated that he would have the Street Department look at the street and have something done to repair it, and also look into the possibility of having a street light installed Mr Bill Wooding addressed the Council and asked about the possibility of having a sanitary land fill at the location of the old city garbage dump Mayor Rice replied that this had been looked into at the time the dump was closed and it had been determined that it would take an initial investment of $45,000 to put this into operation and there would be no guarantee as to how long the City would be able to use this location Mayor Rice also stated that at the present time the Councy is making acstudy on the garbage situation and that the City of Anacortes would continue to use the County dump until this study is completed A request was received from Mr MacGregor Allan in which he requested a 45 day extension on the parking project at his building at 21st and Commercial, as Marine Asphalt had been unable to pave because of bad webther conditions Councilman Baker stated that the area is not prepared for paving as per the agreement made with Mr Allan and the City of Anacortes A motion was made by Mr McDugle and seconded by Mr Baker that this extension be permitted with the understanding that all requirements requested in the agreement are complied with Roll Ayes --Nicholson, Rice, McDugle, Lunsford, Nelson, Perry, Baker Motion carried A request was received from Mr A C Thorneycroft to have a small area in front of the apartment at 1116 6th St zoned as a loading and unloading zone Motion was made by Mr Perry and seconded by Or Nicholson that this request be referred to the Traffic'Sefety Committee Roll Ayes --Rice, McDugle, Lunsford, Nelson, Perry, Baker, Nicholson Motion carried Council permission was requested to call for bids on new garbage contract and also for City insurance, bids to be opened January 26, 1971 at 2 00 P M and Council to act on bids on February 2, 1971 Motion was made by Mr Nelson and seconded by Mr McDugle that permission be granted Roll Ayes--McDugle, Lunsford, Nelson, Perry, Baker, Nicholson, Rice Motion carried A request was received from the school district to allow placement of certain traffic signs containing advertising These signs would be sold to individual firms wishing to have their names printed on the bottom of the signs at a cost of $69 50 each It was the general opinion of the Council that the City Manager and Street Superintendent could get together with school officials and the City would put up any signs that might be desired There was some question as to whether or not the signs with advertising on them were legal Councilman Lunsford stated that he thought any public spirited citizen wishing to do something worth while for the schools could do so in some other way, rather than paying for advertising on these signs Motion was made by Mr Perry seconded by Or Nicholson that permission to allow placement of these signs be denied Roll Ayes --Lunsford, Nelson, Perry, Baker, Rice, Nicholson, McDugle Motion carried A request was received for an alley vacation in Block 1, Nelson's Addition, between Floyd Grace's property and property recently purchased by the City of Anacortes The City Attorney pointed out that a petition signed by two- thirds of the abutting property owners would have to be acquired before the Council could take action on this request The City Attorney read a resolution authorizing the execution of proclaimer certificates for the Anacortes Industrial Park Project, Wash R-15 Motion made by Mr Perry and seconded by Mr Lunsford that this resolution be approved and adopted and given RESOLUTION NO 314 Roll Ayes --Nelson, Perry, Baker, Nicholson, Rice, McDugle, Lunsford Motion carried J Jan 5, 1971 Cont The City Attorney read an ordinance adopting an amendment to the Land Use map of the Comprehensive Plan of the City of Anacortes, and repealing Ordinance No 1532, passed and approved on the 15th day of December, 1970 motion made by Or Nicholson and seconded by Mr Perry that this ordinance be approved and adopted and given ORDINANCE NO 1533 Roll Ayes --Perry, Baker, Nicholson, Rice, mcDugle, Lunsford, Nelson motion carried The City Attorney read an ordinance amending the Zoning map of the City of Anacortes The following described area, heretofore placed and classified within the R-3 multi -family residential district, is hereby and shall hereafter be placed and classified in the commercial district I Lots 3 to 6 inclusive, fractional Lot 7, fractional Lot 13, and Lots 14 to 18 inclusive, Block 1, Nelson's Addition to Anacortes, Washington motion was made by Mr Nelson and seconded by Mr Perry that this ordinance be approved and adopted and given ORDINANCE NO 1534 Roll Ayes --Baker, Nicholson, Rice, mcDugle, Lunsford, Nelson, Perry motion carried Mr Farrell, representing the Guardian Insurance Company, addressed the Council and presented a disability plan and rate schedule to cover police and firemen This will be discussed by the Council at their next study session Regular claims