Meeting called to order by Chairman pro-tem Gary Coatney at 7:05PM.

Mr. Measamer, for the applicant absent in an apparent maternity situation, reviewed this request for a front-
yard setback variance from 20 feet to 15 feet to cover the front entry to the applicant's home.
The applicant's petition for variance explained that the uncovered entryway to their older home opens directly
into the living room. The covered entry will obviate the problem of rain damage to carpeting, etc. from
entering rain and wet boots.
There were no City Staff comments/objections; the Development Review Committee had approved the
request. There was no input from neighbors.
A motion was made (Wilson/Mehler) and passed with all ayes to grant the requested front-yard setback
variance with the condition that the entry must not be enclosed with solid walls in the future. The Board noted
that the setback relief for the small entryway benefits the applicants' effort to improve their homestead with
minimum impact on the surrounding neighborhood.
City of Anacortes Vacation (portion of Burrows Street, et al, Anaco Beach Addition)
Mr. Barnett, City Engineering Staff, reviewed this petition for street vacation: that portion of Burrows Street
adjacent to Lots 69 and 70 and additionally, a small portion of two right-of-ways all in the Anaco Beach
Addition.
Mr. Barnett explained that intent of this vacation request is to improve the safety of the sweeping curve of the
roadway transition between Anaco Beach Road and Marine View Drive and also to provide easements for
better management of storm drainage in the upland properties. This is the Marine View Drive Safety Project.
Mr. Barnett stated that the City has worked out a satisfactory agreement with the property owner in the area
to swap the above undeveloped vacated right-of-ways for sections of his property adjacent to the Marine
View Drive curve and for a drainage easement on a portion of a previously vacated section of Marine View
Drive above the current roadway; a drainage easement in vacated Burrows Street will also be continued.
City Staff comments: a Statement of Purpose Memo from Mr. Davis, Engineering Staff was presented.
Mr. Patrick, resident Marine View Drive, stated that the area under consideration included Clyde River and an
extensive extension of wetland. He expressed concern about the impact of requested vacation on this
wetland. Mr. Barnett indicated that the Marine View Drive project, per se, will not impact the wetland above
the roadway; but any future development of the properties above Marine View Drive must address the
wetland issue.
Board recommendation to Council moved (Wilson/Mehler) and passed with all ayes: City approve the
requested street and right-of-ways vacation. The Board agreed that the Marine View Drive Safety Project and
providing for future storm drainage in the area justify the vacation.

i NOTICE IS HEREBY GIVEN that the Board of Adjustment will hold a Public Hearing the evening of
Thursday, August 7, 2002 at 7:00 p.m. in the Municipal Building Council Chambers, 6th and "Q"
Avenue. The purpose of the Public Hearing is to consider a variance request from Scott Baumann of
4122 R Avenue to reduce the front yard setback from 20 feet to 15 feet for the purpose of constructing a
roofed cover over the existing entry landing.
Anyone wishing to comment on the proposed variance request may do so at the above stated date,place

Petition Checklist
The Anacortes City Council is unwilling to vacate property unless
there is a very clear showing that the property will be of no use
to the City and, that there is a hardship need that would justify
the specific project request. If your proposal meets these
criteria, please submit the following attachments with your
Petition:
1. The City requires that two-thirds of the owners of property
abutting on a street/alley sign a petition for vacation even
if only a portion of the street/alley is in fact being
vacated.
2 .C✓ List of all property owners (and mailing addresses) within
300' of the street or alley to be vacated. These property
owners will be notified of the Board of Adjustment/City
/Council hearings.
3 .V Statement of Purpose, i.e. , if vacated how will the property
be used.
4. proof of ownership.
5.✓/Map showing area to be considered and surrounding property.
6. Filing fee of $200. 00.
Two hearings will be scheduled, one before the Board of Adjustment
and one before the City Council. The Board will hear testimony,
review staff reports and make a recommendation to the Council. The
City Council will conduct a Public Hearing, may adopt or reject the
Board's recommendation, hear testimony and will grant or deny the
Petition. If granted, the Council with authority by Ordinance
will vacate such street or alley provided the owners of property
abutting the street or alley compensate the City in an amount that
does not exceed one-half the appraised value of the area so
vacated. The City may elect to be compensated in an amount that
does not exceed one-half the assessed value of the area so vacated.

