HomeMy WebLinkAbout1975 City Council MinutesDecember 169 1974 continued 23 Public Works Director, David Ford, asked for Council permission to release Skyline road bonds in the amount of $262,000 for divisions 4, 5, 99 10 and 16. He stated that a $20,000 bond would be obtained from Skyline to insure completion of a few items that still have to be done. Motion made by Mr. Nelson and seconded by Mr. Mansfield that permission to release these bonds be granted. Roll: Ayes --Lunsford, Nelson, Bryant, Mansfield, Separovich, Rice. Nayes-- Sortun. Motion carried. Public Works Director, David Ford, also asked for Council permission to release Skyline sanitary sever bond in the amount of $6,000 for division 9. Motion made by Mr. Sortun and seconded by Mr. Separovich that permission to release this bond be granted. Roll: Ayes --Nelson, Bryant, Mansfield, Separovich, Rice, Sortun, Lansford. Motion carried. Public Works Director, David Ford, told the Council that the City staff have some alternate propsals ready for 12th Street, and asked for Council approval to submit a "Change of Scope" plan to the Urban Arterial Board. Mayor Rice requested that these proposals be outlined on a sheet of paper and taken to the nest Council study session. Mayor Rice announced that the Council would be holding a study session on Wednesday, December 189 1974 at 7:30 P.M. and would be meeting with Paget Power and the Y.M.C.A. There being no further business to come before the Council, Mayor Rice declared the Council to be adjourned at 9:05 P.M. Roll Call: Mrs. Bettye Bryant, Mr. Jerry Mansfield, Mr. Ray Separovich, Mr. James Rice, Mr. Henrik Sortun, Mr. Floyd Lansford, Mr. Gary Nelson. Mayor Rice requested the Council's pleasure on the minutes of the previous meeting held on December 169 1974. Motion made by Mr. Lansford and seconded by Mr. Sortun that mutes be approved as if read. Roll: Ayes --Bryant, Mansfield, Separo nch, Rice, Sortun, Lunsford, Nelson. Motion carried. Mayor Rice called for guest hearings. There were none. Linder old business an alley vacation request from Mr. Delbert Johnson was discussed. The request was to vacate lots 1-6 and 15-20, Block 20, Kellogg - Ford Addition and also 101 of the south side of 33rd Street. Both the Planning Commiesion and the City Council having held public hearings on this request previously. This vacation was reviewed by Public Works Director, David M. Ford. A motion was made by Mr. Separovich and seconded by Mrs. Bryant that this vacation request be granted with the restrictions noted by Mr. Ford, Roll: Ayes --Mansfield, Separovich, Rice, Sortun, Lunsford, Nelson, Bryant. Motion carried. A request to place a mobile home -on property nest to the San Juan Nursing Home was withdrawn. A vacation request from Paget Power was discussed. Public hearings having previously been held on the request. The request was to vacate a portion of the existing alley, 16 feet in width, between Blocks 906 and 9079 bordering Lots 16 through 22, Northern Pacific Addition, between W. 3rd and 4th Streets and Kansas and Illinois Avenues, this being in the area where the Burrows Bay sub -station is located. Several people living in this area asked questions about this vacation. They wanted to be sure that the power lines would not ran in front of their homes. A motion was made by Mr. Sortun and seconded by Mr. Lunsford that this vacation request be granted. Roll: Ayes--Separovich, Rice, Sortun, Lunsford, Nelson, Mansfield. Nayes--Bryant. Motion carried. Mayor Bice declared a public hearing to be open to consider a request from Snelson-Anvil for the vacation of 26th Street between R Avenue and the railroad right-of-way and S Avenue between 20th and 22nd Streets. One written protest was received from Mr. Charles Hanson. Mayor Rice declared the public hearing to be closed. Motion was made by Mrs. Bryant and seconded by Mr. Separovich that this request be granted. Roll: Ayes --Rice Sortun, Lnnsford, Nelson, Bryant, Mansfield, Separovich. Motion carried. 24 January 6, 1975 continued Mayor Rice declared a public hearing to be open to consider a request from Charles Funk for rezoning from R-1 to C-2, with contract, a portion of lot 239 all of 24 to 30, in the Norman A Woods subdivision. There were no objections and Mayor Rice declared the public hearing to be closed. The City Attorney read an ordinance covering this request. Motion made by Mr. Lansford and seconded by Mr. Mansfield that the ordinance be approved and adopted and given ORDINANCE N0, 1631 Roll: Ayes--Sortun, Lunsford, Nelson, Bryant, Mansfield; Separovich, Rice. Motion carried. Mr. Hen Kinzel, Urban Renewal Director, asked for Council approval of the suggested contract for sale of land to Bering Sea Products and Alaska Consolidated Trading Company. This contract having been submitted to the Council previoubly for their comment and review. The Council requested that this be taken up at the neat regular Council meeting. Following discussions between City staff members and representatives of Harry Davidson and Company, with regard to installation of a 1209000 gallon water tank at Skyline, Mr. David Ford, Public Works Director, made the following recommend- ations. 