Referenced drawings are PTC Inc. shop drawings PT-1 and PT-2 and structural drawings S1 and S2. • Prestressing Steel - Reviewed Titan Steel and Wire Co. LTD submittal. Wire is 1/2" diameter, 7 strand, ASTM A416, 27 KSI as specified (low relaxation strand). No torn or damaged sheathing was observed. Anchorages - Appeared acceptable, properly positioned. Need to insure tight contact between plastic grommets and form to prevent cement paste infiltration. • Tendon Lengths -Acceptable Tendon Placement - The correct number of tendons were in place. Orientation, support, clearances were satisfactory. Rebar 1) 2 - #5 continuous rebar were not properly lapped along line 1, Ito K. 2) #4 rebar mat was in place at 18" o.c. each way 3) #3 hairpins were not in place at all locations. GEO/Test will recheck prior to concrete placement. In our opinion, the reinforcement (except as noted on rebar items 1 and 3) and post-tensioning tendons are acceptable for concrete placement, scheduled for Friday, 4-26-96. During construction of the Fidalgo Marina facility, the proposed eight-inch gravity sanitary sewer line along the south side of their site, was revised to a six-inch diameter with a designed slope equal to 0.006. This existing six-inch gravity line extends from the existing sewer manhole in "V" Place, easterly, to a cleanout located approximately 30 feet east of the 1 vehicle turnaround area. The Fidalgo Marina provides gravity flow to this line from their clubhouse building and provides a pumped discharge from the waste storage structure down at the docks. According to Mr. Sortune, the pump from the waste storage structure is rated at 40 gallons per minute; however, due to pipe losses and elevation loss, likely operates at 20 to 30 gallons per minute. The existing six-inch gravity sewer line has a capacity of 210 gallons per minute based upon the designed slope. The proposed sanitary sewer service from the Bunnies By The Bay facility is to connect near the easterly end of the existing six-inch gravity sanitary sewer. This proposed sewer line will be kept as high as possible to prevent any backflow potential from the forcemain installed by Fidalgo Marina. It appears the existing six-inch gravity sanitary sewer line has sufficient capacity to handle the gravity flow from the Fidalgo Marina Clubhouse, pump discharge from the marina docks, and a gravity flow from the Bunnies By The Bay facility. The general contractor for this project, Fisher & Sons, has been informed of the size of the existing sanitary sewer line and has been directed to keep the proposed six-inch line from the new building as high as possible. We will proceed with the sewer construction according to this condition unless you feel this is unacceptable to the City of Anacortes. This letter is to formally make the final ruling on consistency and to file the required notice with your department. Pursuant to WAC 173-27-100, the revised permit is effective immediately. However, "appeals shall be in accordance with RCW 90-58.180 and shall be filed within twenty-one days from the date of receipt of the local government's action by the Department" This revision is being transmitted by overnight mail and, accordingly, the twenty-one days should be calculated from January 31, 1997. That drawing is not consistent with the original intent of the submittal nor with the document's own conclusions. Exhibit 8 does not depict a deck that was to be constructed extending beyond the top of bank and up to a point land ward of the ordinary high water, as described in Conclusion 7.6. It also does not depict a line of Ordinary High water necessary in evaluating this shorelines application. Enclosed is a new graphic which is being submitted in order to modify Exhibit 8. A building permit application has been made by Bunnies by the Bay for the construction of a deck extending to within 2' of the ordinary high water. It was brought to our attention that the proposed work falls out side of the scope depicted in the current exhibit 8 and the building department can not issue a permit. Please review this request for a modification of the documents. If you find it consistent with the conclusions and forward it to DOE for processing please allow Mr. Frank to release a permit in order for us to build the deck. Box 547 Anacortes, WA 98221 Reference: Bunnies by the Bay • Dear Don: I have been contacted by the Harbor Keeper, Mr. Ina Sortune of Fidalgo Marina. During construction of the Fidalgo Marina facility, the proposed eight-inch gravity sanitary sewer line along the south side of their site, was revised to a six-inch diameter with a designed slope equal to 0.006. This existing six-inch gravity line extends from the existing sewer manhole in "V" Place, easterly, to a cleanout located approximately 30 feet east of the vehicle turnaround area. The Fidalgo Marina provides gravity flow to this line from their clubhouse building and provides a pumped discharge from the waste storage structure down at the docks. According to Mr. Sortune, the