invocation was given by Rev Arthur Campbell of the methodist Church Roll call Dr L E Nicholson, Mr Eldon Baker, Mr James Rice, Mr Floyd Lunsford, Mr Don McDugle, Mr Gary Nelson Mr Robert Perry entered the meeting at 7 38 P M Mayor Rice requested the Council's pleasure on the minutes of the previous meeting held December 16, 1969 Motion made by Mr Nelson seconded by Mr Lunsford that minutes be approved as if read Roll Ayes --Baker, Nicholson, Rice, Lunsford, mcDugle, Nelson motion carried Mayor Rice called for guest hearings Mr Richard Stockwell addressed the Council in regard to the application sent in to the Army Corps of Engineers by the City of Anacortes requesting permission for dredging, bulkheading and filling in Fidalgo Bay Mr Stockwell was protesting this project as he felt it would have a detrimental effect on fish and wildlife, conservation, pollution, and general public interest, and he was also concerned because the adjoining property owners did not receive written notice on this proposal Mr Stockwell felt that the project as now proposed would irrevocably destroy, without compensating ,justification, all hope of use of the property as a park or beach site, and he was requesting that a public hearing be held so that the public could properly be notified and all the facts presented Mr mile Moore, also a property owner in this vicinity, addressed the Council and stated that he would like to request that a public hearing be held on this before any decisions are reached Mr William Gallagher, City Engineer, stated that a letter had been received from the Corps of Engineers in which they stated that a decision on the application had been postponed so that further study could be made Mayor Rice stated that no action would be taken on the City holding an election on changing the form of government until a written opinion from the Court is received Under communications a letter was read from Mr T G Thompson stating that he had written to the Interagency Committee for Outdoor Recreation to inquire about the current status of the Anacortes Open Space application for Ship Harbor, and he attached their reply to his letter The letter from the Interagency Committee stated that they had not received any official confirmation from either the Port or the City as to the status of the property, particularly as it related to the proposed marine development, and it was their position that this matter should be resolved on a local level with a general agreement as to the availability of the property and a firm indication as to how the property will be put into public use before it could be considered further for funding assistance Mr Thompson asked that the City take immediate steps towards meeting these conditions Mayor Rice presented a plaque to Mrs Marie Hapeman for the Museum Board The plaque listed the names of the original members of the Museum Board Mrs Ann bessner and Mrs Madge Stafford, both original members of the Board were to '\ increase the monthly charges for garbage collection from $1 25 per month to $1 65 per month A motion was made by Dr Nicholson and seconded by Mr Perry that this ordinance be approved and adopted and given ORDINANCE NO 1501 Roll Ayes --Baker, Rice, Lunsford, mcDugle, Nelson, Perry, Nicholson motion carried A proposed ordinance was read which changed the land use map of the Compre- hensive Plan of the City, which changes the Commercial C-2 District classi- fication for acreage in the Skyline area of the City of Anacortes to Residential R-1, single family residence district motion made by Mr Perry seconded by Mr Baker that this ordinance be approved and adopted and given ORDINANCE NO 1502 Roll Ayes --Rice, Lunsford, mcDugle, Nelson, Perry, Nicholson, Baker Motion carried - A proposed resolution was read approving and providing for the execution of a third amendatory contract amending Loan and Grant Contract No Wash R-15 (LG) by and between the City of Anacortes and the United States of American r motion made by Mr Perry and seconded by Mr mcDugle that this resolution be approved and adopted with the understanding that all correspondence to San Francisco alert them to the fact that we are staying with the original contract as far as interest rates go This is to be RESOLUTION NO 276 Roll Ayes -- Lunsford, mcDugle, Nelson, Perry, Nicholson, Baker, Rice motion carried A proposed ordinance was read declaring the policy of the City with respect to the underground relocation and installation of existing and new electric and communication facilities within the City of Anacortes, providing certain minimum requirements and procedures relating thereto, and constituting Article 8-13 of the Official Code of Ordinances of the City of Anacortes motion made by Mr Perry seconded by Or Nicholson that this ordinance be approved and adopted and given ORDINANCE NO 1503 Roll Ayes --Nelson, Perry, Nicholson, Rice, Lunsford Nayes--mcDugle, Baker motion carried Claims against L I D No 166 were presented as follows Commercial Excavating for materials $2,435 90 Concrete NorWest for materials 697 69 I Motion made by Mr mcDugle seconded by'mr Nelson that these claims be approved and that in order to provide funds for the payment thereof, revenue warrants be drawn against the L I D No 166 funds in favor of Grande and Co , Inc , in