A. FINDINGS OF FACT
1. Request
On May 14, 2012 James W. Stevens submitted an application to conduct a physicians referral
service to assist Washington State residents obtain medical cannabis recommendations under
state law within an existing single family residence located at 4119 R Avenue. The property is
currently zoned R1.
2. Consistency with AMC Sections 17.10.120 & 17.10.130
The proposal has been reviewed for consistency with the regulations outlined in Anacortes
Municipal Code (AMC) Sections 17.10.120 — Home occupation permits and 17.10.130 —
Procedure for home occupation permits. As conditioned, the proposal will comply with the
applicable code provisions and requirements. A staff analysis describing compliance with
applicable regulations was completed and is available in the project file located at the Planning,
Community and Economic Development Department.
3. Consistency with 2010 Comprehensive Plan
The 2010 City of Anacortes Comprehensive Plan designates the project site as R1. The goals
and policies outlined in the Comprehensive Plan are intended to provide guidance for both public
and private decision makers in future growth and development of the City. Development goals
and policies pertinent to the request are as follows:
Housing/Residential Goals 1(f), 1(g)
B. CONCLUSIONS OF LAW
1. If approved as conditioned below, the development is consistent with the 2010
Comprehensive Plan and meets the requirements and intent of the Anacortes Municipal
Code.
C. DECISION
Based on the foregoing Findings of Fact and Conclusions of Law, the Zoning Administrator
APPROVES the application for a home occupation June 25, 2012, subject to the following
conditions:
1. The site including the interior of any building, may be subject to inspection by the City of
Anacortes Police Department upon notification;provided, that is condition in no way limits
the search methods that may be utilized in a criminal investigation.
2. Onsite dispensing or sale or barter of marijuana/cannabis products and/or paraphernalia
related thereto is prohibited.
3. One onsite client parking stall shall be identified on a site plan provided to the planning
department for review and approva prior to commencement of operations and maintained
thereafter.
4. If the occupation is at any time deemed by the Director or the Police Chief to cause
detrimental effects to the surrounding neighborhood, the permit may, at the sole discretion of

the City, be revoked, or additional conditions applied to mitigate impacts in accordance with
17.10.130.E AMC.

Appeals: Section 17.10.130 AMC—Any aggrieved party shall have five working days from date
of the decision to appeal the decision of the administrator to the city council. The appeal shall be
in writing and is to be filed with the city clerk.