against the City for the last half of December 1970 were pre- sented as follows Salaries and Wages 32,185 86 Expenditures 127,142 25 Upon approval of the Finance Committee, a motion was made by Mr Perry and seconded by Mr mcDugle that these claims be approved and warrants drawn Motion was made by Mr Lunsford and seconded by Mr mcDugle that these claims be approved and that in order to provide funds for the payment thereof, revenue warrants be drawn against the L I D No 166 funds in favor of People's National Bank in the total amount of $905 11 dated January 12, 1971 and bearing interest at the rate of 6% per annum from their date of registration, that the proceeds of said interest-bearing warrants be deposited in the L I D No 166 Fund and that cash warrants be drawn upon said fund in favor of said creditors in the amount of $905 11 in payment for work and Mayor Rice reported tht the City of Anacortes would be asked for approximately $1,000 as their share of the costs involved in the apprehension of these drug peddlers There being no further business to carried Mayor Rice called for guest hearings Mr and Mrs Harry Balda, owners of the Island Vending Machine Company addressed the Council and entered a protest on the price of a City business license for vending machines and asked the Council to give consideration to the changing of these rates A petition, signed by more than two-thirds of the abutting property owners re- questing an alley vacation was read The alley is in Block 1, Nelson's Addition to the City of Anacortes lying between the west line of lots 3 and 18 extended a and the west boundary of the railroad right-of-way A motion was made by Or Nicholson and seconded by Mr McDugle that this request be referred to the Planning Commission Roll Ayes --Nicholson, Rice, McDugle, Lunsford, Nelson, Baker Motion carried A letter was read from the Washington Alpine Club requesting permission to use Mt Erie on May 1, 1971 and a letter from The Mountaineers of Seattle was read requesting permission to use Mt Erie on April 17th and 18th, 1971, and also on May 22nd and 23rd, 1971 Motion made by Mr Nelson and seconded by Or Nicholson that permission to use Mt Erie on these dates be granted, with the understanding that the City would n t be held responsible for any accidents Roll Ayes --Rice, McDugle, Lunsford, Nelson, Baker, Nicholson Motion carried A proposal from the Washington Physicians Service to provide insurance for uni- formed personnel was discussed The premium rate per month for uniformed personnel would be $15 30 per month and $25 15 per month for retired or disabled personnel Motion made by Mr Nelson Quinton-Budlong, Inc , was discussed Schematic and design development phases at a cost of $8,040 00, and Construction document phase at a cost of $9,800 00 Motion made by Or Nicholson seconded by Mr Nelson that this proposal be accepted Roll Ayes --Lunsford, Nelson, Perry, Baker, Nicholson, Rice, McDugle Motion carried Mayor Rice asked for Council approval of the re -appointment of Mr W B van Horn to a five year term on the Anacortes Housing Authority Board Motion made by Mr Lunsford and seconded by Mr Perry that this appointment be approved Roll Ayes --Nelson, Perry, Baker, Nicholson, Rice, McDugle, Lunsford Motion carried A request was received from the March of Dimes committee to put up a barricade at 11th and Commercial and 11th and 110" on January 30, 1971 from 9 DO A M to 6 00 P M in order to stop traffic and ask for donations for the March of Dimes Councilman Baker stated that he thought this would put undue pressure on the citizens Fire Chief Bowen stated that he was not in favor of having this particular location blocked off Motion was made by Mr Perry and seconded by Mr McDugle that permission be granted Roll Ayes --Perry, Nelson Nayes--Baker, Nicholson, Rice, McDugle, Lunsford Motion did not carry A resolution was read authorizing the loan of $3,627 00 to the Library Fund, loan of $2,460 00 to the Street Fund, and a loan of $9,330 00 to the Cemetery Fund These loans are necessary for auditing purposes for,the year ending on or before ninety days with interest at 6% Motion made by Mr Nelson and seconded by Mr McDugle that this resolution be approved and adopted and given RESOLUTION NO 315 Roll Ayes --Baker, Nicholson, Rice, McDugle, Lunsford, Nelson, Perry Motion carried A resolution was discussed which would direct the Mayor to advise all appropriate State, County and Municipal agencies of the opposition of the City of Anacortes to any change in state law which would mandate a system of regional libraries that would ,jeopardize control of municipal systems by the cities The Council decided to take this to a study session and meet with the Library Board to disouss this further Councilman Baker also requested that the Council discuss the Library's financial situation with the Library Board A request was read from Mr MacGregor Allan, requesting a 30 day extension on his permit to install a parking lot near his building at 21st and Commercial Avenue Motion was made by Mr Lunsford