According to Anacortes' zoning code Chapter 14.04.16.060A (copy attached), the required
setbacks for the garage construction in progress are 15 feet from the street right-of-way line and
10 feet from adjacent property lines. While Skagit County Resolution 16210 allows for an
administrative variance process, the County's updated zoning code does not provide for such a
provision. Thus, I have enclosed a general information sheet, a copy of the County's Level II
variance application and fee schedule (note: Critical areas fees were paid with the Building
Permit application) along with some staff contacts. Please give us a call if you have questions
about the application or review process. The variance must be approved before the building
project can continue.
Once the variance is approved, a revised site plan indicating the actual setbacks (consistent with
the variance request) will need to be submitted and as requested, the property line will need to be
outlined in string before calling for reinspection.

AN INTERIM ORDINANCE IMPLEMENTING THE CITY OF ANACORTES DEVELOPMENT
STANDARDS WITHIN THE URBAN GROWTH AREA.
WHEREAS, RCW 39.34.030(2) authorizes joint cooperative agreements between two or
more public agencies; and
WHEREAS, the 1997 Skagit County Comprehensive Plan (comprehensive Plan) took
effect June 1, 1997; and
WHEREAS, the Comprehensive Plan states "for the Cities and the Towns to meet their
growth management and locally adopted comprehensive plan goals, the County needs to ensure
that it does not permit activity which would be inconsistent with their future plans". (Object #3
of the Skagit County Comprehensive Plan states that" Within the designated urban growth areas
the county shall coordinate with the respective cities or entities delivering, or who are anticipated
to deliver, urban public facilities and services to insure that growth and development are timed,
phased and consistent with the provision of adequate urban level facilities and services." Object
#4 states that" Designated Urban Growth Areas of municipalities, outside of municipal corporate
limits, should be subject to joint municipal County planning."); and
WHEREAS, an Interlocal Agreement was executed between the City of Anacortes and
County on June 25, 1996 regarding the implementation of city zoning, subdivision and street
design development standards within the Anacortes Urban Growth Area; and
WHEREAS, the Interlocal Agreement states that "Skagit County will take measures
necessary to apply and enforce the City's zoning and subdivision standards within any area
included within the City's final urban growth area, except that the County will retain its authority
to approve administrative variances to conditionally approve expansion of non-conforming uses
and structures and to approve short plats of 4 lots or lcsc with appropriate modifications
necessary under County Comprehensive Plan Policy 3.2 (Chapter 7). Further provided the short
plats have reserved rights-of-ways for future lots on the property and connections to the City or
regional street plan for the area. It is also understood that review procedures under each of the
standards will be modified to conform to existing County review procedures."; and
WHEREAS, the Interlocal Agreement states that "Skagit County will take measures
necessary to apply and enforce the City's street design standards within any area included within
the City's final urban growth area. It is intended that civil engineering plan review and
inspections for streets and utilities will be conducted by each city's staff and coordinated and
approved with the County Engineer. Plan review and inspection fccs may only be assessed by the
reviewing agency. No duplicate or double fees may be charged."; and
WHEREAS, the County is in the process of developing and reviewing a new
development code to implement the provisions of the Comprehensive Plan which encourages
interlocal agreements with each City; and
WHEREAS, the County expects to complete its review and adoption of the new
development codes within the next six months; and
WHEREAS, the current City and County standards are inconsistent; and
WHEREAS, the County recognizes the hardship on property owners whose use of their
lands may be restricted without the adoption of standards within Urban Growth Areas ; and