1. That the Tank in question be allowed to be built by Skyline at their expense provided that: _ A. The City approve structural design of the tank. B. The City approve control equipment to regulate pumping and tank levels. C. The City approve pipeline extension, check valves, and other appurtenances as may be necessary for development of the tank. 2. That the City release the moratorium for the Skyline Subdivision following the filing by Skyline, with the City, of a tank construction bond in the amount equal to the estimated construction and installation cost of the tank control equipment and all appurtenances necessary. 3. That it be stipulated that the tank and controls be in operation by May 1, 1975. 4. That the City will allow 70 units to be built in the Skyline Subdivision with the stipulation that this number of units may be revised up or down at such time as sufficient experience with regard to operation of the tank is gained to determine the exact amount of'units. 5. The City will allow "I" occupancy construction only to take place with the lifting of the moratorium. "I" occupancy is single family dwellings only. There will be no extension of existing commercial or no new commercial enterpirses will be constructed. 6. Skyline will agree to turn over tank, controls and appurtenances to the City for operation and maintenance. 7. The tank elevation will be such as to provide a minimum of 30 psi to all present platted subdivisions within Skyline.' 8. Under peak conditions of flow, pressure in the Balch Homes Addition will not be reduced below 20 psi due to Skyline operation. Mr. Ford stated that it might take longer than anticipated for delivery of some of the materials necessary to construct the tank and that the moratorium would not be lifted until a definite confirmation delivery date on materials is known. Mr. Ford also stated that under item 5, that duplexes would be allowed with two seperate water services. A motion was made by Mrs. Bryant and seconded by Mr. Nelson that Skyline be allowed to build the tank under all+the recommendations that were made by Mr. Ford. Roll: Ayes--Laneford, Nelson' Bryant, Mansfield, Separovich, Rice. Nayes--Sortun. Motion carried. Methods of financing proposed water improvements were presented to the Council and they will consider these at a study session. A request was received from the City of Oak Harbor to reduce their committed water reserve from 26 million cubic feet per month to 10 million cubic feet per month. Motion made by Mr. Nelson and seconded by Mr. Lansford that this request be granted. Roll: Ayes --Nelson, Bryant, Mansfield, Separovich, Rice, Sortun, Lansford. Motion carried. The City Manager informed the Council that the City should make formal application to F.H.A. by February 15, 1975 for water improvements. The Council will consider this at their next study session. The City Manager informed the Council that the Public Employees' Retirement System was requesting payment from the City of Anacortee in the amount f $49725 26 due to the fact that the Statewide City Employees' Retirement System succeeded on January 6, 1975 continued 25 January 1, 1972, by the Public Employees' Retirement System) had a practice of charging excessive amounts of administrative costs of managing the System's inv estments to the income from those investments, rather than assessing adminis- trative costs to the cities which were members of the Retirement System daring the period 1960-1971. The Manager also reported that the City and employees would be required to pay the Retirement System on all over -time pay since 1972. The City and employees have been paying the System on basic monthly vages only. An ordinance vas read vacating certain streets and alleys in the City of Anacortes as follows: That portion of J Avenue from the South line of 18th Street to the South line of 17th Street, that portion of I Avenue from the North line of 20th Street to the South line of 17th Street, that portion of 18th Street from the West line of I Avenue to the West line of H Avenue and that portion of 19th Street from the West line of I Avenue to the West line of H Avenue and that portion of H Avenue abutting Blocks 150, 1519 and 152• Map of the City of Anacortes, records of Skagit County; Those alleys lying in Blocks 