and seconded by Mr McDugle that Mr Allan be granted an extension to run until June 1, 1971 Roll Ayes -- Nicholson, Rice, McDugle, Lunsford, Nelson, preliminary water rate study had been received and that the Council would be going over it at their next study session Councilman Nelson asked if any action had been taken on a request that a guard rail be installed along the property belonging to Mrs Hutton at 4506 Oakes Avenue As this is part of the state highway, the City Manager was re- quested to contact the State Highways Department and see if they would do anything to correct this situation Councilman Baker suggested that a meeting be scheduled with the Council and the Housing Authority, as there were several things that the Council January 19, 1971 motion made by Mr McDugle and seconded by Mr Lunsford that minutes be approved as if read Roll Ayes --Baker, Rice, Nicholson, McDugle, Lunsford, Nelson motion carried Mayor Rice called for guest hearings Mr Don McKee addressed the Council on behalf of the Western Washington College He stated that the College needed information on the cost of utility services for the west end area where the College will be building a Marine School, and he urged the City to initiate a sewer district that would take care of the entire west end area Mr McKee stated that the first phase of the school construction would be approximately $400,000 and the utility service costs would be included in this figure City Manager Wyman stated that there were two possible alternatives for this situation One would be to run a trunk line from the present treatment plant, and two would be to develop an L I D and come to some type of agreement with Skyline The approximate cost to run a line from the'present plant would be in the neighborhood of $150,000 Mr John Noyes, First Aid instructor for the Red Cross, addressed the Council and stated that for the past three years they have been having first aid classes in the Municipal Building on Thursday evenings and at the present time there is a conflict with an upholstery class that is also meeting on Thursday evenings Mayor Rice asked Mr Noyes to check this out with the City Manager A letter was read reporting on a meeting of the Traffic Safety Commission which was held February 2, 1971, and at which time a discussion was held re- garding the traffic and pedestrian problems during school days at the inter- section of 22nd Street and "J" Avenue It was recommended that a part time auxiliary patrolman be employed for approximately two hours per day, before and after school hours, and that the City of Anacortes and the Anacortes School District explore means of financing such City Manager Wyman reported that it would cost approximately $540 to $600 to provide this service for the balance of the school year The Council decided to discuss this at a study session with the school officials A letter was read from the Washington Alpine Club asking permission to change their date for using Mt Erie from May 2nd to April 25th, 1971 Motion made by Mr Nelson and seconded by Dr Nicholson that permission be granted Roll Ayes --Nicholson, Rice, McDugle, Lunsford, Nelson, Perry, Baker Motion carried A letter was read from The Mountaineers of Tacoma requesting permission to use Mt Erie on April 10, and May Bth and 9th, 1971 Motion made by Mr Nelson seconded by Mr McDugle that permission be granted Roll Ayes -- Rice, McDugle, Lunsford, Nelson, Perry, Baker, Nicholson Motion carried A letter was read from Mr Reg LeBrun resigning his position as a member of the Anacortes Housing Authority Board A motion was made by Mr Nelson and seconded by Mr McDugle that this resignation be accepted with regrets and a letter of appreciation be written to Mr LeBrun for all the work he has done Roll Ayes--McDugle, Lunsford, Nelson, Perry, Baker, Nicholson, Rice Motion carried A letter was read from Marine Asphalt Company in which they requested that payment be made of all amounts over and above the amounts retained or to be retained on 50% of the original amount on Project No 8-2-154 (1), Schedule II, "R" Avenue Truck Route This request was being made in accordance with Chapter 238, Laws of 1963 A motion was made by Mr Nelson and seconded by Mr Perry that this request be granted providing it had the approval of the locate a trailer home on his property for his parents was discussed motion was made by Mr Perry and seconded by Or Nicholson that permission be granted for this trailer on a one year basis and be Rocket Sanitation appeared to be the low bidder Mr John Cheney, attorney for Mr Gordon Meling of the Superior Disposal Company, addressed the Council on behalf of Mr Meling and asked the Council to give consideration to the fact that the Superior Disposal Company, although not the apparent low bidder, did have some reasons why they thought they were the low bidder The reasons given were that they were offering free service to City Hall, city shops, fire and police departments, city parks, and city owned containers located on city streets, and also their