Anacortes Board of Adjustment Meeting - October 20, 1977
Meeting called to order at 7:35 P.M. by Chairman Norwood Young =
Members present: Norwood Young, Bill Morningred and Helen Vincent
Ray Iversen was present representing City staff.
A request by Mr. Tom Colson for a second variance to set back requirement
of 14 feet to 9 feet 6 inches in rear yard setback of a 20 foot long sundeck
at 5522 Sugarloaf Drive was read by Mr. Norwood Young.
Mr. Iversen stated the the City staff was notified of this second variance
request and the Engineering Dept. would request that if variance is granted,
a stipulation is made that the bank be protected in a manner set forth by the
Engineering Dept.
Mr. Colson stated that he had discussed this matter with Dave Ford, Director
of Public Works, and he planned to put in a retaining wall as soon as he
could.
Mr. Bill Wildes, from the audience, of 5516 Sunset, stated that he wished
the variance to be denied for several reasons, i .e. he did not want a
presidence set of 71/2 feet from City line for the future development of
building sites in that area; he felt that there should be room left for
widening of the street; there was deliberate defiance of the ordiance;
structure could be altered so as not to require, a variance; there was a
deliberate attempt to circumvent the law. Mr. Wildes requested that this
variance be denied and the building be made to comply with the law.
Further discussion was held by the members of the board and Mr. Colson spoke
on his behalf.
Mr. & Mrs. Bart Betts, from the audience, spoke on their opposition to this a,
variance.
Mr. Morningred moved that the variance not be granted. Motion seconded.
Vote: Morningred - Aye; Vincent - Nay, Young - Nay. Motion failed.
Motion made by Helen Vincent that the variance be granted with a 6 month time .
limit to construct a retaining wall which will have to meet the approval of s.
the Engineering Department. Motion seconded. 1''
Vote: Vincent,- Aye, Young - Aye, Morningred - Nay. Motion carried.
