STIPULATION TO THE SHORELINE PERMIT
I. Street Access Improvements
A. Market Street - 9th to 6th. Adequate right-of-way shall be dedicated and the
street shall be improved to City standards with curb, gutter and sidewalks.
B. 9th Street, "Q" Avenue to Market. Street to be improved to City standards
comparable to Market Street.
C. 6th Street between "S" and "T". To be improved to City standards comparable
to the above two streets.
D. "T" Avenue between 6th and 4th, To be improved to City standards comparable
with the above improvements.
E. The Port shall agree to the improvement of "Q" Avenue utilizing the LID method.
F. There should be installed a sidewalk around the north end of the boat basin with
a landscaped strip for its full length.
II. Parking
A. There shall be provided one (1) parking stall for each boat slip in an amount
to satisfy the parking requirements for the existing as well as the proposed
marina expansion.
B. Parking shall be developed to City standards which includes paving, drainage
and striping.
C. Parking areas shall be landscaped pursuant to standards included in the City's
proposed parking lot landscaping standards.
D. Parking lot should be lighted.
III. Street Lighting
Adequate street lighting shall be provided pursuant to City standards.
IV. Water
A. Water system improvements will be required to service both existing and proposed
marina expansion in order to provide domestic as well as required fire flows.
Size, design and location of the improvements shall be reviewed and approved
by the City. Improvements shall include all backflow prevention devices, hydrants,
etc. as required.

V. Sanitary Sewers
A. Adequate sanitary and storm sewers shall be constructed to service the area
in accordance with City design and location standards. The proposed pump-
out facility shall be provided with proper holding and dilution tanks according
to City specifications.
B. A restroom facility should be provided to service the northerly boat basin and
parking area.
VI. Sanitation
Sanitation containers shall be provided with proper concrete pads and sight-screening
in the pleasure boat-recreational areas. Locations of the containers to be reviewed
and approved by the City so that more efficient service may be provided.
VII. Landscaping
There should be developed and provided a landscaping plan for the marina subject
to the review and approval of the City.
VIII. Public Access
The Port will provde and dedicate 60' of shoreline with appropriate uplands and
access for the public access to the waterfront between the breakwater and the
eastern end of 15th Street extended. In return the City will exchange, on an
equal value basis, land that it owns along the southern boundary of the Port's
property.
IX. The City recognizes that the plans of the Port District may change during project
development and agrees to cooperate with the Port in modifying the conditions
hereinbefore set forth as the same are deemed appropriate to good planning and
development for the Community.

Thanks sincerely for your cooperation concerning occupancy
of boats in the new section of our marina. As we discussed,
our contractor is scheduled to have the water line installed
by April 15, 1984. However, it is probable that the complete
fire protection system will not be operational until a couple
of weeks after this date.
Since it is desirable for the Port to utilize the new floats
before activation of the system the Port of Anacortes agrees
to defend and to hold the City of Anacortes harmless from all
liability against loss or damage by fire relating to occupancy
of the new floats until such time as the fire protection system
is operational .
Pursuant to our conversation, boats will start to occupy the
new floats starting about April 15, 1984. This will give the
Port the opportunity of collecting moorage fees from the new
tenants effective May 1, 1984.
You are to be complimented on the agreeable manner in which
you handled this situation. It was very professional , but
still in a reasonable and practical manner. This will not
be forgotten and is much appreciated.

SUBJECT: Cap Sante Expansion Project - Parking Standards

Even though the Port of Anacortes has not provided complete dimensional imformation
on the parking spaces, please proceed to finalize and, if appropriate, approve their
drawings. Given the detailed planning the Port has undertaken, I am confident that
the parking spaces will be laid out appropriately.
On the matter of an overall parking plan for the boat basin, I agree that this is
required. However, Mr. Olson of Reid Middleton has indicated that submission of
such a plan is premature at this time. However, at some later stage in the expansion
project a complete plan will be forthcoming. Accordingly, the lack of such a plan
should not inhibit us processing their present expansion project.
In no way should this position be taken as setting a precedence for other development
projects. This Port project is unique in the comprehensive nature of its development
plan and scheduling.

