Anacortes Municipal Code Section 16.08.050 2.0 Description of the Project . 2.1 The applicant is proposing a 3-lot short plat in the R 2 use zone generally at Marine Drive and Anaco Beach Road Exhibit 1 drawinul. Attachment A: January 28, 2008 introductory letter Attachment B: History of land use permits at this location Attachment C: Map showing original ownership Attachment D: Drawings (2) showing entire parcel lot layout Attachment E: Subdivision Guarantee Attachment F: Warranty Deed Attachment G: CC&R's • 2.2 The minimum lot size in the R 2 zone is 7,500 square feet; Lot 4 is 8062.7 square feet; and Lot 5 is 8264.2 square feet; and Lot 6 is 9061.2 square feet. 2.3 The project site is surrounded on all sides by the R 2 zone. 3.0 Consideration of Alternatives 3.1 The applicant has considered and rejected alternative designs. 3.1.1 The City's Design Review Group (DRG) met on March 10, 2008 to review the Short Plat submittal; the application was determined to be complete and 4 conditions were proposed in addition to standard short plat conditions (Exhibit 2). 4.0 State Environmental Policy Act 4.1 Short plats are exempt from SEPA requirements unless they involve lands covered by water, lands previously short-platted and exempted from SEPA, or lands to be divided 3 Short Plat#08-001 —Marine Pointe into five or more lots. WAC 197-11-800(6)a and Anacortes Municipal Code Section 16.08.010. 4,2 There are no wetlands present on the property as regulated by City of Anacortes Zoning Ordinance, Chapter 17.65 that are affected by this action. 4.3 The subject property has not been short-platted within the last five years. 4.4 The subject property is not to be divided into five or more lots, and accordingly, no SEPA Checklist was prepared. 5.0 Notice 5.1 For a short subdivision adjacent to the right-of-way of a state highway, written notice, including a legal description of the proposed subdivision and a location map shall be sent to the Secretary of Transportation of the State of Washington. The Secretary shall respond within fifteen (15) days of said notice as to the affect that the proposed subdivision will have on the adjacent state highway. Anacortes Municipal Code Section 16.08.031 5.1.1 This short-plat is not adjacent to a state right-of-way. 5.2 For all short subdivisions, the application shall be accompanied by a list of all, property owners, with their mailing addresses, who own land within 300 feet of the boundaries of the property being proposed to be subdivided. 5.2.1 On March 3, 2008 the Planning Department sent notice to all persons on the list informing them of the proposed short subdivision and inviting comments to be made in writing within fifteen (15) calendar days of the date that the notice was mailed. 5.2.2 No letters of comment were received in response to this Notice. 6.0 Short-Plat Requirements 6.1 "If the Administrator finds that the proposed short plat is consistent with the comprehensive plan, SEPA requirements, and zoning requirements for the district, and that there is adequate provision for drainage, sewage disposal, water supply and access for each lot, that [the short-plat improvement] requirements of this ordinance are met, and the short plat would not landlock other parcels, he/she shall approve the • application." Anacortes Municipal Code Section 16.08.030 6.2 The proposed short plat is consistent with the Comprehensive Plan. 6.3 The proposed short-plat is consistent with the R 2 zoning district (see 2.1.1 above). • hnrt Plat# 08-001 —Marine Pointe 6.4 Subject to conditions there is adequate provision for drainage: surface water management controls shall be implemented to the City Engineer's specifications/Ordinance #2441. 6.5 Subject to conditions there is adequate provision for water supply: connection to city water. 6.6 Subject to conditions there is adequate provision for sewer service; connection to city sewer. 6.7 Access is available for this development from Anaco Beach Road and Marine Drive. 6.8 The short-plat will not landlock other parcels. 6.9 All required improvements from findings 6.4 to 6.7 above "shall be constructed or installed according to applicable subdivision regulations, and, if required, a commitment • of non-opposition to any Local Improvement District shall be submitted to the Short Plat Administrator prior to short plat approval. In addition, bonds or other security may be required by the Administrator securing to the City the successful operation of the improvements for up to one (1) year after short plat approval". Anacortes Municipal Code Section 16.08.060 6.10 Subject to the conditions detailed above, all requirements have been satisfied. 