Members present: Brad Snyder, Ken Wilson, Gary Coatney, George Mehler Staff present: Ed Frank Ramaglia Variance (3217 M Avenue) Mr. Ramaglia reviewed this request for a front-yard setback variance from 20 feet to 6 feet from M Avenue to enlarge an existing deck attached to his residence. Mr. Ramaglia explained that the existing 6-foot wide deck is too narrow for full enjoyment of family activities. The proposed 175-sq.ft. deck would extend an additional 8 feet into the front setback; the plan would also include a 5 to 6-foot screening railing for the deck along M Avenue; the front of the deck would be about three feet above ground thus requiring a minimum 3'6" railing. Mr. Ramaglia stated that M Avenue with sidewalks is not developed to the full width of the platted 80-foot right-of-way so that the proposed deck would be 20 feet from the sidewalk. There is a 4'6" latticed fence along the front of the property set back approximately three feet from the property line; the proposed deck would be within 2 to 3 feet of this fence. Mr. Ramaglia indicated that an alternative location for the deck is not an option. Vehicular sight obstruction is not a problem. There were no City Staff comments/objections addressing the setback variance In discussion, the Board noted that the proposed deck with screening railing immediately behind the front fence would give an unacceptable appearance of an 8-foot fence when viewed from M Avenue. Railing alternatives were discussed; a motion by Mr. Wilson to grant the setback variance, limiting the railing height to 3'6"was not seconded. A motion was made (Mehler/Coatney) to deny the setback variance request and passed with three ayes (Snyder, Coatney, Mehler), one abstention (Wilson). The Board stated that special conditions to warrant variance approval were not demonstrated by the applicant; the configuration of the proposed railing and existing fence would create a negative visual impact from M Avenue. Bean Variance (3017 V Place) Mr. Bean reviewed this request for side-yard setback from 10 feet to zero feet to construct a 14'X8' building on the site of his commercial boat launch/recovery facility. Mr. Bean stated that the building will house a pump/filter and tanks required to treat water from pressure washing boats brought in on his new boat ramp; his facility will handle big boats (greater than 40 feet). However, the width of the ramp is limited so that it would be difficult to bring in boats with the wash building at the required 10-foot setback. The building would have a slightly pitched roof to about ten feet above ground. There were no City Staff comments/objections addressing the setback variance. The owner of an adjacent Marina stated that he understands Mr. Bean's situation and would prefer a minimum visual impact of the building on his operation. A motion was made (Snyder/Coatney) and passed with all ayes to grant the side-yard setback variance stipulating that the roof of the building have a 4 in 12 pitch to a maximum ridge height of eight feet. The Board noted that the narrow site is a special condition that creates a limitation for the applicant in his commercial venture. 2. Jehovah's Witness Variance (2511 29th Street)) Mr. Schuemann, representing the applicant, reviewed this request for a variance in the Sign Ordinance for a free-standing sign setback from ten feet to three feet along 29thStreet. Mr. Schuemann explained that the congregation is in the process of reconstructing the parking area and access to their Kingdom Hall to comply with ADA requirements. Because the Hall site slopes away and below 29th Street there has been extensive grading of the site and a retaining wall constructed to support 29th Street. To maximize the parking area, parking spaces have been installed immediately adjacent to 29'h Street and a circular vehicular flow pattern established from a single 29th Street entrance. A sign is proposed at the entrance to the site, replacing a present sign on the building that has poor visibility because it is so far removed from 29th Street. However placing the sign to a required 10-foot setback would interfere with the proposed traffic entrance lane; the requested 3-foot setback would avoid this problem. A large portion of the sign would actually be below the level of 29"'Street because of the site grade. There were no City Staff comments/objections. A motion was made (Snyder/Mehler) and passed with all ayes to grant the setback variance. The Board reasoned that the setback relief would significantly benefit the applicant with no impact on the neighborhood. It is a closed loop system. It will consist of a 500-gallon holding tank for non-treated wastewater, the treatment system, and a 500-gallon holding tank for treated wastewater. The treatment system (see enclosed drawing) consists of a 200-gallon, cone shape, fiberglass tank with a steel stand and a large Racor filter that collects the sludge. Wastewater from the non-treated wastewater tank is pumped into the 200-gallon tank of the treatment system. A combination of lime and alum is then added to the tank. The solution of wastewater and chemicals is then agitated and mixed thoroughly. This causes the metals and pollutants to chemically bind and settle to the bottom of the tank in a solid form. The water is then filtered through the Racor filter and pumped into the "treated" holding tank, where it is now clean enough to re-use in the power washer. The sludge is collected in the filter canister and is collected into a 5 gallon bucket, then disposed of in our dumpster, which currently accepts such sludge in 5 gallon buckets.