8 . Clothes dryer shall be connected to a moisture duct directly to
the outside. In no case shall the duct terminate in an attic or under
a floor crawl space, or be assembled with a sheet metal screws .
9. All wood in contact with concrete or masonry shall be pressure
treated wood of any species, foundation grade cedar or redwood, all
marked or branded by an approved agency.
10. Sewer hookup charges will be as follows : $580 for the first 30
fixture units and $1. 25 for each additional unit thereafter. The
restroom facility has 71 fixture units which totals a sewer hookup
fee of $631.25. The laundry room facility has 8 fixture units so the
basic fee will be $580.00 ; for a grand total sewer hookup charge of
$1,211. 25.

11. The City of Anacortes Fire Department is going to require an
additional fire hydrant located southeast of the existing boat
storage building hooked into the 12" water main as marked onthe plans .
12. Heat loss calculations will have to be submitted on this building
N/A for heat system sizing. (Building is not to be heated) .
13 . All drain, waste and vent lines where applicable may be of ABS
plastic material .
14. This building is to be Type V - 1 hour construction throughout.
15 . All construction is subject to field inspections , corrections and
final approval by the Building Official. An approved set of plans
shall be kept on the job site at all times during construction.
16 . Fire extinguishers are to be provided, COA Fire Dept. to determine
size, type & location.

After discussions between Joe Baier and Mayor Rice, and between you, myself and
John Olson of Reid-Middleton, the following has been agreed:
1 ) Based on our review of the drawings submitted by Reid-Middleton, the City is
prepared to issue a building permit with the stipulation on the permit that
no occupancy will be permitted until a site plan has been reviewed and approved
by the City.
2) Mr. Olson informs me that this will allow bids to be let within the next
45 days and that we can expect to have a site plan submitted for our review
and approval within 60 days.
3). Once a site plan has been reviewed by the City occupancy of the moorage will
then be permitted prior to the completion of the upland improvements committed
to in the shoreline permit and the approved site plan.
If you have any questions about this process or would like further clarification,
please let me know.

RE: Plan Review Port Dock Proposal
Dear Mr. Baier,
The City staff has reviewed the plans for the docks and floats
with respect to cross connection control. We find that there are
numerous potentials for back siphonage and contamination of the
potable water system on the docks. We also find that we have
limited information with regard to metering of water services not
only to the docks but also to the proposed buildings at the site.
Our requirements to protect the City' s potable water system and
the docks potable water system are as follows :
1) to each dock head it will be required to install a 3 inch
reduced pressure backflow device (RPVD) . The RPVD installed
shall be above ground and protected from the weather and
situated so that they can be tested on a periodic basis.
2) At each fire hose connection on the dock it will be required
to place an RPVD between the fire hose_ connection_and the
3 411 hogs bibb. These RPVD' s at this location are necessary
to protect the dock' s potable water from contamination of
salt-water and the Fire Department foam system during a fire.'
3) The drain plug as shown at various points along the dock
will be under water. Therefore it will be required that an
approved double check valve assembly be installed (DCVA) .
An alternative to installing the DCVA would be to delete
the drain plugs entirely.
4) The sewage pump-out station drawing indicates that a vacuum
breaker be installed on the incoming potable water system.
This is contrary to acceptable procedures and principles
in cross connection control. RPVD will be required for
installation on this station. Again this devise shall be
above ground and protected from the weather and shall be
situated so that it can be readily tested periodically.