7.0 Appeal 7.1 Under the City Subdivision Ordinance the Administrative Official has "the authority to approve or disapprove proposed short subdivisions". State law grants the Administrative Official authority to deny a Short Plat of 4 lots or less only if specific City standards are not met, e.g., lot size, dimension, road frontage. Short Plats of 5-9 lots and Short Plats of 2-4 lots with wetlands involve the exercise of more discretion in that a State Environmental Policy Act review is mandated. 7.12 On March 27, 2008 the Subdivision Administrator approved the SVCD LLC 3-lot plat. 7.2 Any party aggrieved by the decision of the Administrator may appeal to the City Council by filing a notice of appeal with the City Clerk within fifteen (15) days of the tentative approval or disapproval by the Administrator. The appeal shall state the reason for the • appeal and be signed by the party filing the appeal. The appeal shall be scheduled on the next available council agenda and notices shall be sent to the applicant and the party filing the appeal. 7.2.3 One appeal was filed. Exhibit 3: April 9, 2008 Appeal from Ben Short Exhibit 4: April 22, 2008 response from SVCD LLC 5 Short Plat#08-001 —Marine Pointe 7.2.4 A Public Hearing to hear the appeal was scheduled before the City Council for May 19, 2008. The Notice was published in the Anacortes American on April 30, 2008 (Exhibit and mailed to property owners within 300 feet on May 5, 2008 (Exhibit 6). 7.2.5 At the conclusion of the Public Hearing, the City Council voted to deny the appeal and to approve the Marine Point 2-lot Short Plat # 08-001 subject to the conditions outlined on pages 7 and 8 below. 8.0 State Subdivision Law 8.1 State subdivision law requires that a city. "(1)...shall adopt regulations and procedures, and appoint administrative personnel for the summary approval of short plats and short subdivisions or alteration or vacation thereof. When an alteration or vacation involves a public dedication, the alteration or vacation shall be processed as provided in RCW 58.17.212 or 58.17.215. Such regulations shall be adopted by ordinance and shall provide that a short plat and short subdivision may be approved only if written findings that are appropriate, as provided in RCW 58.17.110, are made by the administrative personnel, and may contain wholly different requirements than those governing the approval of preliminary and final plats of subdivisions and may require surveys and monumentations and shall require filing of a short plat, or alteration or vacation thereof, for record in the office of the county auditor: PROVIDED, That such regulations must contain a requirement that land in short subdivisions may not be further divided in any manner within a period of five years without the filing of a final plat, except that when the short plat contains fewer than four parcels, nothing in this section shall prevent the owner who filed the short plat from filing an alteration within the five-year period to create up to a total of four lots within the original short plat boundaries. (2)...shall...consider provisions for considering sidewalks and other planning features that assure safe walking conditions for students who walk to and from school." Growth Management Act Section 51 CONCLUSIONS OF LAW 1.1 The requirements of SEPA have been complied with. 2.1 The notice requirements of Subdivision Ordinance Section 16.08.031 have been satisfied. 3.1 The conditions set forth in Subdivision Ordinance Section 16.08 have been satisfied by this application. 4.1 The applicable goals and policies of the Comprehensive Plan have been met by this application. 6 Shnrt Plat tt 38-001 - Marine Pointe 44, CITY OF ANACORTES DECISION TO APPROVE A SHORT PLAT FOR THE SVCD LLS 3-LOT SHORT PLAT SHORT PLAT NUMBER ANA 08-001 Based on the foregoing Findings of Fact and Conclusions of Law the Anacortes City Council hereby issues short-plat approval for the SVCD LLC 3-lot Short Plat subject to the following conditions: (1) Short Plat Approval authorizes the applicant to proceed with application for necessary permits to construct required improvements and to prepare construction drawings in accordance with the determinations made and conditions imposed by the Administrator. The scope of this permit is not to exceed that as set-out in Exhibit 1 and attachments. (2) This project is subject to applicable water, sewer, and stormwater general facility and hookup fees and transportation, fire, school, and park impact fees. These fees are payable at levels in effect at the time of building permit issuance and may differ from those fee levels currently in effect; sewer and water latecomer charges may be payable. (3) The Skagit County Treasurer's