I vent out to 571E eugarloel on 9-15- 97 to proceed with corrections needed on maid project. However, upon further inspection, the corrections have already beer. taken care of. The edges along the gables (rakes) have been hand sealed. The bottom course c.f shingles have been sealed. The (shiners) nails that. were visible in the field have been removed? Or at least caulking installed over the heads. The valley has not beer. re--cut, but is has been hand sealed down. It is now glued solid and you cannot get it apart. As of 9-16-97, we are not responsible for any further findings, and or solutions to the project listed above. We have not done ONE thing to this Tool, except Inspect only. Our only concern is to have this house completed correctly. You may have "addressed" or talked with us about the deficiencies that we have brought to your attention but they have NOT all been corrected. As stated in our February 3rd letter we have been waiting for 3 loads of topsoil to be delivered. This has been requested and agreed to on many occasions since before the middle of July. As stated in our February 3rd letter we have been waiting for light tube tape. This has been requested and agreed to since September. As stated in our February 3`d letter we have been waiting for interior paint on the drywall repairs that your subcontractor made in November. This has been requested and agreed to since September. It is now February....not timely. As stated in our February 3`d letter we are still waiting for you to correct the findings as listed by the City in their letter of December 30th. It is now over 30 days later....not timely. Your response is "to delay such repairs a couple of months." We can understand delaying repairs to the damage to the interior caused by settling. We can NOT understand delaying the repair of all the other deficiencies. The exterior doors now have 3 coats of defective finish paint. We would rather that you didn't add any more paint to the doors so we are settling for less than professional quality workmanship. Our adjustment for the roof inspection is based on the following: 1) In April it was agreed that you would have a roofing contractor (other than the contractor who installed the roof) remove some shingles and inspect the roof. We proposed to pay for any expense if it was determined that the roof was installed to meet the manufacturer's guarantee, otherwise you would absorb that expense. 2) After you failed to seek a roofing contractor, we consulted Wetherholt and Associates (a disinterested 3`d party) who was referred to us by the shingle 1- • f • manufacturer. During the meeting on July 14th it was determined and agreed to by you that the roof had not been installed to meet the manufacturer's guarantee. Immediately following that meeting you agreed to pay Wetherholt's bill. You have clearly gone back on your word. Before we moved in we asked you if you would be cleaning the windows and you said you would. When we moved in there was still paint overspray on all the windows and stickers on the eyebrow windows so we hired a professional to clean the windows. Had you cleaned them as you said you would there would have been no need for this expense. Our adjustment for the towel bar credit is the amount you originally told us you would allow when we discussed providing our own. You have clearly gone back on your word. Our adjustment for the garage ladder is based on the fact that you agreed to provide one and you have not. You have clearly gone back on your word. We have not purchased a ladder but a credit for an estimated cost seems appropriate. Our adjustment for re-installing the closet shelves is based on the cost of materials ($30.98) plus two hours of our own time. Had the shelves been properly installed per the manufacturer's system there would have been no need for this time and expense. We thought we would make the repairs ourselves rather than bothering you with it. Clearly you are not willing to make this minor adjustment to our bill. Again, our position has not changed nor has the date been extended from that stated in our February 3rd letter.
