Re: Sewer Hookup Fee for 309 "U" Avenue
Dear Mr. Mendum:
Referencing our conversations of a few days ago regarding the
necessity to pay a new sewer hookup General Facilities Charge
for 309 "U" Avenue, please consider this letter as confirmation
that this fee does not apply to this property.
The criteria for repaying a sewer General Facilities Charge as
per our ordinance is that the water service must be discontinued
for three years and the building must be removed or will be
substantially rebuilt. The key word here is "and" as it takes
both conditions to require payment. In the case of 309 "U"
Avenue, both these conditions do not exist as you have
reinstated the water service prior to the three year limit and,
as I understand it, the building would not have to be removed,
although it probably will be or substantially remodeled.
Therefore, again the determination is that no new sewer General
Facilities Charge will be made against this property.