5) Astmospheric vacuum as shown on each individual 3/4" hose
bibb is specified as a vacuum breaker Watts 8A. The
approved devices testing date was February, 1982 indicates
that the Watts 8A-C is approved. If the devise specified
and the approved are one in the same no problem, if not,
the Watts 8A-C should be used.
As you may or may not be aware the cross connection program is
based on probability of contamination of a potable water system.
The law makes the water purveyor responsible for providing pot-
able water to the last outlet on a system even though that last
outlet may be on private property. The law also prescribes severe
penalties against not only the City of Anacortes as purveyor but
also against the Maintenance Superintent but myself personally.
Therefore you may think the requirements are rather stringent
we are trying to protect ourselves but also the users of the water
at dock side and the City of Anacortes as a whole. It is becoming
more prevelent to place the blame on water systems for any and all
unexplained illnesses which manifest themselves in the intestional
tract, sometimes with good reason. We are therefore doing what
we can to protect all our customers.
The Fire Chief has reviewed the plans also and submitted a list
of couuuents to the Buidling Inspector. I have listed some of
those comments.
1) To date neither the Fire Chief or myself have received flow
calculations which would indicate an adequate flow and
pressure on each dock line.
2) The spacing of the hose connections along the docks are
such that the Fire Department would require siamese con-
nections rather than a single connection. If a single
connection were to be used the spacing should be not less
than seventy five feet. In addition where siamese hose
connections are used a riser should be two inch pipe rather
than 1;" pipe
3) The plans indicate a "shore end detail" does not indicate
any provisions for a pumper truck connection. In addition
will there be a fire hydrent located at each pier head?
With regard to the pump station detail I would like to have some
additional information as to the operation of this pump-out station
with regard especially to the capability of the station providing
dilution water. The chemicals used in holding tanks are of such
a concentration that they are toxic to sewage treatment plans bac-
teria. The chemical concentraiton must be reduced in order to
prevent sewage treatment plant upset.

As stated above I do have some additional concerns with regard
to water metering as well as the placement of the water mains to
serve the facilities as proposed.
I suggest that we have a meeting between your engineers and City
staff to resolve these concerns as you are opening your bid on
November 7 , 1983 for this project. The meeting should be as
soon as possible.

Members present : Baker, Hogg, Kinzel , Latham, and Root.
Staff present: Mayor Rice, Planning Director Munce.
The minutes of the July 27th meeting were approved on a motion by Latham seconded
by Kinzel.
No correspondence had been received.
Under Old Business, the Commission reviewed with Mr. Les Johnson the proposed
zoning amendments that were presently before the County Commissioners. Previous
correspondence between the City and the County over the past four years was review-
ed together with a September 12th letter from Mr. Johnson pointing out that the
County had to date still taken no affirmative action on the City' s request that
the densities on the southwest fringe of the City reflect the City' s Comprehensive
Plan. The Commission decided to take no additional action at this time.
Also under Old Business, Mrs. Juddie Murphy's letter to the Commission dated July 20,
1983 was reviewed. In this letter Mrs. Murphy points out the density calculations
in the Residential Medium Density and Residential Low Density districts diverge _
fromthe number of lots that would be permitted based on an analysis of minimum lot
size. Planning Director Munce pointed out that the discrepancy can and has been
resolved by rounding density calculations off using the usual rules to the nearest
round number of units. Mrs. Murphy asked that this procedure be formalized and
readily "available to those interested. The Planning Commission determined that no
additional action was necessary at this time.
Finally under Old Business, the Commission considered a request from the Anacortes
Christian Fellowship and School for an extension of their conditional use permit
issued on March 21, 1983 for a six month period. The extenion requested was for
an additional 12 months. After some discussion, the Commission on a motion by
Mr. Kinzel , seconded by Mr. Latham decided to issue only a 30 day extension to the
permit and invite Pastor Tom Christoe to attend the next Planning Commission meeting
with more detail of their development plans.
Under New Business, the Planning Commission considered three variance requests.
On the request by Mr. Nichols of 604 38th Street, for 20 feet of T Avenue to be
vacated, the Commission determined to take no action and therefore leave the matter
to the City Council. On the request of Mr. Mace for Block 12 of the First Plat
of Ship Harbor, the Commission, on a motion by Mr, Root seconded by Mr. Latham
decided to recommend denial of the application to the City Council as premature;
the vacation requested was that of a portion of Harrison Avenue, a portion of
D Street and all of the alley in Block 12. Finally on Mr. Zurcher's request for
the vacation of 3 feet of T Street adjacent to his house of 320 4th St. , the
Commission concluded that they had no objection. The vacation was requested
because the house encroached approximately 3 feet into the T Street right-of-way.
Finally under New Business, the Planning Commission considered permit modifications
sought by the Port of Anacortes in a September 7 , 1983 letter to the Shoreline
Permit issued by the Planning Commission in 1980 for the expansion of the Cap Sante
Boat Basin. Planning Director Munce stated that the modifications requested fell
into three separate categories. First , was the revised moorage layout. Second,