containers for com- mercial they were representing Mr Gordon J meling, dba Superior Disposal in regards to the bid notice issued by the City of Anacortes for garbage collection They stated that the procedures used were contrary to the provisions of the law of the State of Washington, and they wished to notify the City that their office would initiate a court lawsuit to enjoin the City of Anacortes if the City persists in its efforts to award the bid to the alleged low bidder This letter was turned over to City Attorney Wells A letter was read from the Anacortes Arts and Crafts in which they stated that this year's festival will be held on July 31 and August 1 and requested per- mission to close off the same area of the downtown streets of Anacortes as has been used in previous years This letter was referred to a study session to be held February 23rd, and a request was made that the committee from Arts and Crafts Festival be notified of the study session Guest hearings were called for and there were none Under old business the garbage contract was brought up Dr Nicholson pointed out that the Council had ,lust received a preliminary report from the Skagit County Planning Commission in regards to disposal sites, and from this report it would appear that it will cost the City somewhere between $14,000 and $19,000 annually for a disposal site, and this would not include the cost of Department of Highways from the Citizens Advisory Committee The letter they wish to send urges the Department of Highways to investigate what methods may be available to enhance the attractiveness of the approaches to the Swinomish Slough Bridge on State Highway No 536 and the intersection of High- way 536 with Commercial Avenue in the City of Anacortes It is the feeling of the Citizens Advisory Committbe that as the new bridge is now under construction, planning for beautification planting should commence immediately A motion was made by Dr Nicholson and seconded by Mr mcDugle that the City estate of John Storvik, who had left a bequest to the City of Anacortes to place a permanent improvement on a public city park in the City of Anacortes The bequest would amount to approximately $29,346 60 It was felt that this money could be used on 32nd Street Park as long as it is used for specific permanent improvements, x e , items that would not be removed to another park or would not wear out and be replaced Also a plaque would have to be provided identifying the source of the funds Mayor Rice gave a report on the statistics to date on the L I D No 166 sidewalk situation 376 contacts have been made with a total response of 256 Total number requesting sidewalks was 61 The cost of sidewalks for this L I D will be $2 75 a running foot Any sidewalks installed after the L I D will be at a higher rate Mayor Rice requested Council approval of schematic plan for 32nd Street Park City manager Wyman pointed out that this plan could be changed in some areas at a later date checking it out to see if it had the required 51% approval of the residents in the area inuolved a Consideration of the garbage contract bids was next on the agenda Three bids were turned in as follows Mr Gordon J meli.ng with a bid of 59 75 percent of the collection Mr Terry Tidrington with a bid of 69 5 percent of the collection Mr Harley Sutt with a bid of 73 5 percent t of the collection Attorney Eugene C Anderson addressed the Council on behalf of his client, Mr Harley Sutt Mr Anderson gave his evaluation of the three bids sub- mitted He pointed out that there were three changes between the first and second bid calls 1 --Percentage paid to bidder was to be on the collections rather than the billing 2 --Bidder was to pay the County charge for the dump site 3 --Cannery account was to be included Taking these three items into consideration there would be approximately a 6% increase between the first and second bid calls, and therefore Mr Sutt had raised his bid to 73 5 percent Mr Anderson pointed out that Mr Sutt had been operating the garbage collection in the City for the past 12 years, and had proven himself to be a responsible person Mr Goedon meling addressed the Council and stated that his company was a responsible company and offered to submit financial statements to the Council if they would like to look them over Mr meling also stated that they had the necessary equipment ready to go and would like the City to vote on the contract `and decide one way or the other Mayor James Rice stated that the Council had held a study session on the bids the previous evening and had agreed not to act on the bids this evening mayor Rice also stated that there was a possibility that the City might operate the garbage collection A motion was made by Mr Rice of Oak Harbor if the City of Anacortes decided to sell them water However, no decision has been made as to whether or not to sell water to Oak Harbor, as Oak Harbor would want to take over the Navy contract and the City of Anacortes prefers to keep their contract with the Navy The City Manager also reported on an