the total amount of $3,133 59 dated January 12, 1970 and bearing interest at the rate of 6% per annum for their date of registration, that the proceeds of said interest-bearing warrants be deposited in the L I D No 166 Fund and Attorney Wells stated that he had received a request from Coburn Ackley and Habitat West asking to have their interest in Urban Renewal property assigned to Bay View Corporation The Council had no objection to this as long as it meets with City Council and HUD requirements Mr Wells stated that he had a proposed ordinance for the Council to study This ordinance would establish a set of definitions that can be applied in the interpretation of all City ordinances Mr Wells stated that this had been prepared by Dan Wollam and that he should be complimented for the work done Motion made Mr Richard Stockwell addressed the Council and asked if a public hearing date had been set on the Fidalgo Bay dredging mayor Rice replied that a letter had been received from the Corps of Engineers and they were holding up any decisions on the matter until January 30, 1970 so that they might have a little time to study the situation further Mr Stockwell requested that a public hearing on the matter be held as soon as possible, as he felt that the citizens and property owners should not be kept in the dark as to what was going on, and he felt that the situation had not been handled right mayor Rice stated that "we aren't sure of the correct procedures involved since this is the first time that the City has been involved in this type of development " Mr Stockwell then read a letter he had received from Governor Evans which stated in part "The Corps of Engineers was requested, on December 29, 1970, to hold in abeyance the approval of the above application, by the State of Washington This hold will continue until all state agencies have approved and in addition, until the recent Supreme Court decision regarding intrusion into navigable waters is clarified " • Mr Tommy Thompson addressed the Council and stated that at the last Council meeting he had turned in allotter which stated certain conditions that the City must fulfill on the open space project of obtaining the Shannon Point area, and asked if anything had been done mayor Rice replied that a meeting with the Port of Anacortes had been set for the first part of February to discuss the situation Or Jack Papritz addressed the Council and stated that he had heard some talk about the possibility of back filling the Cap Sante park area, and he felt that such a project would ,jeopardize one of the few remaining low bank water fronts that we have, and he thought the matter should be looked into mayor Rice stated that he didn't know anything about this, but would have it checked out Or Papritz also spoke on the proposed dredging of Fidalgo Bay and thought that this property should be obtained for park purposes Or Papritz stated that tourism ranks third in the state for revenue and will go higher and thought that the filure of the city to acquire low bank waterfront property could hinder future development in the area of waterfront park facilities Mrs Alice Newland addressed the Council and expressed much the same opinions as those expressed by Or Papritz Three bids were received for two trucks for the Street Department, but two of the bids did not meet the bid specifications and a Dickinson Heating and Sheet Metal, in which Mr Dickinson stated that posted signs for limited parking of 1 or 2 hours in the down town shopping area are being ignored and asked if provisions could be made for the effective police petroling system Mayor Rice stated that the letter would be turned over to the Police Department A letter from the Alpine Club asking for permission to use Mt Erie on May 3, 1970 was read` A motion made,by Or Nicholson seconded by Mr Nelson that permission be granted with the usual stipulations that the City is not held responsible for any accidents Roll Ayes --Baker, consideration was the Court ruling handed down by Judge Deierlein stating that the City Council of Anacortes should pass a resolution to hold an election on whether or not the citizens of Anacortes wished to change their form of government back to the mayor/ Council form mayor Rice stated that everyone who wished to express an opinion would be heard and requested that everyone in the audience be" reasonable and calm and that the proceedings be conducted in a business like manner with no arguments or demonstrations mayor Rice also stated that the Rotary Club of Anacortes had invited Governor Evans to be a guest in Anacortes next week and expressed his hope that the City of Anacortes could show some stability and harmony in the community City Attorney Wells gave a resume of the Court ruling and stated that the ruling stated that an election should be held in not less than 45 days nor more then 90 days and that the City had 30 days from January 26th to,decide on whether or not to appeal the case Councilman Baker stated that he was not in favor of the mayor/Council form of government but felt that the City should abide by the court decision and allow the election to be held as a demonstration of good will Councilman Nicholson stated that he agreed with what Mr Baker said but felt that if no appeal was made that this case