deletion of four items of the conditions and amendment of two others. Mr. Bill
Vaux, President of the Board of Commissioners of the Port of Anacortes, addressed
the Commission on the need for the modifications and for cooperative action
between the City and the Port. Mr. John Olson of Reid-Middleton 4 Associates,
the Port' s consultants on this project, then presented the background of the
request. He pointed out that the same amount of space in the Boat Basin was to
be utilized under the new layout but with an increased density designed to match
the layout to the size pattern of moorage slips demanded. He added that of the
715 slips now proposed, �424' would be developed in the proposed Phase 11 He added
that the sewage pump-out facility would be relocated from the south to the north
basin and should be considered an integral part of the Phase I project. The
Planning Commission informed the Planning Director that they had no objections
to this modification and accordingly it would be processed administratively.
Mr. Olson then explained the financial feasibility of the Phase I project and
how this fitted within the overall development plan his firm was preparing for
the Port. He described in detail the form that this development plan was taking I
and how in each of the latest alternative scenarios access to the north basin
was to be from 6th Street with 9th and Market Streets being closed off and
possibly vacated. He added that only part of the esplanade under the Port' s
proposal of Phase I would be included and that a C5 to 1 parking to moorage
slip ratio was requested.
iketi The Planning Commission then turned to consideration of which of the conditions
attached to the 1980 shoreline permit should apply to Phase I. After lengthly
discussion with Mr. Olson and other Port representatives, the Commission concluded
that IABD were not applicable to Phase 1 . However, the Commission declined to
consider action that would remove these conditions from the permit at this time
and accordingly it was agreed they remain a requirement for the development of
the Cap Sante Boat Basin under the 1980 shoreline permit .
Additionally, after reviewing a five page report on marina parking standards in
comparable marinas in Puget Sound and findings based on a daily count of parked
vehicles from June 30 through September 4 at the Cap Sante Marina, the Commission
took the following action: On a motion by Mr. Latham seconded by Mr. Baker the
Commission determined under Section . 07(b) of the City Zoning Ordinance to set
a requirement of .5 parking spaces for 1 moorage slip as the standard for the
entire permit based upon the documented finding that the overall parking situation
in the project vicinity would not be adversely affected by this action. It was
noted that this standard was (lased on setting aside 316 equivalent ,parking space)
for a combination vehicle and trailer parking in connju ction with the boat launch
facility.
In a response to a question from the audience, the Port Executive Director Joe
Baier stated that the Port now has everything they needed to proceed with the project.
The meeting adjourned at approximately 11 :00 p.m.

certain adjustments in the conditions of the permit should not be considered
the only and/or final action. Condition No. 9 stipulates that the City
recognizes that the plans of the Port District may change during project
development and agrees to cooperate with the Port in modifying the conditions
herein before set forth, as the same are deemed appropriate to good planning
and development for the community. Under this condition we would expect that
as your plans are finalized you would continue to consult with us on necessary
permit condition changes.

STIPULATION TO THE SHORELINE PERMIT
I. Street Access Improvements
A. Market Street - 9th to 6th. Adequate right-of-way shall be dedicated and the
street shall be improved to City standards with curb, gutter and sidewalks.
B. 9th Street, "Q" Avenue to Market. Street to be improved to City standards
comparable to Market Street.
C. 6th Street between "5" and "T". To be improved to City standards comparable
to the above two streets.
D. "T" Avenue between 6th and 4th. To he improved to City standards comparable
with the above improvements.
E. The Port shall agree to the improvement of "Q" Avenue utilizing the LID method.
F. There should be installed a sidewalk around the north end of the boat basin with
a landscaped strip for its full length.
II. Parking
A. There-shall be provided one (1) parking stall for each boat slip in an amount
to satisfy the parking requirements for the existing as well as the proposed
marina expansion. i
B. Parking shall be developed to City standards which includes paving, drainage
and striping.
C. Parking areas shall be landscaped pursuant to standards included in the City's
proposed parking lot landscaping standards.
D. Parking lot should be lighted.
III. Street Lighting
Adequate street lighting shall be provided pursuant to City standards.
IV. Water
A. Water system improvements will be required to service both existing and proposed
marina expansion in order to provide domestic as well as required fire flows.
Size, design and location of the improvements shall he reviewed and approved
by the City. Improvements shall include all backflow prevention devices, hydrants, 1
etc. as required.