estimate received from Marine Asphalt Company to place an overlay on Commercial Avenue from 2nd Street to 12th Street at a price of $22,971 25 and a price of $17,062 50 to prelevel, patch and overlay 10 intersections from 2nd to 12th As'the City plans to completely re -do Commercial Avenue about a year from now, the City Manager thought it might save the City money if the street department was to smooth out the rough spots now and wait until next year when the complete fob can be done, which would include separating the storm drains from the sanitary sewer Mayor Rice announced the the City Council had decided not to lease Heart Lake from the Department of Natural Resources They were asking $4800 per year for the lease Mayor Rice asked for Council approval of the appointment of John Tursi to the Museum of History Board, and the appointment of Gary Nelson as the garbage collection but that she has no garbage to be collected, and she didn't think she should have to pay for a service that she didn't use It was explained to Mrs Montgomery that the City has a compulsory garbage ordinance and that exceptions could not be made The City Attorney read a proclamation which had been issued and signed by Mayor Rice on May 12, 1971 It was proclaimed that a state of emergency exists within the City of Anacortes endangering and threatening the prompt and continuous collection, removal, and disposal of garbage, ashes, refuse, and waste, thereby endangering the public health, safety and welfare, and authorizing the City Manager to take whatever action necessary to ensure the continuous and uninterrupted collection of garbage, which action may include, but shall not be limited to, the leasing of equipment, employment of per- sonnel, and/or contracting for service Under communications a letter was read from Assistant Chief of Police, Gerald A Perkins, in which he asked acceptance of his resignation from the Anacortes Police Department, as he is accepting the position of Deputy Sheriff on Lopez Island, Washington Mayor Rice requested that a letter of have the circus, and issue a permit for the standard flat fee of $20.00 per day Councilman Nelson stated that he would not be in favor of waiving the 5% on this as this had been done before and B --Oak Harbor is obligated to pay for 4.5 MGD beginning the day the 24" water line is put into service. Scheduled rate by our con- sulting firm is $17,113.50 per month, equivalent to 9.5/100 Cu. Ft. C --The 3 MGD addition requested by 1985 will be billed at the rate of 10.50/100 Cu. Ft. D --By 1985 the City of Anacortes may have to eliminate the 3MGD if water is needed locally and the plant capacity has not been increased. They also asked the Council to waive the city license for this purpose. Some discussion took place on the waiving of the license, with various suggestions being made. Mr. Ray Carpenter, representing the Anacortes Jr. Chamber of Commerce, addressed the Council and asked the Council to review the tax and licenses fees for civic civic organizations. -Treasurer shall issue such license upon payment of a sum equal to one-half of the regular license fee prescribed by ordinance for such activity or business This ordinance would in no way change the limits and the people out there who had city water were on a small pumping system which really wasn't adequate to serve those who were on it now, and it had been suggested to the reIsidents in this area that they form an L I D for an adequate water line Mayor Rice declared a public hearing to be open on up -dating the 6 -year Street Improvement Plan The City Engineer pointed out the streets involved on a map Mr Stockwell addressed the Council and asked if there was any possibility of having Fidelgo Road improved, as it would be used for a secondary highway in the event of any trouble or closure on Memorial Highway Mr Raaen addressed the Council and asked if the guard rail at 174 J Aug 17, 1971 Cont 35th and Commercial would be taken out It was pointed out that this guard rail was required by the State Highway Department mayor Rice declared the public hearing to be closed Mayor Rice declared a public hearing to be open to consider an amendment of Ordinance 1407 to include a definition of "mobile home" The definition is as follows A single family transportable structure which exceeds either eight (8) body feet in width or thirty-two (32) body feet in length, with or without a chassis and designed to be used as a dwelling with or without a permanent foundation when connected with the required utilities A mobile home unit may have collapsing or telescoping parts that can be ex- panded, or consist of two or more separate transportable units ,joined at the site into a single structure There were no objections and mayor Rice de- clared the public hearing to be closed A letter was read from Western Washington State College stating that they were concerned about the location at which they could tie in the Shannon Point marine Center sewer to the city system and stated they would apprec- iate any information that is