Members present John Curtis, Ken Wilson, George Mehler Staff present: Don Measamer Minutes of July 1, August 5, and August 19 were approved Foster Variance (4011 0 Avenue) Mr. Foster reviewed this request for a variance in height of a recently constructed front-yard fence set back twelve feet from the front yard property line. The overall fence height is 5'6", a 4'6"solid section topped by a one-foot open sunburst patterned lattice. The Zoning Ordinance allows a maximum 2' 6"solid fence and/or a 4' 6" open fence. City Staff had received a complaint about the height of the solid fence in the front yard. Mr. Foster explained that he had discussed the fencing project with City Staff prior to construction; he erected the fence with a "20-foot setback from the front property tine' using what-he-thought-was a property corner. A reexamination of the area after the complaint was filed revealed that the fence has only a 12-foot front setback. He stated that moving the fence to the proper setback would be a task and also impact new front- yard landscaping. His property is at the corner of 41st Street and 0 Avenue, a high traffic corner because of the proximity of Mt. Erie School. The fence was designed to reduce traffic noise and littering. He noted that a 7-foot fence behind the development on the opposite side of 0 Avenue, allowed as rear-yard fencing, extends the entire length of this section of 0 Avenue. There were no comments/objections from City Staff; Mr. Ruddell, residence i development spoke in support of the variance. A motion made (Mehler/Wilson) and passed with all ayes to grant the variance as requested with the condition that the applicant provide a 2-3-foot minimum height evergreen screen planting in a 4-foot bed along the front of the fence. The Board determined that, in this situation, the benefit to the applicant outweighed any detrimental impact on the neighborhood. O'Dell Variance (2309 Westwood Drive) Mr: O'Dell reviewed this request to reduce rear-yard setback from 20 feet to 9 feet to extend an existing open deck. Mr. O'Dell explained that the enlarged decking will provide more room around an existing spa, a larger area for family gatherings, and create an entrance to the deck from the master bedroom. The deck is three feet above ground level; the deck will not be enclosed but will have fencing required by code. Mr. O'Dell stated that a 70-foot wide dedicated greenbelt to the rear of his property separates his subdivision from an adjacent subdivision; he maintains a large portion of the greenbelt behind his property in grass. There were no comments/objections from City Staff; Mr. O'Dell stated that his subdivision Homeowners Association approved the project. A motion made (Curtis/Wilson) and passed with all ayes to grant the variance as requested. The Board determined that the variance benefited the applicant with no impact on the neighborhood. •• 2. Frazier Vacation (12-foot Right-of-Way, