Ate- Attat - Regular Meeting Anacortes Board of Adjustment July 17, 1980 Chairman Norwood Young called the meeting to order at 7:30 P.M. Members Present: Norwood Young, Ruth Horn, Bob Hogg, George Mehler, Bill Morningred City Staff: Ray Iversen Minutes of Previous Meeting - Mr. Morningred made at motion to approve the minutes of the meeting of May 1, 1980 as if read. Mrs. Horn seconded the Motion. Vote: Ayes - Horn, Young, Mehler, Morningred, Hogg. Motion Carried. Vaux Variance Mr. Young then stated the first item to be considered was a request by Mr. Bill Vaux to allow construction of a small cantilevered deck into the rear yard set- backs at Lot 44, Division 2, Skyline. Mr. Iversen informed the Board that there were no objections received from City staff, although Mr. Jim Pemberton, Engineering Supervisor, commented if requests of this nature continue to be made then possibly • a modification to the Zoning Code should be looked at. Mr. Vaux addressed the Commission stating that if he were to comply with the setback requirements then it would be necessary to remove a large fir tree from the rear yard. After brief consideration, Mr. Hogg made a motion that the variance be granted t permitting Mr. Vaux to build his deck within 15 feet of the back property line in order to save the tree. Mr. Mehler seconded the motion. Vote: Ayes - Young, Mehler, Morningred,Hogg, Horn. Motion carried. Mr. Mehler commented that the would be considered under special conditions unique to the area. O'Donnell Variance Mr. Young stated the next request was that of Mr. & Mrs. Daniel O'Donnell to allow construction of a ten foot deck to encroach approximately 3 feet into the 20 foot setback off of Doon Way at Lot 47, Skyline Division 8. Mr. Iversen stated no objections had been received from City staff, and no objections had been received from abutting property owners. Mr. Morningred asked if Mr. O'Donnell had planned to build a deck when he purchased the home, and Mr. O'Donnell stated he had planned to and had been assured by the realtor who sold him the home that he would be able to do this. He further stated he had no specific design in mind and had looked around the area and decided on something similar to the homes in the same vicinity. Mr. Hogg commented that it appeared Doon Way would not be widened, therefore, this request would not interfere with any plans to widen the street. Mr. Iversen also explained that decks of this nature had been allowed under the previous code, and there were probably home there now with decks encroaching into the setback area. Mr. O'Donnell stated he had no plans to cover the deck. Mr. Mehler made a motion that the three foot variance as requested be granted. Mr. Morningred seconded the motion. Vote: Ayes - Mehler, Morningred, Hogg,- Horn & Young. Motion carried. Dwight Smith Variance Mr. Young stated the last variance request was by Mr. Dwight J. Smith to extend the corner of the garage and one corner of the home past the 10 foot setabck on the East property line at Lot 1, Division 13, Skyline. Mr. Iversen stated he had received no objections from City staff, although Mr. Mansfield did comment Page 2 it that it did not appear the requirements of the Zoning Code regarding variances were met; that the hardship must be peculiar to the land in, question and must not have been created by applicant. Mr. Young commented that this request again dealt with destroying trees, and it appeared trees needed to be saved in the area. There were two items of correspondence received by Mr. Smith from the abutting property owners stating they had no objections to this variance request. Mr. Hogg asked if Mr. Neil Danard, an abutting property owner, would also be requesting a variance, and Mr. Smith stated he would not. Mr. Smith also commented that his plans had been approved by the Skyline Architectural Committee. In answer to Mr. Hogg's question, Mr. Smith stated that setback on the west side of the property would comply with the Code, which would be a 5 foot setback. Mr. Mehler commented that the shape of the property is certainly a "unique condition". Mr. Morningred made a motion that,due to the short distance on a peculiar shaped lot, this variance be granted as requested. Motion seconded by Mr. Hogg. Vote: Ayes - Mehler, Morningred, Hogg, Horn & Young. It was further commented that this request was granted because of the peculiar conditions of the building F lot involved and to save some trees.