available The engineering firm of Stevens, Thompson and Runyan presented a proposal for studies to be made in Anacortes as follows Storm Sewer Study at a cost of $12,500, Sanitary Sewer Study at a cost of $21,500, Water System Study at a cost of $12,500, Arterial Study at a cost of $4,500, Planning Study at a cost of $7,000, for a total cost of $58,000 They also askedtfor approval of an Aerial Topography to be done by Jay Whiteford and Assoc at a cost of $9,000 A motion was made by Mr mcDugle and seconded by Mr Nelson that the the Council of the public hearings on LID #166 on Wednesday and Thursday at 7 30 P M City Manager Harold A Wyman, asked if he could discuss method of payment with the Council before entering into negotiating an agreement with Burlington Northern for purchase of right of way I He then reported his duscussion with Mr Harley Sutt in offering him the fob of operating the Sanitation Department -for the City under the realm of the budget Mr Sutt had told him that he could not do it on that amount of money He would need at least three drivers, and he would not be as operable as he had been in reference to driving a truck He also asked why the City would have to operate under $59,000 when the bids were based on $100,000 Mr Wells was called in on the discussion and was to do some research for an answer to this question Mr Sutt then offered to work one week under the original offer Mr Sutt addressed the Council stating that he felt that the only fair bid call -was the first one on January 26 when his bid was low at 70% The only change in the second call was the garbage charge to the county He added this to his second bid, and by the time the Council took action, his was the only bid to be considered, but it was still decided that the City would go into the garbage business He felt that the three trucks purchased were inadequate to do the fob, and he believed they had never been serviced and were not ready to be used He stated that he would not be working beyond Wednesday He also felt that Mayor Rice was responsible for the Council not accepting his bid 180 Sept adjacent to their area Mayor Rice read a proclamation designating October 27, 1971 as Navy Day A letter was read from the Anacortes Jaycees in which they stated that they are building a Haunted House attraction for the children of Anacortes with opecing night planned for October 25th and the house to be open every night until October 31st They asked for Council permission to place a banner across Commercial Avenue, at the corner of 22nd and Commercial with an arrow pointing west toward 22nd Street where the house is located at 1014 -22nd Motion made by Mr Nelson and seconded by Mr Sortun that present and quorum for a 15 member committee was 8 members present An observation was made that the range in attendance at committee meetings had been between 6 and 15 for a considerable length of feet, was represented on the petitions and of a total of 120,000 square feet,of area within the pro- posed district, a total of 63,000 square feet of area, or 52 5 percent of the total area, was represented on said petitions It was recommended that any action on this be tabled until such time as a cost estimate has been estab- lished and the people signing the petition notified as to what the professional services as might be required to achieve a beautiful, imaginative and efficient re- development scheme for Commercial Avenue k ' A letter was read from the Anacortes Jayceed requesting permission to hold their annual Christmas Parade on Saturday, December 4, 1971 with starting time set at 10 00 A M The parade would start at 24th and Commercial and go down Commercial Avenue to 5th Federal Aid to the States, designated as the "Topics" program, the general purpose of which is to increase the capacity and safety of arterials in urban areas of the United States It is necessary that these agreements be signed in order that Anacortes can obtain funds for the "Topics" program The council decided to discuss these agreements at their next study session ' Proposed L I D No 172 for They stated that they had had a cement driveway much like their neighbors and the neighbor's was replaced with paving at no cost, but they were charged for the same thing when they had been assured by the City that their driveway would be re placed at no cost to them They also stated that they had received no top soil for their parking strip In addition to the above, they own some lots on 4th Street where they had a concrete walkway from the then existing curb to the sidewalk and now, instead of bringing the area level with the curb and sidewalk, it was pieced together in such a manner as to make it not only ugly, but hazardous as well, and felt it was the City's respon- sibility to bring the parking strip to the level that it should be As this request was not in at the original hearing, a motion was made by Mr Lunsford and seconded by Mr Nelson that the request be denied Roll Ayes --Nelson, Mansfield, Nicholson, Rice, Lunsford Nayes--McDugle Motion carried Mr and Mrs
