Members present Brad Snyder, John Curtis, Ken Wilson, Charles Boubeau, George Mehler Staff present: Don Measamer Minutes of May 5 were approved CC&R Development LLC Variance (3602 & 3606 West 7th Street) Mr. Rhoades reviewed this request for variance to raise the point of building height measurement approximately six feet for height measurement in the proposed construction of two single-family residences. Mr. Rhoades explained that, in the development of building sites in the area of platted West 7'h Street between Kansas and Minnesota Avenues in the Northern Pacific Addition, CC&R Development was required to construct West 7fh Street. This required regrading West 7th at Kansas Avenue adjacent to the subject lots approximately eleven feet above the natural grade of the area. Mr. Rhoades indicated that the requested relief in point of building height measurement would allow access to the proposed residences at street level. Mr. Measamer stated that the point of building height measurement is determined from the natural grade at the time a subdivision plat is recorded - in this case, the recorded Northern Pacific Addition. He noted that CC&R Development obtained the necessary permits for grading and construction of West 7th Street but used the underlying Northern Pacific Addition plat rather than recording a new plat of the area (which would have modified the point of building height measurement). He indicated that City Staff discussed with CC&R Development the consequences of the course of action the applicant followed in this matter (citing a memo from Steve Lange, City Engineering Department). Mr. Snyder commented that the variance request should have been for building height rather than point of height measurement. The variance request application included an outline that indicated a 35-foot building height above the rear yard. Thus the requested raise in point of building height measurement would increase the building height to over forty feet. Ms. Skillman, property owner below the subject properties, opposed the variance request stating the new residences would tower over her single-story residence. Mr. Harvey, property owner across West 7th, opposed the variance request stating the new residences would affect his two view lots on which he has imposed height restrictions to avoid impacting the view from other properties in the area. Memos from M/M Lea, M/M Keltz, and Mr. Curtis, all owners of properties that would be impacted by the added building height, opposed the variance request. A motion was made (Snyder/Wilson) and passed with all ayes to deny the variance request. The Board felt that a relief in building height was not justified in the matter. Robillard Appeal (5101 Kingswav) Mr. Robillard presented this appeal to a reversal of a decision by the City Planning Department that instructed Mr. Lehmann, his adjacent neighbor (5124 Doon Way), to comply with a 4-foot restriction of a fence above a retaining wall but to allow a 7-foot rear-yard fence on the retaining wall. The retaining wall serves Mr. Robillard's property that now has roughly a 2'/2-foot grade above Mr. Lehmann's property. Mr. Robillard reviewed the background of the issue. In 2004 he removed a dense cedar hedge growing along his property line above the Lehmann property. He found a gradual 2%-foot slope down to the Lehmann property and discussed with Mr. Lehmann his plans to install a simple stone retaining wall to level his yard. A) Special Conditions: The applicant has installed public right of way between Kansas Ave. and Minnesota Ave. in the Northern Pacific Addition to the Plat of Anacortes. The applicant was required to elevate W. 7th between Kansas Ave. and Minnesota Ave. approximately 11 feet above the pre-existing average natural grade in order to maintain grade and public access to Kansas Ave. The elevated portion of W. 7th abuts lots 1 and 2 Block 1113 to the Northern Pacific Addition to the plat of Anacortes. Under the current definition of"Height", Chapter 17.06 Definition of Terms Pg. 2-3 Subdivision and Zoning ordinance. The applicant is required to measure building height from the pre-existing, natural grade of the under laying plat. The applicant is not allowed to measure building height from the re-graded level of the road at the time the applicant recorded the subdivision of property. This condition requires that the applicant begins measurement of the building height approximately 11 feet below the level of the street effectively placing access to the building below the level of W 7`h. The applicant is requesting a variance to adjust the point of measurement approximately 6 feet to allow a positive graded access to lots 1 and 2 Block 1113 of the Northern Pacific addition to the Plat of Anacortes. B) Literal Interpretation: According to the literal interpretation of the Definition of term "Height" Chapter 17.06 City of Anacortes Subdivision and Zoning Ordinance, The Term"Natural Topography" shall be grades as they exist at the time of recording. Building "height" may be measured from the natural topography of the re-graded elevation at the time of recording of the final plat. This portion of the definition does not extend to tracts of land within the same district and are within the city plat. Because the applicant is using the underlying city grid to record lot subdivisions the applicant may not measure building height distance from the"Natural Topography" at the time of recording as similar plats within the same R2 district. The applicant is required to measure building height from the average of the natural grade prior to the installation of W. 7th. Thank You, CITY OF ANACORI''S r tekte e a..4on Michelle Deaton Permit Technician Don Measamer, I was just this morning made aware of a hearing scheduled for 7:00 pm tonight regarding a height variance for a planned residence on the NW corner of 7th and Kansas. I will not be able to attend this hearing, as we won't be located in Anacortes until July 18, 2005, but would like to inform you of my concerns. I very recently purchased a lot directly north of the requested height variance, and am in the final stages of developing my building plans. All of my planning has been based on sight lines calculated from the platted elevations that would affect my building plans. Allowing this variance would affect the existing vacant lots to the north and cause them to also seek variances from the recorded height restrictions. My plans at this time are to construct a residence that will be well within the current height restrictions of the city and in compliance with the spirit of the CC&R's recorded with the plat. Granting of this variance could cause a snowballing effect that may cause me to alter my plans to protect the view that was instrumental in my decision to purchase me lot. Thank you for considering my concerns in this matter, and I am looking forward to hearing the final results of the hearing. We feel the variance should not be granted. The north side of West 7th has already been designated with smaller lots than the rest of the neighborhood(a mistake in our opinion.) Due to that variance instead of one house directly behind one another there are two or three. Why is it that everyone that wants to build wants to change the rules to suit themselves without any regard for the people already living there?The lots in question should be left as they are without further deteriorating the space. The proposed variance to measure the building height six feet above grade has the potential to adversely affect the territorial view from Per and Barbara's property. This view was a significant factor in choosing to purchase this home and the proposed action will negatively impact their enjoyment of their property as well as potentially impacting the current and future value of their home.