would be cited as a yard stick for any future actions of this type Councilman Perry stated that he did not believe that a lot of the people really understood what was going on and that the City should have the right to look into this and should have the time rwessary to proceed in an orderly fashion Councilman Nelson, who was out of town, sent a telegram in which he stated that he had information which he felt the Council should have time to study before making any decision Councilman Lunsford stated he felt everyone should have the right to express an opinion, and he felt that some of the people had been heard more vocally than others and that the Council should take another two weeks and look at all sides , Councilman mcDugle stated that he felt the Council/manager form of govern- ment was the best form for the City, but the City should abide by the Judge's decision and hold an election as the democratic way is to vote on it Mayor Rice called for comments from the audience Mr Bill Lowman addressed the Council and stated that the election should be held Mrs Alice Barcott 83 6 Feb 3, 1970 Cont spoke in favor the Council/manager form of government Mr Marion Peck stated that he was the one who had started the petitions to change the form to Mayor/Council and could not see any reason for delaying action on a resolution for two weeks as he felt nothing could be gained by a delay Mr Jack Granville spoke in favor of the Council/Manager form and was in favor of waiting the two weeks before a decision was made Mrs Mary Latshaw stated that she felt the citizens should have a chance to vote on it Several others in the audience spoke for and against One member of the audience asked Mr Lowman why he was against the Council/manager form of government and he replied that he felt that it was not democratic anough After everyone spoke who wished to, a ten minute recess was declared After the recess the City Attorney read a resolution which would authorize the Skagit County Auditor to authorize the election A motion was made by Mr Baker seconded by Mr McDugle that the resolution be adopted and a date set for the election Roll Ayes --Rice, McDugle, Baker Nayes--Lunsford, Perry, Nicholson As this was a tie vote no decision was reached and it will be voted on again at next regular meeting when it is hoped that all Councilmen can be present It was called to the attention of the Council by a representative from Truckers International, Inc , that in awarding the truck bid to the low bidder that the low bid did not include sales tax while the bid from Truckers International included sales tax, making it the lowest bid In consideration of this information a motion was made by Dr Nicholson and seconded by Mr McDugle that the Council reconsider the truck bids and lay it on the table Roll Ayes --Lunsford, meeting at 7 36 P M Mayor Rice requested the Council's pleasure on the minutes of the previous meeting held February 3, 1970 Motion by Mr Perry seconded by Dr Nicholson that minutes be approved as if read Roll Ayes --Perry, Baker, Nicholson, Rice, Lunsford, Nelson Motion carried Mayor Rice called for guest hearings There were none A resolution was read by the City Attorney which would authorize the County Auditor to conduct a special election within the City of Anacortes, Wash- ington to vote on the question, "Shall the City of Anacortes abandon its organization under the council-manager plan and become a city under the general law governing cities of the third class?" A motion made by Mr Nelson seconded by Mr Lunsford that this resolution be approved and adopted and the date of April 7, 1970 be set for this election, and the resolution to be RESOLUTION NO 279 Roll Ayes --Nicholson, Baker, Rice, Lunsford, Nelson Nayes--Perry Motion carried Under communications a letter addressed to Mr T G Thompson, Jr from the Great Northern Railway Company was read The letter stated that the removal of the railroad line from Illinois Avenue westward had been de- ferred until March 1970, and that they had no indication at this time as to the condition of the trackage involved nor the expenditures that would have to be made to bring it up to the standards which are required by the Railway Company before equipment is allowed to be operated over it They 1 J 1 •85 Feb 17, 1970 Cont further stated that "if your organization is prepared to purchase the land and trackage as is, we would be pleased to discuss the matter with you and with the other parties who are interested in acquiring the property " A letter addressed to the Council from Mr Thompson was then read in which Mr Thompson stated, "The Great Northern is taking steps to abandon their trackage from Illinois Avenue to Ship Harbor and are prepared to discuss the sale of the waterfront land to the City of Anacortes and the trackage, as is, to the Anacortes Railway This is an excellent opportunity for Anacortes to obtain a one mile strip of supurb waterfront beach land for public use and enjoyment Funds for the acquisition are available from the Interstate Agency for Outdoor Recreation Pursuing this opportunity will also achieve the realization of the Anacortes Railway Its operation will not only be profitable to the City and its parks, but also will be a great stimulus to the tourist industry in Anacortes " mayor Rice