The Washington State Department of Health and the water purveyor, City of Anacortes, requires a double check valve backflow protection device for such use. Given that the site is primarily industrial,the double check valve would need to be installed at the water meter on the property owner's side. Please note that a plumbing permit will need to be acquired prior to the double check valve installation and that testing of the backflow device is required after installation by an approved individual. Terry Nemeth vi? pO& �'t �_AA On Wednesday February 25,2004 I stopped at 4 th ST to see if Canflex was through with our double check valve I had installed last week. When I arrived I noticed that the assembly was not being used but instead there was a 2" hose connected to a water line coming from the ground next to the building. Upon further investigation I followed the hose inside the building were they were filling rubber bladders.Normally this would not be an issue but I noticed there was no backflow assembly installed for this building. The rubber bladders are considered unapproved storage tanks. According to the DOH and the City of Anacortes regulations this facility must have a double check valve backflow assembly. Members present: Brad Snyder, John Curtis, Ken Wilson, George Mehler Staff present: Don Measamer Minutes of March 11, 1996 meeting were approved. Old Business Olson Variance ( 403 3rd St.) Mr. Olson requested clarification of building length limit imposed as a condition for a side-yard setback variance granted March 11, 1996; building length was limited to 40 feet. Mr. Olson explained that he misunderstood the discussion which resulted in the 40-foot building limit; he considered this a building footprint limit, whereas customary interpretation is total building length including eaves overhang. With 18-inch eaves, the building length would be limited to 37 feet which Mr. Olson contended inadequate for two vehicles (with the end-to-end parking garage design). A motion was made (Snyder/Curtis) confirming the building outside wall limit of 40 feet, with an additional 3 feet allowed for eaves overhang. Motion passed with all ayes. New Business Harker Vacation (2218 32nd St.) Chairman Brad Snyder absented himself from this agenda item; Vice-Chairman John Curtis continued the meeting. Mr. Harker reviewed this Petition for Street Vacation: the East 20-foot portion of C Avenue lying between the street center line and the far East portion of C Avenue vacated by Ordinance No. 2137 and adjacent to Lot 20, Block 11 Kellog & Ford Addition to Anacortes. Mr. Harker explained that he had previously vacated the far East portion of C Avenue to expand his residence while maintaining the needed 20-foot side-yard setback from the remaining undeveloped C Avenue. He has landscaped the area and has used the adjacent portion of C Avenue as driveway access to a rear-yard garage. The requested vacation will add the driveway portion of C Avenue to his property. City Staff: no comments/objections; there are no utility services presently in this section of C Avenue. Adjacent property owners signed-off on the Petition. Board recommendation to Council moved (MehlerNVilson) and passed with all ayes: City approve the requested C Avenue vacation but impose a condition allowing accessibility to the vacated street to install and service utility services should this become necessary. The Board believed that the long-range City Plan does not anticipate future development of this section of C Avenue. Mr. Mehler commented that the City should enter the "real estate" business and market (at true market value) several remaining undeveloped sections of C Avenue in this area, and for that matter, undeveloped and use-unplanned sections of streets throughout the City- if legally allowed; an excellent revenue source. 2. Tracy Variance (1217 37th St.) Mr. Tracy resubmitted a request for rear-yard setback variance from 20 feet to 8 feet for a proposed garage construction. The Board reviewed an identical request July 21, 1996 and granted the setback variance - however, Mr. Tracy did not exercise the variance within the allotted time because of financial considerations. After reviewing the issue, the Board unanimously approved a motion to grant the setback variance (Curtis/Snyder). Woodino Variance (406-418 30th St.) Mr. Wooding presented this request for a side-yard setback variance from 10 feet to 2 feet on the West property line of his building site along the Burlington Northern right-of-way (ROW). He plans tb construct a 50' X 220' pre-engineered steel building paralleling the property line. The area is zoned Heavy Manufacturing. Mr. Wooding proposes to construct three industrial buildings on the 2.4-acre tract as Phase 2 complementing the nearby completed Lake Erie Industrial Park, Phase 1. He explained that the angular West property line creates a hardship in maximizing building size (to tenant's needs) while providing adequate ground space for trailer truck accessibility, maneuverability, and parking; the latter needs were observed through experience in managing Phase 1 traffic flow. The buildings are targeted for single occupancy. Mr. Perkes, project designer, reviewed site/building dimensional details and how the requested setback relief is required. City Staff: Mr. Curtis (Fire Marshall) submitted some fire-safety needs which Mr. Perkes noted have been included in the project design. there were no other comments/objections. Discussion primarily addressed the visual impact of an expansive wall fronting the railway ROW as undesirable with the likelihood that the ROW will become a recreational pathway. The Board noted that the site plan allowed for a 15-foot required East side setback which could be an alternative setback encroachment to avoid the close proximity to the West side railway ROW. Mr. Wooding explained that this East side area has been retained as a potential vehicle parking area, although not designated as such in meeting Ordinance parking requirements; again, experience with parking needs in Phase 1 indicated this planning desirable. A motion to grant the requested variance was made (Curtis/Mehler) and passed with three ayes (Curtis, Wilson, Mehler), one nay (Snyder). The majority considered favorable action in keeping with encouraging business development in the Urban Renewal area. Meeting adjourned at 8:10PM.