V. Sanitary Sewers
A. Adequate sanitary and storm sewers shall be constructed to service the area
in accordance with City design and location standards. The proposed pump-
out facility shall be provided with proper holding and dilution tanks according
to City specifications.
B. A restroom facility should be provided to service the northerly boat basin and
parking area.
VI. Sanitation
Sanitation containers shall be provided with proper concrete pads and sight-screening
in the pleasure boat-recreational areas. Locations of the containers to be reviewed
and approved by the City so that more efficient service may be provided.
VII. Landscaping
There should be developed and provided a landscaping plan for the marina subject
to the review and approval of the City.
VIII. Public Access
The Port will provde and dedicate 60' of shoreline with appropriate uplands and
access for the public access to the waterfront between the breakwater and the
eastern end of 15th Street extended. In return the City will exchange, on an
equal value basis, land that it owns along the southern boundary of the Port's
property.
IX. The City recognizes that the plans of the Port District may change during project
development and agrees to cooperate with the Port in modifying the conditions
hereinbefore set forth as the same are deemed appropriate to good planning and
development for the Community.

fish and wildlife values, flood hazards, flood plain values, land use, navigation,
shoreline erosion and accretion, recreation, water supply and conservation, water
quality; energy needs, safety, food production and, in general, the needs and
welfare of the people.

part of the record and will be considered in determining whether it would be in the
best public interest to grant a permit. Comments should refer to the reference

Washington Coastal Zone Management Program
Notice is hereby given that a request is being filed with the Department of
Ecology for certification that a proposed discharge resultin from the project
described in the Corps of Engineers Public Notice No.O.7J 5j Z—�tj =Cf
will comply with the applicable provisions of State and Federal Water Pollution 1
Laws.
Notice is also given that a request is being filed with the Department of Ecology
for concurrence that the above referenced project will comply with the Washington
State Coastal Zone Management Program and that the project will be conducted in
a manner consistent with that Program.
Any person desiring to present views pertaining to the project on either or both
(1) water pollution or (2) the project's compliance or consistency with the
Washington State Coastal Zone Management Program may do so by providing written
comments to the Department of Ecology, Inter-Agency Operations Section, Mail
Stop PV-11, Olympia, Washington 98504.
Please note, state regulation requ,}res a minimum of 20 days of public notice.
The comment period will begin 7��e (date of publication) and
run until final comments are rec ed from reviewing state agencies and the
local government(s) .

Your verbal request of August 25, 1983 for a time extension on the above-
referenced approval written by these departments on August 18, 1980 and
extended on September 22, 1980, November 17, 1981 , March 3, 1983 and
August 16, 1983 has been reviewed and Provision a. is hereby changed to
read as follows :
a. Time Limitation: Pile driving and dredging may be started
immediately and shall be completed by December 31 , 1984.
A time extension will be considered upon reapplication.
However, there shall be no pile driving or dredging allowed
from March 15 to June 15 of any year.
All other provisions of the original approval are to remain in effect and

Enclosed please find revised permit drawings as per our discussions on
Monday, July 18. Revisions consist of respacing and placement of the
proposed floats in the north basin. Although the revision provides for
additional mooring spaces, the floats generally cover the same area as
the presently approved permit.
As you may know, with the exception of the northwest corner of the harbor,
as shown on revised sheet 3 of the application, the dredging of the harbor
has been completed. Because of this commitment, and the need to install
the floats as soon as possible to produce revenues, the Port of Anacortes
is hereby requesting that if at all possible, this revision be given
"in-house" approval . Your early consideration of this matter will be
greatly appreciated. Please advise me of your determination regarding
the approval and the time required for this process.
