The issue is a request for two variances. 1) to increase the height from 2.6" to 6 feet of a solid fence that has been permitted by City Encroachment Agreement in the Longview Avenue right-of-way south of the McMakin property and 2) reduce the side-yard setback along Longview Avenue from 10 feet to 3 feet to construct a garage in a two-story addition to the McMakin residence. Mr McMakin stated that he had discussed the variance requests with neighbors Mrs Stanton and Mr Pupkiwicz who had urged denial of the requests at the December 2 meeting. He felt that they had misunderstood what the variance requests encompassed -there was no further testimony Indicated from these neighbors. Mr McMakin expressed concern that wording in the Encroachment Agreement he had received for the fence indicated a "hold harmless" clause for City liability So he felt that a 6-foot fence was needed to limit the potential for personal liability. He stated that Longview Avenue is a dead-end street with few houses so the impact of the 6-foot fence and two-story addition on the neighborhood would be minimal He also repeated the need for the garage addition because the existing carport was poorly designed and does not meet his family needs. The Board discussed the 'hold harmless" clause Mr McMakin referenced and concluded that, since the City Encroachment Agreement was for a fence complying with the restrictions in the Zoning Ordinance (i.e. a 4'6" open fence), Mr McMakin's liability is no greater than that for any property owner in a liability issue. The Board decided to act on the two variance requests separately. 1. A motion to deny the request for fence height variance was made (Wilson/Curtis) and passed with all ayes. Members present Brad Snyder, John Curtis, Ken Wilson, George Mehler Staff present: Ed Frank Minutes of the November 4, 1999 meeting were approved Ball Variance (919 35th Street) Mr. Bail reviewed this request for variance in the sign provision of a home occupation conditional use permit that restricts an advertising sign to two square feet attached to the building Mr. Ball proposes to install a custom-made free-standing sign, 16 sq .ft in area, in the front yard of his home occupied mortgage business The sign meets all the requirements for a permited business in a residential zone. Mr. Ball contended that the sign he installed, as allowed in the conditional use permit, has essentially been invisible to prospective clients. He explained that his home is located at the end of a dead-end street and immediately adjacent to Commercial Avenue; dense conifers screen his home from Commercial Avenue traffic The proposed sign and location will greatly enhance visibility on 35th Street and from Commercial Avenue He questioned the reasoning for the more restrictive sign requirement for a home occupancy business. Paradoxically; there is a large City sign located in the Commercial Avenue right-of-way adjacent to his property. City Staff. Mr Mansfield addressed the intent of the sign provisions for a home-occupancy business. there were no other comments/objections Mss. Stuart and King, neighbors, in written correspondence, objected to the sign variance. Mr Harju, James Signs. sign fabricator; mentioned the confusion created by the fine-line distinction between signs allowed for permitted and home-occupancy businesses Mrs. Ball noted the difficulty now experienced by clients looking for their business because of the poor signage A motion was made (Mehler/Curtis) and passed 'with three ayes (Curtis; Wilson, Mahler); one nay (Snyder) to grant the variance as requested. The Board noted that Mr. Bali demonstrates the hardship he has experienced in advertising his business, also, experience has shown that, in general, custom-built signs of this nature do not adversely affect a neighborhood. McMakin Variance (3825 S Avenue) Mr. Snyder stepped down from the Board for this request. Mr. McMakin reviewed this request for two variances- 1) to increase the height of a side-yard solid fence on the south side of his property abutting a Longview Avenue from 2'6" to 6 feet and 2) reduce the side-yard setback along Longview Avenue from 10 feet to 3 feet to construct a garage in a two-story addition to his (residence Mr. McMakin used a series of projected slides to explain his request for these variances. Fence variance —the topography of this area necessitated a steep rock wall constructed along the south edge of the McMakin property for grading needed to build Longview Avenue, a large portion of the McMakin property is over ten feet below Longview Avenue This has created a severe safety hazard for pedestrian and vehicular traffic along Longview The City, recognizing this hazardous situation, granted Mr. McMakin an encroachment agreement so that he could construct a fence in the street right-of-way above