150, 151, and 1529 Map of the City of Anacortes, Records of Skagit County. This ordinance shall not become effective until Anacortes School District #1039 a Municipal Corporation, the owner of the property &batting upon the vacated streets and alleys listed above, shall deed to the City of Anacortes an eighty foot right-of-way over property owned by the School District for the purpose of extending 20th Street. A motion vas made by Mr. Mansfield and seconded by Mr. Separovich that this ordinance be approved and adopted and given ORDINANCE NO. 1634 . Roll: Ayes -- Bryant, Mansfield, Separovich, Rice, Sortun. Abstain --Lansford, Nelson. Motion carried. An ordinance was read providing for the adoption, administration add enforcement of the State Building Code and repealing any Ordinances ofithe City of Anacortes in conflict therewith. Motion made by Mr. Nelson and seconded by Mr. Sortun that this ordinance be approved and adopted and given ORDINANCE NO. 161L__. All Ayes. Motion carried. The City Manager reported that the Housing Anthority had received notice from HUD that the City of Anacortes should refund to the Housing Authority money paid by the Housing Authority in lien of taxes. This will be discussed at a study session. Mayor Rice announced that the Council vonld be holding a study session on January 159 1975 at 7:30 P.M. The Public Works Department requested permission to proceed with a request for change in scope of work for 12th Street. This request will also be considered at the Study Session on January 159 1975. There being no further business to come before the Council, Mayor Rice declared the meeting to be adjourned at 9:05 P.M. Mayor Rice dolled for guest hearings. Mr. John Noyes addressed the Council and requested that within the next seven days the Council request the resignation of the City Manager. A resolution was read authorising execution of a contract for the sale of certain real property by and between the City of Anacortes and Pacific Sea Products Company Inc., an Alaska Consolidated Trading Company. Motion was made by Mr. Mansfield and seconded by Mrs. Bryant that this resolution be approved and adopted and given RESOLATION NO. 410 . Roll: Ayes --Mansfield, Separovich, Rice, Sortua, Lunsford, Nelson, Bryant. Motion carried. Council permission was asked to apply to the Corp of Engineers for a permit to 26 January 20, 1975 continued replace the boat launching ramp and mooring floats at Washington Park. Motion made by Mr. Sortun and seconded by Mr. Separovich that permission be granted. Roll: Ayes--Separovich, Rice, Sortun, Lunsford, Bryant, Mansfield. Nayes-- Nelson. Motion carried. Council permission was asked to execute a CETA II contract on City employees. This is a Federal funded program for hiring unemployed people. Mr. Douglas Everhart, City Librarian addressed the Council and asked to hhve the 1975 budget for the Library increased by $1210 due to the fact that not enough was budgeted in the account for extra employees and nothingtwas budgeted for vacation coverage. The City Attorney was requested to prepare an arf-v ordinance to amend the budget and present it at the next,Council meeting. Council permission was asked for the City to apply for application for funds from FHA for water improvements. Motion made by Mr. Mansfield and seconded by Mrs. Bryant that permission be granted. A request was made by Paget Power to set a single pole and place overhead two spans of wire at the intersection of 35th and Commercial: The reason for making these improvements is to tie the Anacortes Sub -station with the Reservoir Sub -station. This will provide greater reliability in power service to the City of Anacortes. Motion made by Mr. Mansfield and seconded by Mr. Sortun that this request be tabled until the Council can take a look at it and hold a study session on the request. Certification of Terrace Drive LID undergrounding request was discussed. r Public Works Director, Mr. David Ford reported that it is necessary to have better than 50% of the petition signers in favor of the LID, both footage wise and area wise. He stated that a little better than 50% were in favor footage wise, but area wise only 43.666 were in favor, and due to this fact an LID was not qualified. Motion made by Mr. Nelson and seconded by Mr. Iunsford that the petition for an LID be denied. Bolls Ayes --Nelson, Bryant, Mansfield, Separovich, Rice, Sortun, Lunsford. Motion carried. Bids to remove and repair a 400 HP Electric Motor at the Water Treatment Plant were received as follows: TOTAL BASE AND AIMERNATE BID Westinghouse $7080.55 Industrial Electric 69497.01 General Electric 79639.31 Motion made by Mr. Nelson and seconded by Mr. Separovich that the low bid from Industrial Electric