pump from the waste storage structure is rated at 40 gallons per minute; however, due to pipe losses and elevation loss, likely operates at 20 to 30 gallons per minute. The existing six-inch gravity sewer line has a capacity of 210 gallons per minute based upon the designed slope. The proposed sanitary sewer service from the Bunnies By The Bay facility is to connect near the easterly end of the existing six-inch gravity sanitary sewer. This proposed sewer line will be kept as high as possible to prevent any backflow potential from the forcemain installed by Fidalgo Marina. it appears the existing six-inch gravity sanitary sewer line has sufficient capacity to handle the gravity flow from the Fidaigo Marina Clubhouse, pump discharge from the marina docks, and a gravity flow from the Bunnies By The Bay facility. The general contractor for this project, Fisher & Sons, has been informed of the size of the existing sanitary sewer line and has been directed to keep the proposed six-inch line from the new building as high as possible. We will proceed with the sewer construction according to this condition unless you feel this is unacceptable to the City of Anacortes. F � �IC LT: Before the Planning Commission, City of Anacortes Shoreline Management Substantial Development Permit Application by Bunnies by the Bay Shoreline Permit# 226 Findings of Fact and Conclusions of Law and Decision Thereon FINDINGS OF FACT 1. General Background 1.1 The City of Anacortes Planning Director has been designated the Shorelines "Administrator" and "Environmental Officer" for the City of Anacortes Shoreline Management Master Plan, Section 5 - Definitions, Appendix C. 1.2 Under Section 11: Permit Procedure, d) "Not more than 5 working days after the 30 day review period, or following a hearing, if necessary, the Environmental Officer shall recommend approval or denial of the permit to the Planning Commission who shall approve or deny the permit at their next meeting. If the Planning Commission does not act on the permit the decision of the Environmental Officer shall stand." 1.3 Application was made on October 27, 1995 for a Shoreline Substantial Development Permit to build a 12,000 square foot manufacturing plant, parking and a 20' x 24' display building for accessory retail sales at the site entrance at 3101 "V" Place, Urban Renewal Area, Anacortes. The application and attachments are shown as Exhibit 1. 1.3.1 Site plan and vicinity map are shown as Attachment A to Exhibit 1 (3 pages). 1.4 The proposed project is located on Fidalgo Bay. The project is located on property formerly owned by the Fidalgo Marina; this property is surplus to marina needs. No water access is available at this location given the existing marina configuration located between project site and the open water. 1.5 The proposed building height is 40 feet in a shoreline zone that permits structures of 50 feet or more and has a Zoning Ordinance designation that permits structures of 40 feet with this building configuration and a pitched roof (as proposed). The required setback from the ordinary high water mark is 0 feet and the proposed deck is set back from the ordinary high water mark as shown on the project drawings. 1.6 As previously stated, the proposed property is surplus to the requirements of the Fidalgo Marina. However, when the marina and the associated uplands, including the subject property, were developed a public access float was constructed and ownership transferred to the City to provide a permanent public access point at this location in Fidalgo Bay; see Attachment A to Exhibit 1 (page 1). 2. State Environmental Policy Act 2.1 A Mitigated Determination of Nonsignificance (hereinafter "MDNS") was issued for this project on November 13, 1995 by the City of Anacortes, the SEPA lead agency. Exhibit 2 2.2 This lead agency has determined that it does not have a probable significant adverse impact on the environment provided that the condition set-out below is satisfied. Accordingly, an environmental impact statement (EDIS) is not required under RCW 43.21C.030(2)(c). This decision was made after review of a completed checklist and other information on file with the lead agency. This information is available to the public on request. 1. Stormwater management plan shall meet Washington State Department of Fish and Wildlife requirements (see Condition # 5). 2.3 The MDNS was made available for public comment on November 13, 1995 and mailed that same day to the following agency with a deadline for comment of December 1, 1995: State Department of Ecology. 