In preparing this letter, I have discussed this matter with Mayor Laurie Gere; Eric Shjarback, the City Engineer; and Don Measamer, the City Planning Director. You expressed concerns about the City's characterization of your neighborhood's private sewer line and your future ability to repair your system. Let me assure you that the City does not consider your private line to be "illegal" or "unauthorized". It is clear that the line was installed during early development of your neighborhood and the City is well aware of its existence. Because it is a private line, you and your neighbors are free, at your expense, to perform whatever maintenance and repairs are necessary to maintain current capacity. Please be aware that the City cannot expend public funds to repair or improve a private sewer line. Additionally, your neighborhood will bear financial responsibility for any damages caused to City lines during any work done on your private line. At your option, your neighborhood may connect to the City sewer line at any time. Section 13.08.027 AMC provides the procedure and cost for property owners to connect to the H Avenue sewer line. As described in subsection (D)(2), you will be asked to pay the sewer surcharge fee along with any necessary inspection and other fees prior to connection. However, the City is not insisting that you connect to the City's line. I hope this letter is helpful. To recap, your neighborhood line is considered a private line by the City. You are free to maintain your line at your expense for as long as you choose Schorr February 9, 2017 Page 2 of 2 to do so. The City is not responsible for maintenance or repairs of your line and you will be responsible for any damage caused by your private line to the City sewer lines. If you choose to connect to the City's line, which you are not required to do, you will simply have to pay the sewer surcharge fees.