be accepted. Mr. Gerald Presler of the Engineering Department gave an analysis of the accident experience recorded on 12th from Commercial Avenue to Oakes Avenue. People in t$e audience spoke for and against the improvements. A motion was made by Mr. Sortun and seconded by Mr. Lunsford that the City go ahead with the proposed improvements as previously outlined. Roll* Ayes--Sortun, Lunsford, Nelson. An ordinance was read vacating the South 10 feet of that portion of Thirty -Third Street, lying East of DcAvenue and abutting on Lots 1 through 69 Block 209 Kellogg and Ford addition to the City of Anacortes and that portion of the alley lying between and adjacent to Lots 1 through 6 and Lots 15 through 209 Block 209 Kellogg and Fords Addition to the City of Anacortes. An ordinance was read vacating Twenty Six Street, between the East line of R Avenue and the West line of the Burlington Northern Railroad right-of-way and S Avenue between the South line of Twentieth Street and the North line of Twenty- second Street. Motion made by Mr. Nelson and seconded by Mr. Mansfield that this ordinance be approved and adopted andegiven ORDINANCE NO. 1637 . Roll: Ayes -- Rice, Sortun, Lunsford, Nelson, Bryant, Mansfield, Separovich. Motion carried. An ordinance was read vacating that portion of an alley lying between Blocks 906 L 1 January 20, 1975 continued 27 and 9079 and abutting Lots 16 through 22 of each Block, Northern Pacific Addition. This vacation being made at the request of Paget Power. Motion made by Mr. Sortun and seconded by Mr. Mansfield that this ordinancelbe approved and adopted and given ORDINANCE NO. 1638 . Mayor Rice announced that due to the resignation of Mrs. Felicia Childs as Chairman of the Bi -Centennial project that the History of Museum Board would be in charge of this project. Mayor Rice expressed thanks to Mr. Bill Lowman for putting in sidewalk at the Museum. Mrs. Ann Bessner inquired about getting the roof at the museum repaired and it was reported that Savage Roofing Company had been contacted to take care of this. There were none. Under old business the request from Puget Power for an overhead tie at 35th and Commercial Avenue was again discussed. A motion was made by Mrs. Bryant and seconded by Mr. Separovich that permission be granted for Puget Power to make this installa- tion and urged Puget Power to cooperate with the City in their future efforts to under- ground utility lines. Motion carried 28 February 39 1975 continued Mayor Rice declared a public hearing to be open on the Community Development Program. Mr. Gerald Presler addressed the Council and stated that a total of 29828 questionnaires were mailed out in the first two weeks of January, 1975 and as of February 39 19759 590 questionnaires have been returned and the items receiving the highest rating are as listed below Increase fob opportunities Local environmental control Improved roads and streets in the City Provide additional housing Expanded cultural activities Expand educational opportunities Expanded senior citizen centers Increased services in drug and alcohol preventive education, handling and treatment Provide improved utility service Improve blighted areas of our community Mr Presler announced that another public hearing will be held on February 10, 1975 for the purpose of reviewing the needs, establish priorities and establish a six year plan There were no comments from the audience and Mayor Rice declared the public hearing to be closed A request was received from the Housing Authority asking for a refund of $49608.00 which they had paid the City on an L I D , as the State and Federal auditors have found this payment to be in error. The City Attorney read an ordinance which would amend the budget so this refund can be made along with an amendment to reflect additional revenue from funds received from the Federal Government under the Comprehensive Employment Training Act Program and an additional amount fora -Library expenditures. Motion carried. A request was received from Mr John Houston to extend a private water line within the City of Anacortes due to the fact that water in his well is non -potable and very possibly creating a health hazard. The line that would serve this residence is a private line not maintained by the City of Anacortes. Motion made by Mrs. Bryant and seconded by Mr. Separovich that this request be allowed. As the next regular City Council meeting would fall on February 17, 19759 which is a legal holiday, a motion was made by Mr. Sortun and seconded by Mr. Separovich to hold the meeting on February 19, 1975. Motion carried A resolution was read to assume obligations of Local Cooperation in the matter of Anacortes navigation channel, Fidalgo Bay, Washington. The