Martin 1109 Dakota Avenue Anacortes, WA 98221 Dear Mr. Martin: This letter shall serve as your Home Occupation Permit to use your home at 2820 Oakes Avenue to conduct your business wholesale firearms, ammunition, clothing, and accessories. The permit is granted based on the description of the Home Occupation as outlined in your May 5, 1994 application. I have enclosed an information sheet that lists the conditions imposed on all home occupation permits. I The following two conditions shall be attached to your permit: 6. Possession, transportation and storage of small arms ammunition shall be in accordance with DOT requirements (all products remain in their original shipping packages). 7. Storage of more than 5 pounds of commercially manufactured sporting black powder, 20 pounds of smokeless powder and 10,000 small arms primers shall be prohibited. Any questions about those conditions can be directed to Mr. Ed Frank, Building Official, at 293-1901 or Mr. Dan Harju, Fire Inspector. Also, Ms. Lisa Beebe of the Finance Department (293-1909) will process your Business License application. The information sheet also outlines the appeal process and the time restrictions should an appeal be filed. If no appeal is made, the effective date of the permit shall be June 3, 1994. Members present : Bob Ainsworth, Diane Erholm, Brad Snyder , Leslie Carty, George Mehler Staff present : Lyle Cornish Minutes of August 6 , 1992 meeting were approved/passed (Erholm/Snyder) . i Mock Variance ( 1805 24th St . ) The Board reviewed this request for side-yard setback variance from 5 feet to 15 inches to construct an accessory storage building; height of the proposed 6 'X16 ' building will be 7 feet at front , 6 feet at rear near the property line. Mr . Mock stated that the building site is adjacent to an existing 5-foot concrete retaining wall topped by a 3-foot fence, thus the proposed building will be below the fence; and beneficially screen the stark wall . He explained that restricted rear-yard area on the property prompted the proposed location, which has minimum visual impact on the neighborhood. There were no comments/objections from City Staff ; Mrs . Aguero, adjacent neighbor , supported the request . A motion to grant the requested setback variance was made (Snyder/Mehler) and passed with all ayes . The Board reasoned that lot size restrictions created a hardship for the applicant . Kilpatrick Variance (2309 llth Street) The Board reviewed this request for reduction in minimum lot size for a single family residence (RL Zone) from 6000 sq. ft . to 4500 sq. ft . in a situation in which 31 contiguous lots (30 'X100 ' ) , under single ownership, have an existing small residence on the 4500 sq. ft . site with the remaining two lots vacant . The owner (applicant ) proposes to build a single family residence on the latter . Mr . Kilpatrick explained that the 12 lots for the present home were purchased in 1968 and the remaining two lots purchased in 1974 ; thus a 6000 sq. ft . minimum lot size applies under the 1978 lot-ownership rule in the Zoning Ordinance. The existing house has a 9-foot side setback from the vacant lot property line. He further explained that his elderly mother now occupies the house and that to displace her for building remodelling to his needs would be very difficult for her . He also cited a favorable Board decision in a similar variance request in the immediate area. Comments from nearby property owners : Mr . Holdont (2320 11th St . ) supported the request ; Mr . Spalding ( 2319 llth St . ) wanted assurance of adequate building setback from his common property line with the proposed building site; Mr . Jones (1120 C Ave. ) objected to the request citing negative impact on property values because of congestion and view obstruction. 2 . In discussion, Mr . Snyder commented that each variance request before the Board is evaluated and judged on its own special circumstances and conditions of hardship to the applicant . Mr . Ainsworth noted that a transient hardship, as suggested by the applicant , is not a definitive grounds for request approval . A motion to grant the lot-size variance as requested was made (Mehler/Erholm) but failed with two ayes (Mehler , Erholm) , three nays (Ainsworth, Snyder , Carty) ; the variance request was denied. In support , Mr . Mehler noted that had the two lots in question been purchased by another party in 1974 , the lots would be a valid building site. The majority determined that the applicant had not demonstrated required special conditions of hardship necessary for approval . Robinson Variance (2819 Oakes Ave. ) The Board reviewed this request for side-yard setback variance from 10 feet to 6 feet along Dakota Avenue to construct a detached two-car garage. Mr . Robinson explained that there is limited rear-yard area for the proposed garage (22 'X22 ' ) on the 90 'X100 ' property because the residence has a large 40-foot front setback from Oakes Avenue. An existing low- quality garage situated on the rear alley will be removed. There were no comments/objections from City Staff ; Mr . Kerr (2901 Oakes Ave) supported the request . In discussion, the Board observed that Mr . Robinson owned additional lots adjacent to the property but considered it inappropriate to expect that he add an additional lot to his building site merely for garage construction. A motion to grant the requested setback variance was made (Snyder/Erholm) and passed with all ayes . The Board considered site limitations a hardship for the applicant . Keltz Vacation (Lot 1 Block 9 Woods Addition) Mrs . Keltz reviewed this Petition for Street Vacation: West 15 feet of 5th Avenue from the alley north to Park Avenue , adjacent to Lot 1 , Block 9, Woods Addition. Mrs . Keltz explained that the street vacation is requested in order to increase Lot 1 area to meet the minimum single family 7500 sq. ft . lot size required by the Zoning Ordinance (RL Zone) . Lot width will increase from 54 feet to 69 feet , with a lot depth stated as 125 feet (but not verifiable with information at hand) . She reasoned that 5th Avenue, less the vacated portion, would still meet the 50-foot Residential Street Right-of-Way requirement ; 5th Avenue platted right-of-way was approximated to be 70 feet but again not verifiable with the information at hand. Mr . Culbertson (Tiger Development ) , owner of a large block of the Woods Addition supported the vacation request . Comments from City Staff : Messrs . Ford and Pemberton did not favor a street vacation, but rather suggested that the applicant seek relief from the Zoning Ordinance requirements through the variance procedure. 3 In discussion, the Board realized that the issue of sub-standard lot size throughout the Woods Addition (all presumably 54 'X125 ' ) is a major problem, far beyond the Keltz Petition for Street Vacation. Sub-standard Lots within each Block seemingly have no recourse to a street vacation; repeated lot- size variance actions as the lots develop would be unacceptable, as would a repeat of the Ship Harbor street vacation hodge-podge. It also appears that the 1978 lot-ownership rule (RL Zone) would probably not be applicable because the rule seems to address specifically the common 30 'X100 ' lot size platted throughout Anacortes . The Board Recommendation to Council moved (Snyder/Carty) and passed with all ayes : Council defer action on this vacation request , rather refer the Woods Addition lot-size problem to the City Planning Department to develop a comprehensive plan for the entire area.