stated this would be taken up at a Council study session next Monday A letter from Mr R E Smith resigning his position on the Anacortes Planning Commission to be effective June 1, 1970 was read His resignation was accepted with regrets and Mayor Rice requested a letter of appreciation be sent to Mr Smith for his many years of service to the City of Anacortes Mayor Rice stated that due to a conflict of interests which had seemed to disturb some people in Anacortes that he had asked Mr Jack Granville to resign from the Planning Commission and that Mr Granville had graciously consented Mayor Rice stated that if anyone was to blame for this situation that it was himself Mayor Rice presented the name of Ray Separovich to be a member of the Anacortes from the Corps of Engineers on the proposed navigation channel in Fidalgo Bay, stating that the engineering study was near completion The Corps is also completing an economic feasibility study for this channel This channel study was authorized ,jointly by the Anacortes Port District and the City of Anacortes and approved by Congress under the Corps of Engineer 107 program Upon completion of the total study and the approval of the Corps of Army Engineers, the Corps of Engineers could spend for dredging up to $500,000 00 It is the City's responsibility to find places to properly contain the dredged material i The City has submitted a revised set of plans for the dredging project south of the area of the Corps project, past Forest Products, Inc , property The revised plans were necessary in order to meet objections raised in the original plan advertised by the Corps of Engineers for this particular project Mr Richard Stockwell askedjif there would be a public hearing on this Mayor Rice replied that the City will write the Corps and request one The City manager reported on recent law suits pertaining to the Urban Renewal area One suit had been over a 5' wide strip 180' long The court had ruled in favor of the City on this particular strip, but the owners of the property have now taken it to the Court of Appeals On other ,judgments made by the Court on parcels 11-1, 6-1, 6-2, 5-1, and 4-1 an award of $200 00 was made DO April 7, 1970 Cont to defray the costs of the respondents This is a proper award but the judg- ment also regbired a payment of interest on the verdict of study session A letter was read from Mr A D Northcutt in which he stated that he owned Lots 2, 3, and 4 of the Seattle Syndicate where his home is located, and as he understood it, Lot No 1 is an eight or ten foot street or alley and it was his wish to go on record as filing a permanent protest against any vacation of this alley or street way A letter was read from the Urban Arterial Board of the State of Washington which stated the 22nd Street is classified as a collector arterial and the desirable roadway width for a collector arterial is 40 feet as specified by the Urban Arterial Design Standards and gave approval for the City to make this street 40 feet wide motion made by Dr Nicholson and seconded by Mr Perry that Council permission be granted to call for bids for the widening of the "dead end" at 38th Street, relative to paving this block He stated that if costs and other details were furnished to each of the residents, and if they seemed reasonable, that 100%, or nearly so, of Anacortes has a cele- bration scheduled for August 1 and 2, called the Arts and Crafts Festival and stating that they prepare announcements directing attention to events of this kind This letter was referred to the Arts and Crafts Festival committee A letter was read from the Anacortes Fire Department in which they recommended that the Lion's Club be granted a permit to sell "Safe and Sane" fireworks at 1519 Commercial Avenue and that the Church of Latter Day Saints be granted a permit to sell "Safe and Sane" fireworks at 918 Commercial, as they have complied with all requirements motion stated that he felt the Council had had time enough to come to a decision on this matter and he felt the Council was dragging their feet Mr R Stockwell addressed the Council and stated that he felt the Council should get in touch with the people and find out what they want as this matter required immediate attention and it was time for an expression of opinion of the City Council Mayor Rice estimate of $20,818 49 plus sales tax was received from Ray Jones for completion of 32nd Street and Heart Lake sewer project which had been started by the City but has not been completed The property owners in- volved have $9,000 00 on deposit to apply to this project Councilman Baker stated that he thought the property owners in this area had been more than patient in waiting for this to be completed and that the work should be finished as soon as possible Councilman Nicholson stated that he thought the City should have some sort of plan for this type of project that would apply to all citizens rather than one group mayor Rice stated that any project costing over $5,000 00 would have to have a bid call put out and suggested the City crews work with Ray Jones on the completion of be submitted to show what plan the City will adopt Mr Sutt will be attending a convention in San Francisco on sanitary land fill disposal methods during the first week in June and asked for a study