claims report for January 1975 was presented as follows Salaries and Wages 799866 56 Expenditures 1239351.40 Upon approval of the Finance Committee, motion made by Mrs. Bryant and seconded by Mr Sortun that claims be approved Roll Ayes--Sortun, Lunsford9 Nelson, Bryant, Separovich, Rice Motion carried Mayor Rice announced that the Council would be holding a study session on Monday, February 109 1975 at 7 30 P.M At the last City Council meeting Mr. John Noyes addressed the Council and requested the resignation of the City Manager. In reply to this request Mayor Rice made a statement, a portion of which follows "The employment and supervision of the City Manager is the Council's respons- ibility The proper procedure for anyone who may have a complaint about a City Manager should do so through the Council in private. Our policy is to consider all employee matters in private and we intend to continue this policy Employees deserve and are entitled to this consideration. We support the present Manager and his management of the City. Policies, programs and projects carried out by management are done so with the approval of the Council. We realize that there are some who are not happy with the present management9 this has been true of past managers and will be 'true of future managers No manager of any organization can possibly please everyone. There are present problems and future problems facing Anacortes. They comply with the requirements in regards to liability and property damage insurance, they have received a State Retail fireworks license from the State Fire Marshall the location is reasonably safe to adjoining property. The City Attorney reported that he is working on revisions for this ordinance. A letter vas read from Fire Chief Bowen stating that on February 28, 1975 certificates were issued to the following Fire Fighter's and Police Men upon completion of an Emergency Medical Technician course: Capt. Iver Johnson i Gerald Hein Robert Strickert William Ross Robert Iversen Thomas Harroun George Maddox Fire Department Fire Department Fire Department Fire Department Fire Department Fire Department Police Department Also Battalion Chief Donald Strom and Captain John Mills were re -certified. The Emergency Medical Technician course consists of 80 hours of training of emergency care of patients and at least 10 hours spent in the Emergency Room at Island Hospital. Included in tLe training is Cardio Pulmonary Resuscitation, splinting and care of broken bones, control of bleeding, emergency childbirth, recognition of various diseases and body afflictions and what action can be taken to wstain life until medical aid can be obtained. Mayor Race commended these employees for having completed this cowee and it was recommended by the Council that the City Manager write letters of commendation to those vho completed the course. .1 2 March 3, 1975 continued Under old business the request from Mr. Marvin Wilbur to put in a 6" nater tap at his residence which is located immediately northeast,of the intersection of Highway 20 and the March's Point Road was again discussed. In connection with this request a letter from the Skagit County Public Utility District was read in which they stated they have been consdiering this situation and realize, from a maintenance and operation viewpoint, a service of this type will present many problems. There has been speculation, from time to time, that the tribal community intends to develop an industrial complex on their property at that location. If the City of Anacortes would agree to permit the P.U.D. to provide water service to any development that might occur, their Board of Commissioners would then seriously consider serving Mr. Wilbur. After some discussion the Council decided it would be well to have a meeting with P.U.D. and set up some definite policy. A letter was received from the Town of LaConner stating that they need an extension on their water contract with the City of Anacortes, in order to comply with regulations of the Farmers Home Administration. They have received some loan money from them for improvements in connection with the sewer and water system of LaConner, and their loan to FEA is payable over forty years. The FHA regulations require that they have a water supply contract for a period at least equal to the term of the loan. A motion was made by Mr. Mansfield and seconded by Mrs. Bryant that an extention be granted to them for a period to equal the term of their loan. Ford, gave a very comprehensive report on the progress being made on L.I.D. #1789 which is a sewer project in the west end of town. The completion date for the project was orginally,set for December 1891974 and had been extended by the Engineering Department