WHEREAS, the Countyis desirous of implementing the Interlocal
p g terioca Agreement and the
provisions of the 1997 Comprehensive Plan; and
WHEREAS, RCW 36.70A.390 specifically authorizes adoption of an interim ordinance
where deemed appropriate to further the goals of GMA; and
WHEREAS,the County shall hold a Public Hearing within sixty (60) days of the adoption
of this Interim Ordinance; and
WHEREAS, the City of Anacortes completed environmental review and held Public
Hearings on the adoption of their implementing codes; and
WHEREAS, the County completed environmental review of the Comprehensive Plan
included consideration of the adoption of the City's zoning map within the Urban Growth Area;
and
WHERAS, the City of Anacortes conducted SEPA review in connection with its adoption
of the zoning, subdivision and street improvement standards in its codes es as further described
below; and
-- WHEREAS, pursuant to WAC 197-11-600(3), the same proposal does not require
additional environmental review;
NOW,THEREFORE, Skagit County adopts the City of Anacortes zoning,subdivision and street
improvement standards as follows: Ordinance Nos. #2453, #2454, #2455,Anacortes City Codes
16.04,16.08, 16.12, 16.20, 16.24, 16.26, 16.28, 16.30, 16.32, 16.40, 17.06, 17.12, 17.14, 17.16,
17.19, 17.40, 17.46, 17.48, 17.49, 17.50, 17.52, 17.54, 17.56, 17.58, 17.60, 17.64, 17.67 and
Anacortes City Code Sections 15.20.010 through 15.20.080; and such ordinances, chapters and
sections shall apply only to those areas shown in exhibit B, (attached hereto and incorporated by
reference), also referenced as the Anacortes Urban Growth Area Zoning Map; and Skagit County
codes, ordinances, chapters and sections shall not apply in those areas shown in exhibit B,
except for Chapter 14.06, the Critical Area Ordinance, and all exceptions made within the
Interlocal Agreement Resolution #16210 adopted June 25 1996, also allowing the ability to enter
into a Developer's Agreement as a vehic of flexibility to ensure concurrency which shall
supersede any other codes.

RESOLUTION NO.
A RESOLUTION SETTING FORTH THE INTERLOCAL AGREEMENT BETWEEN
SKAGIT COUNTY AND THE CITY OF ANACORTES
ON ADOPTION AND IMPLEMENTATION OF
THE CITY OF ANACORTES URBAN GROWTH AREA
WHEREAS, the Joint Planning Framework Agreement governing the development and
amendment of the Countywide Planning Policies establishes that the implementation of urban growth
areas is to be handled by joint action of cities/towns in Skagit County and Skagit County;
WHEREAS, pursuant to the Growth Management Act the cities/towns have proposed urban
growth area boundaries and Skagit County is moving towards agreement with cities and towns relative to
designation of specific urban growth area boundaries for each;
WHEREAS, the Countywide Planning Policies call for the development and adoption of Joint
Plans to guide the character of future development within the urban growth area of each city/town;
WHEREAS, these Joint Plans are to be adopted by a city and by Skagit County as a part of their
Comprehensive Plans and these Joint Plans must include Capital Facilities and financing components
that extend to cover transportation projects of regional importance,
WHEREAS, the Growth Management Act requires Skagit County to enact development
standards and optional impact fee schedules consistent with its Comprehensive Plan;
WHEREAS, Countywide Regional Planning Policy 1.7 mandates that "Development within
established urban growth boundaries shall conform to urban development standards";
WHEREAS, Skagit County and the cities/towns of Anacortes, Burlington, LaConner, Mount
Vernon, and Sedro-Woolley will each adopt development standards and impact fees, consistent with their
respective Comprehensive Plan, intended to implement the Joint Plan applicable to their respective cities
and their Urban Growth Areas; and
WHEREAS, Skagit County and the five cities/towns find that the adoption of such standards
and impact fees by the County will contribute to the achievement of the long term objectives that each
city has for the development of its Urban Growth Area,
NOW, THEREFORE, Skagit County and the City do hereby agree that
Section 1: Within the Urban Growth Area Skagit County will adopt the City's zoning and
subdivision standards, except that the County will retain its authority to approve administrative
variances, to approve special use permits, to conditionally approve expansion of non-conforming uses
,and structures, and to approve short plats of 4 lots or less with appropriate modifications necessary

Section 2: Skagit County will adopt a Forest Practices Ordinance that applies a single
approach throughout the Urban Growth Area. This approach is intended to support forest management
practices that retain and integrate significant stands of trees into the layout and design of developments
within the Urban Growth Area.
Section 3: Skagit County will adopt the City's street design standards. It is intended that
civil engineering plan review and inspections for streets and utilities will be conducted by each city's
staff under the direction of the County Engineer, with appropriate fees.
Section 4: Skagit County will adopt the City's site plan standards only for industrial and
commercial projects.
Section 5: Skagit County and the City agree that it is desirable to annex properties prior to
securing development approvals.

