Members present Brad Snyder, John Curtis, Ken Wilson, Gary Coatney, George Mehler Staff present Ed Frank Minutes of the February 5, 2004 meeting were approved_ Jones Variance (4307 Whidbey Court) Mr. Jones reviewed this request for a variance in front-yard setback from 20 feet to 13%feet to construct a second-level deck on the front of their existing single-family residence. Mr. Jones explained that the house, which was built about four years ago with his request for a four-bedroom design, originally was designed to include the deck. But, because of setback problems with the irregularly shaped lot at the end of a cul-de-sac, the builder opted to eliminate the deck rather than redesign the house/deck. As a result the bold, overpowering appearance of the residence above the street is not aesthetically appealing; all the neighboring homes have a balanced appearance. Mr. Jones feels that the proposed deck will greatly improve the external appearance of his home in the neighborhood. There were no comments/objections from City Staff. Mr. Jones mentioned that his neighbors support the project. A motion was made (Wilson/Curtis) and passed with four ayes (Wilson, Curtis, Coatney, Mehler), one nay (Snyder) to grant the variance request. The majority recognized the unusual conditions of the lot and the applicant's desire to improve the visual appeal of the residence. Kelley Variance (1101 15th Street) Ms. Kelley reviewed this request for variance to the Underground Utility Ordinance to reroute an existing overhead power line drop to a proposed new commercial building. Ms. Kelley explained that the existing power line from 15th Street passes over a vacant lot to supply her residence. She plans to build a new commercial building on the vacant lot necessitating removal of the overhead line; the residence will be grandfathered into an alternative power drop elsewhere. Ms. Kelley reasoned that, since the overhead power line already passes over the proposed building site, why not use it as a drop to her new building. The objective is to reduce costs. In discussion, Ms. Kelley did not have a firm cost comparison between using the existing overhead drop vs utility undergrounding as required by the Ordinance but did suggest$375 for the drop vs maybe $3,000-5,000 for undergrounding. Mr. Snyder commented that this would be less than 2% of the total cost for the proposed commercial building project. The Board noted that the 15th Street and 0 Avenue area presently is already a mass of overhead wiring so the impact of this undergrounding would be minimal. There were no comments/objections from City Staff. A motion was made (Mehler/Curtis) and passed with four ayes (Wilson, Curtis, Coatney, Mehler), one nay (Snyder) to grant the variance request. The Board recognized the cost-benefit aspect of this situation. F I 2. Oxford Variance (1603 25t6 Street) Mr. Oxford reviewed this request for a variance in rear-yard setback from 20 feet to 11 feet to construct a 189 sq.ft. addition at the rear of an existing residence. Mr. Oxford explained that the proposed addition will provide a master bathroom and reconfigure the access to an existing bathroom and utility area. He mentioned that the building lot is on a cul-de-sac which necessitated placing the house further back on the lot in order to meet the front-yard setback at the radius of the cul-de-sac. Mr. Johnson, Anacortes Construction, further defined the proposed project. There were no objections/comments from City Staff or adjacent neighbors. A motion was made (Snyder/Curtis) and passed with all ayes to grant the variance as requested. The Board considered the project benefited the applicant with minimal impact on the neighborhood. Skagit Auto Parts Variance (2219 Commercial Avenue) Mr. Sahnow, owner, reviewed this request for a variance in the Sign Ordinance display area of a pole sign from 36 sq.ft. to 46 sq.ft. Mr. Sahnow explained that the recommended corporate standard "NAPA Auto Parts" pylon sign for his location is 62 sq.ft. but he is proposing the smaller 46 sq.ft. sign which he felt would provide much better visibility than a sign size required by the Ordinance, and at about the same cost. The sign will meet the minimum 14-foot ground clearance. The Board noted that the proposed location for the sign is in an area free of obstructions with good visibility. A motion was made (Mehler/Curtis) and passed with all ayes to deny the variance. The Board felt that compliance with the Ordinance would not be a business detriment for the applicant. Provisions of the Zoning Ordinance: Part 17.34.060A— Front yard requirements for the Residential Medium Density Zone. Justification: Surrounding homes have a sense of depth and character due to design and external features, such as decking, etc. Our home lacks these desired features. At the time of construction, our home was originally designed with a deck facing the street. Due to the size of our home, we were informed by our builder that we could not have a deck on the street side due to the 20 foot setback. We were not advised by our builder as to options, such as redesigning the house/deck or requesting a variance from the City at the time of construction. We feel our home is not aesthetically appealing due to the lack of depth and character, which is common in neighboring homes.