Office requires that the following statements shall appear on all long plats, replats, altered plats or binding site plans: a. Treasurer's Certificate. (6) The proposed Native Growth Protection Easement shall remain untouched with the following exceptions. (a) Hand removal of non-native or adventitious plants as approved by the Parks Department. (b) Hazard trees will be identified with the concurrence of the Parks Department. Hazard trees removed or blown down shall be replaced by the landowner subject to approval of the Parks Department, with 3 foot minimum appropriate native stock and shall be maintained by the landowner until able to survive without care. (c) Trails through the NGPE shall not be permitted without the approval of the Parks Department. (7) Fire apparatus access and turnaround shall be provided as required by the Fire Chief; fire flow shall be provided as required by the Fire Chief. (8) All easements shall be shown on the face of the plat, including sewer, water, and fire apparatus access. (9) Frontage and access improvements shall be completed as required by the Public Works Director prior to final plat approval. (10) The street addresses shall be determined by the Building Department. (11) This approval will expire three years from the date of approval if the short plat is not signed and recorded. SECTION J103 PERMITS REQUIRED J103.1 Permits required.Except as exempted in Section J103.2,no grading shall be performed without first having obtained a permit therefor from the building official. A grading permit does not include the construction of retaining walls or other structures. J103.2 Exemptions. A grading permit shall not be required for the following: 1. Grading in an isolated, self-contained area,provided there is no danger to the public, and that such grading will not adversely affect adjoining properties. 2. SECTION J104 PERMIT APPLICATION AND SUBMITTALS J104.1 Submittal requirements.In addition to the provisions of Section 105.3,the applicant shall state the estimated quantities of excavation and fill. 105.3 Application for permit.To obtain a permit, the applicant shall first file an application therefor in writing on a form furnished by the depai[went of building safety for that purpose. Such application shall: 1.Identify and describe the work to be covered by the permit for which application is made. 2.Describe the land on which the proposed work is to be done by legal description, street address or similar description that will readily identify and definitely locate the proposed building or work. 3.Indicate the use and occupancy for which the proposed work is intended. 4.Be accompanied by construction documents and other information as required in Section 106. 5. J104.2 Site plan requirements.In addition to the provisions of Section 106, a grading plan shall show the existing grade and finished grade in contour intervals of sufficient clarity to indicate the nature and extent of the work and show in detail that it complies with the requirements of this code.The plans shall show the existing grade on adjoining properties in sufficient detail to identify how grade changes will conform to the requirements of this code. J104.3 Soils report.A soils report prepared by registered design professionals shall be provided which shall identify the nature and distribution of existing soils; conclusions and recommendations for grading procedures;soil design criteria for any structures or embankments required to accomplish the proposed grading; and,where necessary,slope stability studies, and recommendatidns and conclusions regarding site geology. Exception: A soils report is not required where the building official determines that the nature of the work applied for is such that a report is not necessary. J104.4 Liquefaction study.For sites with mapped maximum considered earthquake spectral response accelerations at short periods (Sr) greater than 0.5g as determined by Section 1613 (Anacortes), a study of the liquefaction potential of the site shall be provided,and the recommendations incorporated in the plans. Exception: A liquefaction study is not required where the building official determines from established local data that the liquefaction potential is low. SECTION J105 INSPECTIONS J105.1 General.Inspections shall be governed by Section 109 of this code. J105.2 Special inspections.The special inspection requirements of Section 1704.7 shall apply to work performed under a grading permit where required by the building official. SECTION J106 EXCAVATIONS J106.1 Maximum slope.The slope of cut surfaces shall be no steeper than is safe for the intended use,and shall be no steeper than 2 horizontal to 1 vertical(50 percent)unless the applicant furnishes a soils report justifying a steeper slope. Exceptions: 1. A cut surface may be at a slope of 1.5 horizontal to 1 vertical(67 percent)provided that all the following are met: 1.1.It is not intended to support structures or surcharges. 