Section 17.36.010 Purpose.
The objective and intent of this district is to maintain and create an environment which meets the
standards for single-family residential development, by restricting uses within the district, and by
requiring a minimum lot size and maximum density. (Ord. 2316 (part), 1994)
Section 17.36.020 Permitted uses.
A. Single-family dwellings;
B. Necessary public uses,parks, and playgrounds. (Ord. 2316 (part), 1994)
Section 17.36.030 Permitted accessory uses.
Garage, swimming pool,tool house and other uses customarily incidental to the permitted uses. (Ord.
2316(part), 1994)
Section 17.36.040 Conditional uses.
Conditional uses in an R2 district shall be as follows:
A. Duplexes, golf/country club, churches, home occupations, nurseries and gardens, schools,
preschool facilities. Neighborhood grocery stores of limited scale, not to exceed one thousand two
hundred square feet of retail sales floor space and three thousand two hundred square feet total building
floor space. No such grocery uses shall be allowed closer than one-quarter mile radius of an existing
grocery store;
B. Landmark building with any approved use, generally not permitted within the area' s land use
classification,which occurs or will occur in a landmark building recognized as such by the city council;
C. Bed-and-breakfast establishments;
D. Commercial parking;
E. Single-family residences on six thousand square foot lots in situations where no more and no less
than four, adjacent, previously platted, three thousand-square-foot lots were in separate ownership and
not of continuous frontage with other lots in the same ownership, and of record as of April 19, 1978, so
as to make two six-thousand-square-foot parcels with a single-family residence built on each of the six-
thousand-square-foot parcels;

F. Assisted care living facilities and congregate care facilities;
G. Public parking;
H. Private parking;

Section 17.36.050 Minimum lot size.
Minimum lot size in an R2 district shall be as follows:
A single-family house shall be allowed on any lot of record as specified in Section 17.60.020. Lot
size of parcels of land within the RL district which are subdivided after April 19, 1978, shall be no less
than seven thousand five hundred square feet. Minimum lot size shall be nine thousand square feet for a
duplex. (Ord. 2316 (part), 1994)
Section 17.36.060 Minimum setback requirements.
Minimum setback requirements in an R2 district shall be as follows:
A. Front yard,minimum depth twenty feet from property line;
B. Interior side, ten feet on one side, five feet on other;
C. Side yard on a flanking street, ten feet from property line. If street is a designated arterial, twenty
feet;
D. Rear yard, twenty feet minimum.
1. Where the rear yard does not abut a platted alley,no portion of the primary structure shall extend
into the setback area, regardless of the use of that primary structure. A detached accessory structure no
larger than one hundred forty-four square feet and twelve feet in height may be placed in a rear yard, or
in the rear twenty-five feet of an interior side yard, provided that it is set back a minimum of five feet
from the rear property line, and three feet from any side property line.
2. Where the rear yard abuts a platted alley, a detached accessory structure, or that portion of the
primary structure used as an accessory structure, may be built in a rear yard up to the alley property line,
provided that it is set back a minimum of three feet from any side property line, and is no larger than one
thousand square feet and no more than sixteen feet in height. If the accessory structure is a garage, built
so that vehicles enter the garage from the alley in a direction substantially perpendicular to the alley, the
garage doors shall be set back a minimum of ten feet from the alley property line to allow adequate
turning distance for vehicles.
3. The lot coverage of any accessory structure exceeding one hundred forty-four square feet shall
count as part of the percentage of lot coverage permitted in this zone. (Ord. 2482 Att. A § 13, 1999; Ord.

Section 17.36.070 Maximum density.
Density for the project applied for shall not exceed four dwelling units per gross acre. (Ord. 2592
Att. A § 3 (part): Ord. 2316(part), 1994)
Section 17.36.080 Maximum land coverage.
Maximum land coverage by buildings shall be thirty-five percent. (Ord. 2316 (part), 1994)

Section 17.36.100 Off-street parking requirements.
There shall be at least two off-street parking spaces per dwelling unit. (Ord. 2316 (part), 1994)
Section 17.36.110 Street improvements.
Thirty feet of frontage is required on an improved public street. If a private street is used, a
conditional use permit is required. Where city ordinance permits development fronting on an unpaved
city street, no building permit shall be issued without a deed restriction being recorded that stipulates that
the property owner will not oppose an L.I.D. for street and utility improvements.