session with the City Council after he returns from this meeting The letter also stated that the percentage of amounts collected should be adjusted to pay to him 85% rather than the 78J% that he is Building to hold an upholstery class The class to be for 12 students and would meet one night a week mayor Rice stated this would be turned over to the Fire Department to check out the safety of holding such a class on the third floor A letter was read from Frances Matson asking if some place down town could be set aside where people could leave bundles of magazines and newspapers Mayor Rice stated he would have the matter looked into A letter was read from the Skagit Mental Health Group expressing their appreciation for the financial assistance Mrs Alice Newland presented $46 00 for the Urban Beautification fund which was realized from a bowling party The City Attorney read a proposed ordinance which would provide for the posting of performance bonds in connection with landscaping was too good an opportunity to passrup and even without State and Federal money that this great irreplaceable asset should be retained by the City for all of us and that failure to act positively on this matter would indicate a com- plete ignorance of the importance of the tourist industry now and in the future Dr Papritz stated that he sincerely hoped that the Council would have the wisdom and help purchase Seasons Greetings banner to be hung across Commercial Avenue City Attorney Wells stated that the Council would have to give this very careful consideration as the State Auditors take a very dim view of such expenditures A letter was read from Mr and Mrs Don Coughlin stating that they had pur- chased a half block of property at 33rd and Commercial and that presently, a billboard owned by the Obie Outdoor Advertising Agency is located where they propose to put up a building Mr and Mrs Coughlin were asking for permission for the owner of the sign to locate it back from the had received a bill for an additional charge of $7 50, and he felt that this extra charge was not ,justified He asked the City Council for any help they could give in getting the matter straightened out The Council felt that about all they could do would be to write to the new company and explain the matter to them and see what they would do about it A letter was read from Ralph H Davis resigning The proposed drill site is on a short side road west of the Lake Forest Road 0.2 miles south of,the paved road to the top of mount Erie and 1.0 miles north of the highway intersection at Lake Erie. The drill hole is part of a summer re- search project supported by the National Science Foundation to study the distribution of the flow of heat from the earth's interior in the north- western United States. motion was made by Mr. Nelson seconded by Dr. Nicholson that permission to drill this hole be granted. Work, Inc. was read which requested permission for a work order change on the water transmission pipeline. They were requesting that they be allowed to use concrete cylinder pipe in lieu of ductile iron pipe as the existing transmission system is basically concrete cylinder pipe and the use of this pipe would ease the city's maintenance problems, and also would save the city approximately $5,000.00. After some discussion it was decided that the City Attorney should draw up a resolution to the effect that the City of Anacortes enter into this Flood Control District just for the property that is located outside the city limits in the flood area. letter was read from Mr' and Mrs Albert Latshaw in which they requested permission to affix fiber -glass screening on their patio at 919 Fidalgo Avenue This was being requested as their patio ex- tends into'the platted portion of Commercial Avenue by approximately five or six feet This platted portion has never been opened up or improved, outside of a one -lane dirt and gravel road The Latshaw's asked that this permission be granted with the understanding that at any time that the City deems it in the public welfare to open up the whole of Commercial Avenue to the south of Fidalgo Avenue, that they would remove any'encroachment onto Commercial Avenue necessary for the purposes intended A motion was made by Mr McDugle and seconded by Mr Perry that this permission be granted Underiquestiorn it was brought out that the Latshaw's have already put up this screening and had puttit up after the City Building Inspector, had informed them that they should first obtain permission his request Also speaking in favor of this request was Mr Pat Mooney who has a business in Mr Allan's building They explained that Commercial Avenue is 8 feet narrower than it is at 20th Street, and Commercial Avenue parking is more hazardous in this area and side street parking becomes more important than dust a few blocks north on Commercial Also, because of the off street parking provided by the Econo-Wash Laundromat across the street from the proposed diagonal parking, there would not be a traffic problem such as might be caused where the opposite side of the street ±s used for parking Diagonal parking would increase the parking for the business located here from 3 spaces to 7 spaces Mayor Rice stated that this situation would be looked at and studied to see dust what could be done A