1.2. It is adequately protected against erosion. 1.3.It is no more than 8 feet(2438 mm)in height. 1.4.It is approved by the building official. 2. J107.2 Surface preparation.The ground surface shall be prepared to receive fill by removing vegetation,topsoil and other unsuitable materials,and scarifying the ground to provide a bond with the fill material. J107.3Benching.Where existing grade is at a slope steeper than 5 horizontal to 1 vertical(20 percent)and the depth of the fill exceeds 5 feet(1524 mm)benching shall be provided in accordance with Figure J107.3.A key shall be provided which is at least 10 feet(3048mm)in width and 2 feet(610mm)in depth. J107.4 Fill material.Fill material shall not include organic,frozen or other deleterious materials.No rock or similar irreducible material greater than 12 inches(305 mm)in any dimension shall be included in fills. J107.5 Compaction.All fill material shall be compacted to 90 percent of maximum density as determined by ASTM D 1557,Modified Proctor,in lifts not exceeding 12 inches(305 mm)in depth. J107.6 Maximum slope.The slope of fill surfaces shall be no steeper than is safe for the intended use.Fill slopes steeper than 2 horizontal to 1 vertical(50 percent)shall be justified by soils reports or engineering data. SECTION J108 SETBACKS J108.1 General. Cut and fill slopes shall be set back from the property lines in accordance with this section. Setback dimensions shall be measured perpendicular to the property line and shall be as shown in Figure J108.1,unless substantiating data is submitted justifying reduced setbacks. J108.2 Top of slope.The setback at the top of a cut slope shall not be less than that shown in Figure J108.1,or than is required to accommodate any required interceptor drains,whichever is greater. J108.3 Slope protection.Where required to protect adjacent properties at the toe of a slope from adverse effects of the grading,additional protection,approved by the building official,shall be included. Such protection may include • but shall not be limited to: 1. Setbacks greater than those required by Figure J108.1. 2.Provisions for retaining walls or similar construction. 3. Erosion protection of the fill slopes. 4. Provision for the control of surface waters. SECTION J109 DRAINAGE AND TERRACING J109.1 General.Unless otherwise recommended by a registered design professional, drainage facilities and terracing shall be provided in accordance with the requirements of this section. Exception:Drainage facilities and terracing need not be provided where the ground slope is not steeper than 3 horizontal to 1 vertical(33 percent). J109.2 Terraces.Terraces at least 6 feet(1829 mm)in width shall be established at not more than 30-foot(9144 mm) vertical intervals on all cut or fill slopes to control surface drainage and debris. Suitable access shall be provided to allow for cleaning and maintenance. Where more than two terraces are required,one terrace,located at approximately mid-height,shall be at least 12 feet(3658 mm)in width. Swales or ditches shall be provided on terraces.They shall have a minimum gradient of 20 horizontal to 1 vertical(5 percent) and shall be paved with concrete not less than 3 inches(76 mm)in thickness, or with other materials suitable to the application. They shall have a minimum depth of 12 inches(305 mm)and a minimum width of 5 feet(1524 imn). A single run of swale or ditch shall not collect runoff from a tributary area exceeding 13,500 square feet(1256 mz) (projected)without discharging into a down drain. J109.3 Interceptor drains.Interceptor drains shall be installed along the top of cut slopes receiving drainage from a tributary width greater than 40 feet(12 192 mm),measured horizontally.They shall have a minimum depth of 1 foot (305 inn) and a minimum width of 3 feet(915 min).The slope shall be approved by the building official,but shall not be less than 50 horizontal to 1 vertical(2 percent). The drain shall be paved with concrete not less than 3 inches (76 nun)in thickness,or by other materials suitable to the application.Discharge from the drain shall be accomplished in a manner to prevent erosion and shall be approved by the building official. J109.4 Drainage across property lines.Drainage across property lines shall not exceed that which existed prior to grading. Excess or concentrated drainage shall be contained on site or directed to an approved drainage facility.