this precipice He has proposed to construct the 6-foot solid fence for maximum safety and also to provide privacy from the street for a patio area below The fence will end far enough back from the S Avenue — Longview Avenue intersection to avoid obstructing traffic visibility / Side-yard variance — Mr. McMakin explained that, when he purchased the house two years ago, he knew the existing car port did not meet his needs and he planned to build a two-car garage on the south side of the house. However, in applying for a building permit, he discovered that the south-side setback shown on the site plan he had received was in error and the planned garage would encroach the required setback. The family also discovered that an additional bedroom is desirable so the garage proposal includes a two-story extension that ihas a second floor bedroom with another room below City Staff comments: in granting the encroachment agreement, Staff recommended the fence conform to a 4'6" open fence permitted in the Ordinance. In written comments, Mr. Brand (not a neighbor) supported the variance requests, Mr. Stanton (neighbor) advocated variance denial. In spoken comments, Mr. Pupkiwicz, Mrs. Stanton, and Mrs. Wheeler advocated denial of the variances citing that the high fence and two-story addition were incongruous with the neighborhood. Mrs. McMakin cited safety and privacy needs for the fence variance. A motion to continue the meeting to a site visit December 16 at 3 OOPiv1 and Board chambers immediately following was made (Mehler/Curtis) and passed with all ayes The Board telt a visit necessary to understand the concerns of the applicant as well as the neighbors. Edwin Frank Minutes of the May 6, 1999 meeting were approved Hawkinqs Vacation (Alley transectinq Lot 22 Cranberry Heights) Mr. Hawkings, reviewed this Petition for Alley Vacation: the 16-foot undeveloped alley which transects Lot 22 of the recently platted Cranberry Heights development; this alley is the eastern segment of the platted alley between Block 1114 and formerly Block 1115 Northern Pacific Addition. Mr. Hawkings explained that, through oversight, this alley was not vacated during the Cranberry Heights replatting process and, without the vacation, Lot 22 can not be developed as a residential lot. Mr. Hawkings indicated that the alley rises very sharply through Lot 22 before its terminus at Kansas Avenue, essentially precluding future alley development for vehicular use. The western segment of the alley, now partially developed, may provide access to the rear of the remaining (Cranberry Heights) lots formerly in Block 1115 Northern Pacific Addition. City Staff comments: Mr. Harju noted potential reduction in fire accessibility; there are no utility conflicts. Mrs. Casey, West 8th Place, opposed the vacation basis traffic safety concerns Noting that Lot 22 is directly opposite West 8th Place entry onto Kansas Avenue, she argued that a driveway access at this location would be a traffic hazard. She also noted that there already was heavy vehicular traffic along Kansas Avenue and the additional driveway would make the situation even more dangerous. Board recommendation to Council moved (Mehler/Wilson) and passed with two ayes (Mehler, Wilson), one nay (Snyder): the City approve the requested alley vacation. The Board considered that topography of the area precluded intended use of the alley and that the traffic safety concern could be minimized by City Staff working with the developer in positioning Lot 22 driveway access to Kansas Avenue. Mr. Snyder felt the applicant did not present a case justifying the vacation. Kilgore/McKee Vacation (Portions V Avenue between 35th & 36th Streets) Mr. Frank reviewed this Petition for Street Vacation: the west 12-foot section of V Avenue adjacent to Lots 1 and 20 Block 30 Beales Maple Grove Addition (Kilgore) and the east 12-foot section of V Avenue extending from 35th Street to Highway 20 right-of-way, adjacent to acreage in SW1/4 NE1/4 Section 30 (McKee • Mr. McKee stated that platted 80-foot V Avenue, now a graveled lane to a residence, dead-ends shortly beyond 36th Street at Highway 20 so the road will never be developed beyond a limited accessway. The reason for vacation is basically to make better use of the adjacent properties rather than having an unused wide V Avenue right-of-way Mrs. Kilgore's lower property (Lots 1-3) is crowded on the west by a house built on the property line. Staff comments' there appears to be no conflict with utility lines: there is a question of access to acreage at the southeasterly end of V Avenue. Mr McKee is aware of this, in any event, an easement for access would be necessary across his property even without the vacation. Mrs. Anderson, nearby neighbor, wondered about potential impact on utility lines. The ouaru fedauned that both