to January 189 1975. However, the project is still not fully completed. Mr. Ford asked the Council if they would care to extend the completion date further before the $200.00 a day penalty fee, as provided in the contract with the Contractor, is implemented. A motion was made by Mr. Separovich and seconded by Mrs. Bryant that the completion date be extended to April 8, 19759 at which time, if not completed, the $200.00 a day penalty fee would go into effect. Motion carried;l A proposal for a revised location of anode bed for the waterline was received from Norton Corrosion Limited, Inc They reported that the alternative design of two deep well anode beds for a cathodic protection system for the Swinomish Slough Crossing was considered because it appears that a right-of-way permit for the originally proposed ground bed may be unattainable. An anode bed parallel to the 36" suspended water line west of the slough crossing appears to be unfeasible since future construction may bury that line. The deep well anode bed system would be more expensive, approximately $10,000 per well, but would provide good current distribution and could be installed within the existing 20, pipeline right-of-way. This design would include two 8" dia. x 3001 deep, deep _ well anode beds One of these would be located east of the slough on the 20" water main and the second would be located west of the slough on the 36" main line In both cases the well would be drilled within five feet of the pipeline A motion was made by Mr. Mansfield and seconded by Mr Sortun that this proposal from Norton Corrosion be approved. ' A request was received from "1776 Dog and Pony Circus" asking to have the $1000 bond required by the City waived for their performance in Anacortes on July 26, 1975. A representative from the Skagit County Health Department gave a report on a survey they have recently completed in the Cap Sante area on sewer problems and urged the Council to try and establish an L.I D. for sewers in this area Mayor Rice stated that the Council would hold a study session with the residents in this area on May 12, 1975 Council permission was asked to have a Resolution of Intent to form a Water L I D. prepared by the City Attorney. The proposed L.I.D. would include re- placement of the 24 inch wooden line coming into the City, adding covered storage to the system, which will make Anacortes in conformity with the Environmental Protection Agency regulations, and placing a transmission line to the West area of the community. Mayor Rice stated that no matter which way the City should decide to go on the water project, whether by an L.I.D. or General Obligation Bonds, that the water rates would have to be raised to possibly $4.75 or $5.00 per 600 cu.ft., and also that the hook-up charge for new services would have to be increased. A motion was made by Mr. Separovich and seconded by Mr. Mansfield that the City Manager and City staff be authorized to set up the mechanics for G.O. Bonds for the water improvement project. Mayor Rice stated that if he would have the hives protected so that other people couldn't get to them that there shouldn't be any problem Mr Don Coughlin addressed the Council and stated that a house he was build- ing at 17th and D was not included in the Sewer L I D #178. Motion carried. Council permission was requested to execute a Grant Agreement for a Community Development Block Grant of $1209000. Two gentlementfrom HUD were present in the audience, Mr. Charles Begley and Mr. E.J. Moger, Mr. Moger addressed the Council and presented them with a letter from President Gerald R. Ford. The letter in part stated, "I am pleased and delighted that your City has completed its own ' 'plan -- and that it has been approved by the Department of Housing and Urban June 16, 1975 continued 45 Development. That is only the first step. I urge that you enlist all your citizens in helping to carry out this plan." The Council recommended that the City obtain from Harry Davidson, Inc., a clear and unencumbered deed to the property and easements for ingress and egress for maintenance and operation. The Council was asked to authorize the transfer of $509000 from the Federal Revenue Sharing Funds to the Sanitation Fund and that this loan carry an interest rate of 6%. The money to be used to cover the purchase of new sanitation trucks. Motion made by Mr. Sortun and seconded by Mr. Mansfield that this transfer loan be made. Mayor Rice also announced that on July 159 1975 the Veterans Administration will have a mobile van in Anacortes equipped and staffed to bring a full range of information and services to veterans and their dependents. They will be in Anacortes on that date from 10,00 A.M. to 4s00 P.M. The City Manager