EASEMENT
The Grantor, SKAGIT COUNTY, the legal description and representative drawing of
whose property is attached (EXHIBIT A and B, respectively) and made a part hereof by
reference, and for no consideration, does hereby grant and convey to the Grantee, the CITY
OF ANACORTES, a municipal corporation of the State of Washington, a non-exclusive,
appurtenant easement for ingress, egress and pedestrian travel; installation, maintenance
and repair drainage culvert and attachments thereto, care and maintenance over, along,
under and across a portion of the real property described in Exhibit A, as depicted Exhibit
B and legally described as follows:
Storm Drain Line Located In Government Lot 3, Section 13, Township 35N; Range
01E, Williamette Meridian.
An easement for storm drain purposes, 10 feet wide, lying 5 feet on either side of the
following described line:
Commencing at the monument at the mid-block of 6th Street, between I Avenue and
J Avenue, in the City of Anacortes, Washington, thence N88-05-46W, 379.78 feet to
an iron pipe monument at the intersection of 6th Street and I Avenue, thence N16-
07-46W, 69.3 feet to the True Point of Beginning, a catch basin, thence N51-02-53E,
71.8 feet to a catch basin, thence N01-02W, 22.5 feet to a catch basin, thence 03-31-
13E, 142.0 feet to the outfall end of the storm drain line which is the terminus of
this centerline description.
Together with and subject to easements, reservations, covenants and restrictions of
record.
Situate in the City of Anacortes, County of Skagit, State of Washington.
The purpose of this Easement is to provide Grantee access for installation and maintenance
of storm drainage culvert and attachments which jointly occupy the above described
easement and the Skagit County right-of-way.
No joint venture or partnership is formed as a result of the Agreement. Each party hereto
agrees to be responsible and assumes liability for its own negligent acts or omissions, or
those of its officers, agents, elected officials, or employees to the fullest extent required by
the law, and agrees to save, indemnify, defend, and hold the other party harmless from any
such liability. In the case of negligence of both owners and Skagit County, damages
allowed shall be levied in proportion to the percentage of negligence attributable to each
party, and each party shall have the right to seek contribution from the other party in
proportion to the percentage of negligence attributable to the other party. This
indemnification clause shall also apply to any and all causes of action arising out of the
performance of work activities under this Agreement.
