This Agreement is made and entered into by and between the
City of Anacortes, a Washington Municipal Corporation, herein
after called "Anacortes" , and the Swinomish Tribal Community, a
Federally Recognized Indian Tribe Organized Pursuant to 25
U.S.C. Section 476 and hereinafter referred to as "Tribe. "

WITNESSETH
WHEREAS, the City of Anacortes operates a dispatch center under
the control of the City of Anacortes Police Department;
WHEREAS, a County-wide 911 emergency dialing system has been
implemented in Skagit County; and
WHEREAS, the City of Anacortes has been designated as a public
service answering point , where 911 calls are initially answered
and routed; and
WHEREAS, the Tribe does not have adequate facilities to
properly dispatch emergency services;
NOW THEREFORE, in consideration of the mutual benefits derived
from this Agreement, Anacortes and the Tribe agree as follows :
1 . SCOPE OF SERVICES
Anacortes agrees to be a public service answering point for 911
calls and other emergency dispatch services for the Tribe from
the following telephone prefix: 466 . The City will be
responsible for answering and forwarding all 911 emergency
calls to the Tribe . In carrying out this function, the City

will follow documented policies and procedures as they
currently exist within the City' s communication center or as
subsequently modified.
In addition, Anacortes agrees to provide dispatch services for
the Tribe which services shall include the following:
a) 24 hour dispatch for 911 calls only.
b) Dispatch service to officers on duty for purposes ,
of normal police operations for such things as
vehicle registrations, driver' s checks, N.C. I .C.
and W.A.C. I . C. checks, traffic stops, arrival and
departure of dispatch calls, signing in and out of
vehicle, etc . , and on a limited basis when needed,
copied of taped conversations between officer and/or
officer/dispatch for purposes of investigation either
civil or criminal or internal or external .
c) Call out of officers after hours of completion of
assigned shift as needed and notification of super-
visors for officers when requested.
2 . RECORDS AND REPORTS
The Tribe and Anacortes shall maintain such reports and records
as are necessary for the execution of this Agreement . These
reports may include financial, statistical, and operational
information and shall be available to both parties to this
Agreement .
3 . COMPENSATION
The Tribe agrees to compensate the City of Anacortes as
follows : $17, 500 . 00 for the calendar year 1998, payable
quarterly in advance . This compensation level is based on
present staffing levels within Swinomish Tribal Police and if
staffing levels increase so as to affect the dispatching
workload, such annual compensation shall be renegotiated.

4. AGREEMENT TERM
The term of this Agreement shall be from January 1, 1998 to
December 31, 1998 . Either party may terminate this Agreement
by provision of 90 days notice of intent to terminate the
Agreement provided in writing to the non-terminating party at
the address indicated herein. If this agreement is terminated
prior to the end of the year, these fees shall be prorated to
reflect that portion of the year the agreement is in effect .
5. HOLD HARMLESS AGREEMENT
The City and the Tribe shall be responsible for all liabiility
of whatever nature arising from the acts of its own law
enforcement officers and employees to the extent provided by
law. Under no circumstances shall either the City or the
Tribe be held liable for the acts of employees of the other
party performed under color of this Agreement.
The City and the Tribe shall indemnify each other for all
claims, judgements or liabilities by third parties for damage,
personal injury or civil liability which may arise out of the
activities of their officers pursuant to this Agreement .

6. AMENDMENTS
This Agreement may be amended upon the mutual written
agreement of both parties.