the applicants and the City (through revenue) would benefit from the street vacation which would have no impact on future development of V Avenue Demarest Variance (3915 R Avenue) Mr. Demarest, with a programmed slide presentation, reviewed this request for variance in solid fence height from 2'6; to 6 feet on a side-yard property line along Fidalgo Avenue He has already constructed this 6-foot fence, not on the property line, but actually encroaching into Fidalgo Avenue right-of-way some eight to ten feet. A 6-foot fence constructed with a 20-foot side-yard setback from Fidalgo Avenue would have met Zoning Ordinance requirement. Mr. Demarest explained the need for the fence in its present location as follows - to confine their three small children in the yard to protect them from traffic on busy Fidalgo Avenue and from marauding individuals possibly in the area, - to create a larger sized yard which is visible from inside the house, - to provide added privacy along busy Fidalgo Avenue; - to enhance the appearance of their large house. Mr. Demarest was somewhat compromised by a change in side-yard fence requirements in the Zoning Ordinance enacted late last year. He inquired about fence requirements last November (presumably before Ordinance change) which, at that time, permitted a 6-foot fencing on a side-yard property line but he did not begin construction until May 1 of this year. As the posts were set Mr i Gerald Osborn, a neighbor, noted the out-of-compliance and told Mr Demarest he must apply to the City for a variance and encroachment agreement. Mr Demarest did apply May 21, but none-the-less continued construction of the fence As for the street encroachment, Mr. Demarest stated that he 'was not aware of the property line location". Mr. Demarest submitted a number of completed forms signed by neighbors supporting the fence as constructed; he also submitted a supporting petition signed by a number of people attending a garage sale recently held at his residence. Mr. Strom and Mrs. Jones mentioned that the fence enhances the appearance of the property; Mr Hoxie supported the fence but expressed concern about encroachment into Fidalgo Avenue right-of-way. In a letter to the Board, Mr. Osborn urged denial of the variance. City Staff comments: potential sight-distance problems may have teen created or vehicles ente^n i Fidalgo Avenue at the R Avenue intersection, are there underground utilities?, and a strong possibility exists that sidewalks will be constructed along Fidalgo Avenue as traffic volumes increase Mr. Frank commented that permits are not required for fences - primarily because land surveys are costly - but the City relies on the integrity of the public it is a property owner beware situation if the fence is found out of compliance. A motion to grant a variance for a 6-foot solid fence at the property line but strongly urging City Staff deny the encroachment into Fidalqo Avenue right-of-way was made (MehlerM/ilson) and passed with two ayes (Mehier, Wilson), one nay (Snyder). The majority reasoned that the higher fence on the property line can be a safety matter. but street encroachment is inappropriate. Mr Snyder felt the applicant aid not demonstrate hardship to justify variance approval. 3 McMakin Variance (3825 S Avenue) Mrs. McMakin reviewed this request for variance in solid fence height from 2'6" to 6 feet on a side-yard property line along S Avenue. The proposed fence will be constructed on an existing concrete retaining wall which averages 3 - 4 feet high Mrs. McMakin explained that her family is completing construction of a new home en a site specifically chosen to provide a large play area for their four children. However, to nave a level play area on sloping terrain, it was necessary to build the retaining wall and backfill the area. She stated that the scope of this project was discussed with the City Building Department last Fall, presumably including the proposed fencing. Accordingly, she claims her family was a victim of the side-yard fence change in the Zoning Ordinance enacted near the end of last year (see Demarest variance above). Mrs. McMakin sees the need for a 6-foot fence as a safety matter -to confine the children to avoid the risk of injury by passing traffic, particularly with the sloping location which could easily increase the risk of injury retrieving runaway balls and to reduce visibility and vulnerability from without the yard. City Staff comments: concern about the appearance in the neighborhood of a 10--foot wall (4-foot retaining wall plus 6-foot fence). The Board also expressed concern about the exceptionally high wall. Mrs. McMakin mentioned that she had discussed the project with neighbors with no adverse comments A motion to grant the variance as requested was made (SnyderiWilson) and passed with all ayes.