2.3.1 Two letters of comment were received: Exhibit 3: 11/3/95 letter from Department of Ecology The following comments are submitted by the Shoreline Administrator in response to the eight points made by the State Department of Ecology: (1) see Findings 1.6 and 4.2.2.1, (2) retention of a major employer such as Bunnies by the Bay within the City of Anacortes on a site of their choice is of extreme importance to the Anacortes community, (3) the project does not exceed the height limitation in either the shoreline designation (see 1.5) or the industrial zone within which it is located (the view impacts were carefully considered in the crafting of the industrial zone height limits), (4) public access opportunities are addressed in Finding of Fact 1.6 and Condition # 7, (5) the deck will not be cantilevered over the water but set back from the ordinary high water mark (see Condition 6), (6) accessory retail sales are permitted in the industrial zone and, by implication, are appropriate in the Urban 1 shoreline environment, (7) the fill proposed is necessary for structural stability on a dredge disposal fill site such as this, and (8) the parking proposed is required under City Zoning Ordinance. Exhibit 4: 12/1/95 letter from Department of Fish and Wildlife (See conditions 5 and 6) 2.4 The MDNS was published in the Anacortes American on November 22, 1995, again with a deadline for public comment of December 1, 1995 and posted on the project site on November 17, 1995. 3.0 Notice 3.1 Section 11: "Permit Procedure", page 6, item b) of the Shoreline Master Plan with regard to Public Notice states, in part: "Upon receipt of the application, the Environmental Officer shall instruct the applicant to publish notices of the application once a week for two consecutive weeks in a newspaper of general circulation in the City of Anacortes. In addition, the Environmental Officer shall post at least four copies of the notice prominently on the subject property or in conspicuous public places within 300 feet thereof. Within thirty days of the final publication of notice, any interested person may submit his views upon the application, in writing, to the Environmental Officer." 2 3.2 Notice of Application was published in the Anacortes American on November 1, 1995 and November 8, 1995, (Exhibit 5) and four copies of the Notice were posted on the site and copies were also posted at the Municipal Building, Library and Post Office on October 27, 1995 (Exhibit 6). 3.3 No letters of comment were received in response to the Notice of Application. 3.4 The 30 day review period for this project ended on December 8, 1995. The Environmental Officer forwarded Findings of Fact and Conclusions of Law to the Planning Commission. The Planning Commission reviewed this permit on December 13, 1995 and voted to approve the project subject to the conditions set-out below. 4.0 Shoreline Master Plan 4.1 The subject property is in a shoreline area designated Urban I by the Shoreline Master Plan for the City of Anacortes. This designation is primarily for industrial purposes and those which are appropriate for industrial purposes. The intent of the designation is to provide for efficient utilization of suitable shoreline areas for water dependent commerce and industry consistent with the Shoreline Management Act of 1971, as amended. (Corresponds to Industrial Zone) 4.2 The applicable goals and policies of the Shoreline Master Plan have been met by this application: • 4.2.1 GOALS AND OBJE _IIVES SHORELINE USE ELEMENT GOAL Shorelines are to be managed and activities coordinated in order to preserve long term multiple benefits of the various shoreline resources. II ECONOMIC DEVELOPMENT ELEMENT GOAL Provide opportunity for development of water dependent, commercial and industrial uses at appropriate locations. Objective: Assure that adequate deep water sites will be available for uses requiring such sites. GOAL Establish multiple-use commercial and industrial sites for compatible activities. 4.2.1.1 Water Access The City of Anacortes has provided the following water access arrangements for its entire 60 acre industrial park on Fidalgo Bay: a barge dock at 29th Street, a boat haul-out/travel-lift at 29th Street, a public float at 30th Street with twelve accessory parking spaces, and a concrete boat launch ramp at 31st Street. The Fidalgo Marina now encloses these facilities with a concrete breakwater. For its part the U.S. Army Corps of Engineers is contractually committed to maintaining the access channel to this area (the Anacortes Navigation Channel) to a depth of minus 18 feet. 3 Accordingly, the Shoreline Use and Economic Development Element Goals and Objectives have been addressed in a manner that permits one acre of waterfront property to be developed for a non-water dependent industrial/commercial use. 4.2.2. SECTION 20: Use-Activitv Policies and Reaulations 4) COMMERCIAL DEVELOPMENT: Developments having a primary use for retail or wholesale trade or other business activities. Policies a) Commercial developments on shorelines of the City should be shore dependent or provide an opportunity for a substantial number for patrons or the general public to enjoy the shoreline. (Emphasis added). b) Commercial development should be encouraged to locate near existing commercial sites or abandoned industrial or manufacturing sites. Regulations a) Except for marinas and related facilities and port facilities, business or commercial uses constructed over water are to