request from Time Oil Company to install a self-service gasoline station on their property at 1801 Commercial Avenue was discussedd City Ordinance No 1068 prohibits the sale and distribution of gasoline by means of self-service This ordinance was passed by the City of Anacortes in February 1951 Since that time self-service had become an accepted method of dispensing gasoline The mayor objection originally voiced in opposition of self-service was that it constituted an inherent fire hazard The National Fire Protection Association Code, which has been adopted in the State of Washington, specifically allows self-service operations and to the knowledge of Time Oil Company, no cases have been reported of accidents or injuries resulting from the use of self- service dispensing devices Time Oil Company respectfully requests that the City of Anacortes repeal Ordinance No 1068 Fire Chief Bowen reported that the City of Anacortes is now operating under the 1965 Fire Prevention Code, and he recommended that the City adopt the 1970 Code which does permit self- service gasoline stations A motion was made by Mr' Baker seconded by Mr Perry that the City pursue this coverage Mr Foster was requesting a broker record letter from the City Council, so that he could bring in various proposals for an insurance program Mayor Rice stated that he was disturbed over the fact that any uniformed employee of the City had made such a request, as under the new law covering uniformed employees, it is the responsibility of the City to pay for hospital and medical bills for uniformed personnel and at present time they are covered by an insurance program mayor Rice stated that we had no problems with our present insurance broker A request for improving and paving the N" W corner of 15th and Commercial as requested by Video Electronics was discussed There is a mobile hamburger drive-in that would like to locate at this location A representative from the drive-in was present and gave a description of what it would be like The building would be 10' x 35' They would have electrical appliances with no open flame cooking Mr Don McKee addressed the Council and stated that the building was 2 x 6 T & G and does not meet fire zone requirements, but thought perhaps a variance or special permit might be issued on a year to year basis Mayor Rice stated that in his opinion a committee consisting of perhaps 10 people or so should be appointed to make a study of building and zoning codes, as there were a number of things that should be remedied, as some of the regulations we have are too strict Councilman Nelson stated that he would not be in favor of traffic coming onto Commercial Avenue from this proposed drive-in, and also that he would like to see a picture of the building Mayor Rice stated that the Council would give this further study at their study session Thursday night , New labor agreement with Anacortes City Employees Local 347 of the American Federation of State, County and Municipal Employees was discussed The new agreement represents a 9% pay raise, 1% raise in hazardous duty pay for policemen, and changing the longevity schedule to $2 00 added per month every year until a total of $40 00 is reached, also chift differential pay in the amount of 50 per hour for swing shift and 100 per hour for graveyard was granted Councilmen were not too much in favor of this particular piece Councilman Baker stated that he was not in favor of this particular piece, but in order that no hard feelings be created and in order to complete this "missing link" in the water transmission system consists of replacing about 200 feet of 20 inch submarine waterline in Swinomish Slough, re- linging and repairing about 900 feet of 24 inch waterline on the west side of Swinomish Slough, and construction of about 2400 feet of new 24 inch waterline from the east end of Stevenson Road to the west limit of Swinomish Slough 4 Fire Chief Responsibility Ordinance, similar to one in operation in Pontiac, Michigan, in which the parents of ,juveniles arrested are subject to imprisonment and fines as the result of their children's criminal activities A letter was read from Police Chief Dragovich in which he stated that under the Criminal Law in Washington State, that a parent cannot be failed or fined for the acts of his children The Wash- ington law does state that the parents are liable up to one thousand dollars for damages incurred by their children to other people's property Under new business, a recommendation was received from the Planning Commission to change land use to Commercial and rezone to C-2 an area between 20th and 21st Streets and "Q" and "R" Avenues as requested by the City of Anacortes and Floyd Grace audience that the wage and fringe benefits for employees for the year 1971 would amount to an increase of $114,384 00 In regards to more money for the library, mayor Rice said the budget had been adjusted to give the library,an additional $2,000 00 Mrs Sybil Hanson of the Library Board, addressed the Council and said that this would be acceptable, and asked in what category they would spend it Mayor Rice explained that it would be allocated to any category that they wished to put it into Mrs Allegra Solzman, representing the AAUW, thanked the Council for the time and consideration they had
