The existing adjacent triplex building lots are also not in compliance due to improper maintenance of the previously planted slope between the buildings and the Oakes Avenue right of way boundary. While relatively new,the use of wild rose and snowberry hydroseeding has been successful and efficient in fully re-establishing these species in wild lands and commercial area buffers in a variety of environments ranging from the dry plateau of eastern Washington to the temperate rain forests of the Queen Charlottes Islands. lndu.sty and vendor data indicate that a 50 % coverage rate per acre for each of these species would be an application rate of three pounds of seed per acre. To establish the rose and snowberry in large concentrated bed areas in the Oakes Avenue buffer landscape we propose to double that amount per acre to establish at least a 90 % coverage rate in those areas; (other areas where this may be used witt be applied at the standard 60 % coverage rate,as recommended ). As indicated previously, in the past with your concurrence,we have attempted to vegetate the slope with wild flowers,clover,snowberry and rosebush by hydro seeding,these attempts were not successful.We subsequently planted trees and many of those died this last summer likely due to insufficient irrigation. The steep 1.5—1 slope obviously does not retain water and accordingly a lot of irrigation is required to maintain it in a moist condition during the hot summer months_ We want to ensure that our landscaping will allow us to maintain the slope effectively by keeping the grass short and thick,thereby controlling the weeds and adding stability to the slope. Our maintenance plan is to have the homeowner associations keep the slope mowed(weed whacked)and irrigated thereby allowing the trees, ground cover and grass an opportunity to get established and choke out weeds in the process.Ongoing mowing will also keep the weeds, scotch broom,alders,blackberry,etc.,from gaining a foothold. Another concern is slope stability. In the past we have had to install curtain drains to drain off migrating subsurface water from saturating the slope and to prevent sliding in the wet winter months. The vegetation on the slope is stabilizing the slope and we are very reluctant to create "islands"of disturbed soil on the slope. The plan shows that we will replace the trees that have died with similar trees(Liquid Amber). My understanding is that Liquid Amber variety we have chosen will grow to approximately 35 feet with a diameter of 20 feet or more. With the trees spaced at, say 35 feet,the space between the trees would be approximately 15 feet,leaving room for views between the trees.The trees will be approximately 8 feet in height and potted(as opposed to bare rooted)so they should have a good start in spring. In addition to our installed irrigation,we will hand water those plants in the summer to ensure they become well established. In addition,we will add some variety, by planting clumps of vine maple and shore pines. I would like to keep the mature height of these trees down to 20—25 feet if possible. While other • Page 2 November 16,2007 species, ie Douglas Fir, Red Cedar, have been suggested,we are reluctant to plant trees that would grow higher than 30 feet considering the slope and their proximity to our buildings. Low growing ground cover(Rubus pentalobus)will be added to some lower sections on a test basis to determine its growth pattern and how it affects our maintenance program vis a vis weeds growing in between the plants.We anticipate we would need a part of a season to see how the groundcover takes before we add more. We understand the rubus is quite aggressive and will soon cover portions of the slope in an emerald carpet In addition we are willing to test plant some"islands"with native shrubs—snowberry and rose bush—that we would obtain from the Native Plant Society next spring. Again,we are concerned about maintenance issues(weeds growing amongst the shrubs)and slope stability issues accordingly these would be planted towards the westerly portion of the site. We have purposely not shown any plantings along the upper portions of the slope for the reason that we want to keep this portion(along the sidewalk and over the crest of the slope)mowed so that any vegetation does not interfere with our sprinkler system. On going irrigation in summer will be required to keep the slope looking green and lush. Also, by keeping the vegetation low in this area we will not be impairing the views for passing motorists. Box 547 Anacortes,WA 98221 Attn: Paul Ingalls, Building Inspector Re:Plan Review Notes for the new triplex at 4923,4925 and 4927 Portalis Way Dear Paul, I am in receipt of your letter of April 29, 2013 regarding the above referenced matter. I am confused by and disagree with points 1 and 2 in that letter for several reasons: 1. Prior to final plat approval of the Portalis site work there were various communications with city officials regarding the landscaping on the Oakes Avenue slope as partially evidenced by the correspondence attached to your above referenced letter. The landscape plan dated Sept 19, 2003 also attached to your letter was clearly not workable. My understanding is that the City agreed and released our $60,000 performance bond on or about November 1, 2006. An alternative landscape plan was submitted at a later date. 2. Enclosed is a copy of a letter and landscape plan submitted to the City of Anacortes on November 16, 2007. To my knowledge, there has been no further communication with me or Portalis in regards to this matter in the nearly six intervening years,which led me to believe,and implies,that this matter was settled. 3. While the shore pine and vine maple clumps and rubus pentalobus were not planted due to slope steepness/stability/irrigation and maintenance issues, Portalis has replaced many of the dead liquid amber trees and has exercised its best efforts to mow and maintain the entirety of that slope free of weeds etc. over the years (now the responsibility of the HOA). I invite you to meet with me on site to discuss this matter in more detail. With respect to the third floor escape and rescue window(point 3),we will insure that a window is installed that meets the minimum clear opening size as per IRC code section R310.1.