be shoreline dependent and provide for regulated public access; this is not to be interpreted to restrict development of commercial uses upon existing docks and wharves. b) Warehousing is permitted on shorelines only as an accessory use directly serving a water-dependent use. 4.2.2.1 The project is located on property formerly owned by the Fidalgo Marina; this property is surplus to marina needs. No water access is available at this location given the existing marina configuration located between project site and the open water. However, when the marina and the associated uplands, including the subject property, were developed a public access float was constructed and ownership transferred to the City to provide a permanent public access point at this location in Fidalgo Bay; see Attachment A to Exhibit 1 (Page 1). The project's accessory retail sales component will draw a substantial number of patrons to enjoy the shoreline. Further, the former owners of the subject property provided the adjacent public access float at 30th Street before the subject property was determined to be surplus to marina support needs. Finally, the proponents will provide a 20 foot wide public access easement/viewpoint as detailed in Condition # 7 to provide an opportunity for a substantial number of patrons and the general public to enjoy the shoreline. No over water construction or warehousing is involved with this project. Accordingly, the Commercial Development Policies and Regulations have been complied with. 11) PORTS AND WATER RELATED INDUSTRY: Public or private facilities for transfer of cargo or passengers from water-borne craft to land and vice-versa; and facilities for processing manufacturing and storage of goods. Policies a. Water-dependent industrial or port uses should be given priority for frontage on navigable waters over other industrial uses. 4 b. Public access opportunities are encouraged at port and industrial sites, if such access would not interfere with operations or endanger public health and safety. c. Cooperative and complementary port and industrial activities are encouraged to locate in common areas. d. Shoreline industrial areas presently served with City utilities and transportation networks and zoned industrial should be considered for use before establishing additional industrial shoreline areas. Regulations a. Existing Port or industrial development on shoreline which is neither shore nor water dependent or related shall be permitted to expand inland from, but not along the shoreline. b. Plans for industrial developments shall provide for screening and buffer areas. c. The Port of Anacortes and City shall coordinate the cooperative and multiple use of piers, docks, and parking facilities. 4.2.2.2 Industrial Use As detailed in 4.2.1.1 the entire City 60 acre industrial park has been developed to maximize water access. No water access is available at this location given the existing marina configuration located between project site and the open water. Accordingly, the applicable policies and regulations covering industrial use have been addressed in a manner that permits one acre of waterfront property to be developed for a non-water dependent industrial/commercial use. 5.0 Zoning Ordinance 5.1 The City Zoning Map establishes zone boundaries and the City Zoning Ordinance establishes (I) the permitted use of land in the various zones and (2) development standards. 5.2 The subject property is in an Industrial District (I), Chapter 17.16 of the Anacortes Municipal Code, Title 17, Zoning. See Exhibit 7. 5.2.1 Section 17.16.010 - "Purpose" states: The Industrial District is intended primarily for heavy manufacturing and closely related uses. To avoid unnecessary regulations on heavy manufacturing, regulations for this district are intended to provide protection principally against effects harmful to other districts and to buffer industry from complains from adjacent areas. 5.2.2 Section 17.16.020 - "Permitted Uses" states: Any industrial, research and development centers, office, park, repair, warehousing, processing, and shipping terminal uses provided that such uses are of such a nature that they do not inflict upon neighboring districts smoke, dirt, noise, vibrations, odor, glare, or other nuisances or hazards detrimental to the health, welfare, and safety of persons occupying or visiting the district or adjacent districts. 5.2.3 These general purposes and uses as set forth in Section 17.16.010 and 17.16.020 have been met by this proposal as have been the specific dimensional requirements. 5 6.0 Findings of Fact 6.1 The requirements of the State Environmental Policy Act have been complied with. 6.2 The Public Notice requirements of the Shoreline Management Act have been complied with. 6.3 The project is consistent with the shoreline designation and general goals and objectives of the Anacortes Shoreline Master Plan. 7.0 Conclusions A Shoreline Substantial Development Permit# 226 should be issued to Bunnies by the Bay to build a 12,000 square foot manufacturing plant at 3101 "V" Place subject to the conditions that: 1. A Building Permit shall be secured from the City of Anacortes prior to any construction activity authorized by this permit being begun. A soils study will be required as part of Building Permit requirement. 