We have submitted copies for your review and comment. We would like to institute these standards ASAP to minimize any future confusion regarding the interpretation of the Uniform Fire Code and required access ways. Because this process is not complete, we will accept an 80-foot circular cul-de-sac as a minimum for Mr. Goddard's project. The cul-de-sac will be required to be posted "No Parking" and maintained "free of any obstructions." This reduction represents a deviation from the standard we are proposing, but it is one that allows Mr. Goddard and Mr. Burkum to fulfill the minimum required turnaround within the available space and right-of-way. It should be noted that these requirements are due to the UFC's language which state an approved fire apparatus road shall be provided to within 150 feet of all sides of any structure as well as an approved turnaround shall be provided for dead-end fire apparatus roads in excess of 150 feet in length. If Mr. Goddard and Mr. Burkum can show that these distances do not apply to their lots, then the turnaround may not be required. It should also be noted that during Mr. Goddard's last contact with Ed Frank and myself, subsequent to my letter of December 6, 1993, Mr. Goddard was going to re-submit a modified turnaround proposal to the fire department and building department for review. He has not done so yet. The two fire hydrants, as noted on the site plan, on Shannon Pt. Road are acceptable as meeting the 250 foot travel distances to the proposed building sites. Mr Goddard needs to contact the Public Works Department for specific requirements for installation of these hydrants 2. The access road to the northern half of Block B and southern half of Block A is in excess of 150 feet. A ninety-foot cul-de-sac is required. The surface shall be "all weather" and capable of supporting the weight of fire apparatus, as per UFC-1991, Section 10.204. 3. The access road to the building site on the southern half of Block B shall also need to meet this requirement when future development occurs �G`J i i i BOARD OF ADJUSTMENT 4+ \-_lKAIhi ITES - NOVEMBER 5, 1998 REGULAR MEETING Meeting called to order by vice-Chairman John Curtis at 7:00PM. Members present: John Curtis, Ken Wilson, Ron Rosenberger, George Mehler Staff present: Edwin Frank Minutes of the October 1, 1998 meeting were approved. Mt. Baker View Condo Variance (910 34th Street} Mr. reviewed this request for a variance in maximum land coverage from 50% to 57.6% to allow a garage enclosure for three tenant parking spaces provided in a new 9-unit condominium now under construction. Mr. explained that the construction plans provide 15 enclosed parking spaces beneath the condominium building but, with an objective of two parking spaces per unit, it is necessary to have three additional parking spaces outside of the building. The proposed garage will provide security for this exterior parking. Vehicular entry will be from the rear alley; the alley will also access some of the r • parking beneath the building. The project includes black-topping the alley. City Staff comments: Mr. Davis questioned the necessity for the additional parking; there were no other comments/objections. Mr. Frank confirmed that the applicant was aware of the land coverage restriction in the Zoning Ordinance. Three neighboring parties (Harley, Colby) expressed concern about excessive land coverage, excessive traffic in the alley, and a significant increase in traffic on unpaved 34th Street and Q Avenue brought about by this project and several others in the vicinity. A motion to deny the variance was made (Curtis/Rosenberger) and passed with all ayes. The Board reasoned that, because this is new construction, the applicant would be expected to develop plans in compliance with the Zoning Ordinance. Rite Aid Variance (1517 Commercial Avenue)} Action on this request was postponed because the applicant was not present at the meeting. Fidalgo Square Variance (1710 Commercial Avenue) Mr. Allen, Madrona Real Estate Investments, reviewed this request for variances in the free-standing sign provisions of the Sign Ordinance to increase sign height from 10 feet to 12 feet and sign area from 60 sq.ft. to 62.5 sq.ft. The sign, at the corner of 17th Street and Commercial Avenue, meets set-back requirements. Mr. Allen explained that the added height is needed for sign visibility above vehicles parked along Commercial Avenue and the sign is one used by the national franchisee, Taco Bell (thus the area consideration). There should be no traffic visibility problems since setback requirements are met. There were no City Staff comments/objections Mehler). A motion to grant the sign variances was made (Mehler/Rosenberger) and passed with all ayes. The Board reasoned that the minor deviations to the Sign Ordinance were justified in providing the applicant needed advertising in the highly competitive food franchise business. Goddard Variance (5705 Sheila Ann Court) - - Mr. Goddard reviewed this request for variances in accessory building maximum area from 1,000 sq'tf:Yd 1;440 sq.fk and maximum height from 16 feet to 19 feet to construct a metal shop building for vehicle/boat storage. • 0 0 2 Mr. Goddard explained that his property, which will include the proposed building, is 31,878 sq.ft. (half a platted City block) with a single residence. He stated that the proposed building will not impact neighboring properties to the east is the State Ferry upper parking lot, street-end cul-de-sacs are to the north and south, and the west is shielded by trees. The building will have a color scheme similar to his residence. City Staff comments: Mr. Mansfield cautioned that the lots with the accessory building could be sold in the future without a primary residence. There were no other comments/objections. A written note from Mr. Burkiem, neighbor, favored the request. Mr. Goddard was not aware of objections from other neighbors. He also commented that the position of the house on the property pretty much obviated the possibility of a lot sale concern cautioned by Mr. Mansfield. A motion to grant the variance was made (Mehler/Curtis) and passed with all ayes. The Board felt that the property size and location essentially assured that the proposed building will have minimum impact on the surrounding neighborhood. Curtis Variance (3312 G Avenue) Mrs. Curtis reviewed this request for a rear-yard setback variance from 20 feet to zero feet to ii construct an 8' X 10' utility shed r` ' Mrs. Curtis explained that the selected location for the shed avoids residence window obstruction, a planting area, a sports court, and other uses in the rear yard. She noted that a 6-foot fence along the rear-yard property line will greatly lessen the visual impact of the shed. She also mentioned that neighbors supported the variance request. City Staff comments: Mr. Davis recommended a 5-foot setback; there were no other comments/objections. Mr. Frank mentioned that the City is presently reviewing 1998 revisions to the Zoning Ordinance including a proposal to reduce the rear-yard setback requirement for an accessory building to five feet. A motion to grant a rear-yard setback variance to one foot was made (Mehler/Curtis) and passed with all ayes. The Board considered this optimal use of a rear yard will have little impact on the surrounding properties. Radtke Variance (1904 Commercial Avenue) Action on this request was renewed as City Staff has resolved a vehicle parking issue which impacted this request and which the Board felt, at the October 1, 1998 meeting, should be addressed before hearing the variance. Mr. Radtke reviewed this request to increase the current maximum land coverage exceedance for a business property from 60% to 62% (from 1170 sq.ft. exceedance to 1470 sq.ft.) to replace several storage buildings with a single building. No rear-yard or side-yard setbacks are required in the Commercial Zone unless abutting a residential zone. He stated that the existing buildings are practically in total disrepair and a visual eyesore; the proposed new building will be functional and attractive.. City Staff comments addressed (redundantly) the parking issue; Mr. Harju indicated that the new building will be favorably looked upon from the fire standpoint. A motion to grant the variance request was made (Rosenberger/Curtis) and passed with all ayes. The i Board considered replacement of the existing buildings a very positive action.
