Members present : Diane Erholm, John Curtis , George Mehler Staff present : Edwin Frank Minutes of February 3 , 1994 meeting were approved/passed (Curtis/Erholm) . Clumpner Variance (618 Haddon Rd. ) Mr . Clumpner reviewed this request for rear-yard setback variance from 20 feet to 5 feet to construct a garage/workshop . Mr . Clumpner explained that , several years ago , he had drawn up a plot plan for his proposed residence and garage/workshop on the over one acre property in the RM Zone assuming a required 5-foot rear-yard setback from an adjacent community greenbelt area - a City Inspector confirmed this setback requirement . Now, with residence construction completed, Mr . Clumpner sought a permit to build the garage/workshop but was advised of a 20-foot rear-yard setback requirement ; his understanding for this setback change was that the area has recently been rezoned Rural . He indicated that to locate the building with setback compliance would necessitate the undesirable removal of several large trees . He stated that the proposed garage/workshop will be 1000 sq . ft . area and 16 feet high - the maximum size accessory building allowed under the Ordinance Mr . frank acknowledged that the initially assumed 5-foot rear-yard setback was erroneous , the standard 20-foot setback requirement applied . There were no objections/comments from City Staff and adjacent property owners . A motion to grant the variance request was made (Curtis/Erholm) and approved with two ayes (Curtis , Erholm) , one nay (Mehler) . The majority reasoned the adjacent greenbelt area would mitigate building impact on neighboring properties . Mr . Mehler felt the applicant did not demonstrate hardship , regardless of erroneous City advice , in that the large building site could easily accommodate the proposed building within setback requirements ; also , the large garage/workshop would be an imposing structure should the greenbelt area be developed into a community park . Hernandez Variance (5805 Sunset Ave . ) Mr . Hernandez reviewed this request for front-yard setback variance from 20 feet to 6 feet to construct a two-car garage with access to Sunset Avenue . Mr . Hernandez had been granted a variance for a similar request to an 8-foot setback in November 1991 but did not proceed with the project . 2 . Mr . Hernandez explained that his 30-year old residence pre-existed Skyline , and was incorporated into the Skyline plat on a pie-shaped lot in a cul-de- sac . His house fronts Sunset Avenue with a 17-foot front setback, whereas the adjacent houses front the cul-de-sac ; a garage with access from the cul-de-sac would compromise the internal layout of his present residence . The proposed garage could be set further away from Sunset Avenue , but this positioning would necessitate unsafe vehicle backing directly into Sunset Avenue as well as require removal of two large trees and encroach the 5-foot side-yard setback . The proposed positioning avoids these disadvantages . Mr . & Mrs . Blancke , adjacent property owners , spoke to a memo they had submitted outlining objections to the variance request , including adverse impact on their property and the likelihood that the garage would really serve as additional building space for Mr . Hernandez ' s business (which the Blanckes claim uses potentially dangerous oxygen generation equipment and functions without proper safety and business authorizations ) . The Blanckes did not object to the 1991 variance hearing basis verbal conditions agreed to by Mr . Hernandez and they were new to the area . However , basis neighborhood exposure over the years , they now object to the variance . There were no comments/objections from City Staff and other property owners A motion to deny the variance request was made (Curtis/Erholm) and passed with all ayes . The Board felt that the hardship justification propounded by the applicant did not outweigh the adverse impact the proposed project location would have on the neighborhood . Meeting adjourned at 7 :45PM. Respectfully submitted , George e r 1(3-5 Underground Utility Ordinance Discussion Mr . Dave Ford reviewed the provisions of this Ordinance and explained the criteria of interpretation used by City Staff in applying the Ordinance . In 1975 , following enactment of the Ordinance , he sought help from Utility Companies in defining more explicitly gray areas in the Code (Puget Power responded) , but areas are still subject to controversial interpretation . i He suggested , and the Board agreed , that it is timely for him to solicit once again Utility Companies for assistance in defining provisions in the Code ; and possibly arrange a study session for Staff and the Board with Utility Company representatives .