requested a meeting with Council members on Monday, June 23, 1975 to discuss wage proposals that have been turned in by City Union Members, Councilman Sortun commended the City Staff and Shell Oil Company for a very well executed water agreement. The Council tabled this for further consideration. A request was received from Western Lime Company with regard to crossing the City's water pipe lines with a road to their new location. At the point of cross- ing the City water pipe lines are within State Highway Department right-of-way. The Director of Public Works stated that he could see no objection to them having a new road across the pipe lines provided they protect the lines by all possible means. He stated that the newspaper has given good coverage and that talks have been made before several service clubs, but more publicity is needed. Mayor Rice appointed Mr. Mansfield and Mrs. Bryant to get a committee together to get some more publicity. It was brought to the attention of the Council that an individual in the Skyline area had been given permission to build a dock with the understanding that he would start building his house within a two year period. The two year period is up and no house has been started. The City Attorney informed the Council that he had written this individual and informed him of this situation. A request was received from the Retail Trades Committee to hold a sidewalk sale on July 26,'1975. They requested permission to have Commercial Avenue from 6th Street to 8th Street blocked off for this event. The sale to run from 10 00 A.M. to 5 00 P.M. A letter was read from the Museum of Hisotry Board in which they requested the Council to notify the Arts and Crafts to vacate that portion of the Museums' building that they have been occupying since 1967. They stated that they needed the room for the Museum. The City Manager stated that he would get together With the committee working on a Community Center to see what ideas they might have. Councilman Separovich asked if anything has been done about the possibility of acquiring the Burlington -Northern depot for municipal purposes. The Council directed the City Manager to find out if the depot can be acquired. The request from the Musuem Board to be held in abeyance until some other arrangements can be made. A request was received from Mr. Gerald T. Koffel to obtain a 1976 lease on City owned land in Government Lot 4, eaterly of the County road, Section 13, Township 34, Range 3 east, adjacent to the fenced portion of land surrounding the Anacortes Water Treatment Plant in Mt. Vernon. Mr. Koffel had a lease on this property .dor the past year and has been paying $62.50 per month. The Council asked the Manager to bring more information on this request to the next Council meeting. 48 July 21, 1975 continued Mr. Presler of the Engineering Department, presented the proposed plat of Fidalgo View and asked the Council to approve the preliminary plat. This plat would extend east from M Avenue on 38th Street and then south along new right- of-way to Longview Avenue then east again. There are 13 lots in the proosed plat. Mr. Presler stated that two changes have been requested by the City. (1l that there be a 601 right of way rather than a 50' and (2) that the request for a 101 vacation on the west side of the lots be deleted. He stated that the vacation of Taylor Street met with City approval because the utility service would be from the north line of 38th Street and Taylor Street would not be needed. A resolution was read authorizing a loan from the Revenue Sharing Fund to the Sanitation Department Fund, and setting forth a repayment schedule. Motion carried. I- A resolution was read authorizing and directing the City to execute an agreement with Scott Paper Company concerning the furnishing of water by the City to Scott Paper. The City Manager explained that the agreement calls for Scott Paper to pay during each month of the term of the agreement the sum of $89740 regardless of the amount of water furnished and in addition to the foregoing, the sum of $61.62 per million gallons. He reported that contract agreements with the different agencies have been reached and asked for Council permission to execute contracts with the Hospital District, Summit Park Fire District, Dewey Beach Fire District and Guemes Fire District. is improved, thus nec- essitating the use of a portion of the N Avenue right-of-way on which the buildings now sit The City staff is therefore, requesting Council permission to execute an agreement with Mr BockenKamp with the stipulation that at any time in the future these buildings would have to be removed, that all costs incurred would be paid by Mr Bockenkamp and the City of Anacortes would