2. The scope of this project not exceed that as set-out in the shoreline application (including attachments) and the accompanying SEPA checklist (including attachments), as revised in the Attached Exhibit 8. 3. This project is subject to applicable water, sewer, and stormwater hookup fees and transportation, fire, school, and park impact fees. These fees are payable at levels in effect at the time of building permit issuance and may differ from those fee levels currently in effect. 4. Stormwater runoff treatment shall utilize best management practices in accord with the Puget Sound Water Quality Manual as determined by the City Engineer. 5. A Hydraulic Project Approval administered by Washington State Department of Fish and Wildlife is required for the stormwater element of the proposed project. The stormwater management plan must satisfy the Department of Fish and wildlife stormwater quality requirements in addition to those of the City of Anacortes. 6. No part of the proposed manufacturing facility including the proposed deck structure shall be built waterward of the ordinary high water line. 7. A 20' wide public access easement shall be provided on the subject property from the cul-de-sac to the top of the bank as shown on Exhibit 8. 8. A Building Permit shall be secured from the City of Anacortes prior to any construction activity authorized by this permit being begun. A soils study will be required as part of Building Permit requirement. 2. The scope of this project not exceed that as set-out in the shoreline application (including attachments) and the accompanying SEPA checklist (including attachments), as revised in the Attached Exhibit 8. 3. This project is subject to applicable water, sewer, and stormwater hookup fees and transportation, fire, school, and park impact fees. These fees are payable at levels in effect at the time of building permit issuance and may differ from those fee levels currently in effect. 4. Stormwater runoff treatment shall utilize best management practices in accord with the Puget Sound Water Quality Manual as determined by the City Engineer. 5. A Hydraulic Project Approval administered by Washington State Department of Fish and Wildlife is required for the stormwater element of the proposed project. The stormwater management plan must satisfy the Department of Fish and wildlife stormwater quality requirements in addition to those of the City of Anacortes. 6. No part of the proposed manufacturing facility including the proposed deck structure shall be built waterward of the ordinary high water line. 7. A 20' wide public access easement shall be provided on the subject property from the cul-de-sac to the top of the bank as shown on Exhibit 8. 8. Any violation of this permit and its conditions shall constitute a violation of the State Shoreline Management Act and its regulations and be subject to its penalties. This permit is granted pursuant to the Shoreline Management Act of 1971 and nothing in this permit shall excuse the applicant from compliance with any other federal, state, or local statutes, ordinances, or regulations applicable to this project, but not inconsistent with the Shoreline Management Act (Chapter 90.58 RCW). This permit may be rescinded pursuant to RCW 90.58.140(8) in the event the permittee fails to comply with the terms or conditions hereof. MONDAY MAY 6, 1996 On site to inspect the stressing of post tension slab tendons. The slab concrete was placed on 4-30-96. Three field cure specimens tested for compressive strength on this date averaged 3190 psi. See GEO/Test report C2. A compressive strength of 3000 psi minimum is required prior to stressing according to the structural notes. Stressing ducts were clean, anchors were in place, and reference marks were painted on the tendons for checking elongation. Stressing took place from 8:30 AM to 11:45 AM. Two calibrated rams/gauges were used to perform the work. Calibration records were checked for both pieces of equipment, and found satisfactory. The latest calibration was done on 2-7-96. The work was performed by Larry Mills and Mike Chambers of West Coast Steel. Stressing started at the northwest corner (east - west tendons) at grid K1, and progressed south to grid K4. A total of 56 east-west tendons were stressed. The north - south tendons were stressed beginning at the southwest corner at grid K4, working east to grid A3. A total of 78 north-south tendons were stressed. The overall total number of tendons was 134. All tendons were stressed to the required gage reading of 6860 psi; or 33 kips. Measured elongations met or exceeded calculated elongations, and no tendon exceeded the maximum specified deviation of +/- 7%. See "Stressing Record" pages 1 through 6 for individual measurements.