Section 6: The City will provide the support necessary for the preparation of a County
version of the City's development standards, including complete copies of development regulations and
fees.
Section 7: The City will provide ongoing technical assistance and support to County staff
responsible for implementing its development standards in its respective Urban Growth Area; this shall
include summaries and handouts for the public and participation in preapplication reviews.
Section 8: The City agrees that the city zoning, subdivision, and other standards adopted
hereinin reliance upon this agreement are the complete requirement for developments within the Urban
Growth Area; the City will not apply additional development standards, although the City does not
control other utilities such as the PUD. The County agrees not to oppose City annexations within the
Urban Growth Area.
Section 9: Skagit County and the City agree to develop a process for the joint consideration
and adoption of future code amendments affecting the Urban Growth Area. The parties further agree to
establish a process for resolving disagreements over implementation of this Agreement.
Section 10: The City will reimburse the County upon satisfactory completion of that portion
of the work identified in the attached scope of work (Attachment A) undertaken in the City's urban
growth area in an amount not to exceed $3,I00. The County will manage the contract implementing the
attached scope of work through a steering committee comprised of one representative from each
financial participant.
Section 11: The City agrees to the following relative to revenue sharing from the urban
groul•th area both before and after annexation with proper allowances for the City's costs of extending
urban facilities and services described as follows

South March Point/Highway 20 Annexation Area(as shown on Attachment B)
Beginning June 1, 1996, the County will share sales tax revenue from Frontier Ford and Jerry
III' Smith Chevrolet with the City on a 50-50 basis. Upon annexation, the City will share sales tax revenue
from Frontier Ford and Jerry Smith Chevrolet with the County on a 50-50 basis for the same period of
time as the County shared this revenue with the City. No County road project reimbursement pursuant to
3 below will be involved with the South March Point/Highway 20 Annexation. However, sales tax
revenue from sources other than Frontier Ford and Jerry Smith Chevrolet shall be shared as described in
(I) and (2) below with the County providing police services through separate Interlocal Agreement for
two years from annexation.
Balance of the City's Urban Growth Area
Outside the South March Point/Highway 20 Annexation Area
I. There would be no revenue sharing if the sales tax lost to the County through a particular
annexation is less than $50,000 a year, after excluding sales tax generated to the County from businesses
locating in the UGA in the two years prior to the effective date of annexation. The calculation of sales
tax lost shall recognize that after annexation the state law directs 15% of the sales tax revenue generated
from the annexed area to the County.
2. Using the same exclusions and calculations set forth in (I) above if the sales tax lost to
the County through a particular annexation exceeds $50,000 a year sales tax revenue from the particular
annexation area, the City will share revenue with the County on a monthly basis from the beginning of
the calendar year after the effective date of the annexation on a straight-line declining basis as follows:

$50,000-$200,000 4 years (80-60-40-20)
$200,000-$500,000 9 years (90-80....20-I0)
greater than $500,000 19 years (95-90....10-5)
3. Upon annexation of a particular area, the City will reimburse the County on a straight-
line declining basis for projects included in joint road and utilities plans costing over $500,000 in County
road funds that are constructed within the annexation area. Reimbursement would be 80% for
annexations occurring in the year following road project completion, 60% in year two, 40% in year three,
and 20% in year four. Projects completed more than four years prior to an annexation would not require
reimbursement.
Section 12: Skagit County and the City agree to use the following procedure for SEPA
Review: (1) Skagit County be designated the SEPA Lead Agency for all application/projects within the
Interim and Final UGAs, (2) upon receiving an application requiring a SEPA Checklist, the SEPA lead
agency circulates this application to affected jurisdictions for input relative to the completeness
determination using the same time periods and procedures the lead agency uses internally, (3) affected
jurisdictions shall use the completeness comment period(s) to submit substantive comments, (4) all
SEPA determinations within a City/Town UGA shall be subject to a 15-day comment period and affected
jurisdictions may use this to make substantive comments, and (5) all SEPA appeals shall follow Skagit
County procedures

Section 13 : The County's Critical Areas Ordinance shall apply
in Urban Growth Areas until they are annexed.
Section 14 : Skagit County and the City shall enter into an
indemnification agreement to address liability issues.
Section 15 : The effective date of this Agreement shall be June
1, 1996.

SCOPE OF WORK
Henderson, Young & Company (HYCo) will provide the following services for
Skagit County and selected cities In the County.
1 . Skagit County Capital Facilities Plan
HYCo will assist the County in completing the Functional Capital Facilities Plan with
Financing Plan, and Capital Facilities Element of the Comprehensive Plan to
,comply with the requirementsof RCW 36.70A.070(3) and the County's County-
wide Planning Policies,
This task applies to County-owned public facilities: roads, bridges, ferry, solid
waste, parks, recreation, fair, senior center, corrections, courthouse, and other
County administrative and maintenance facilities,
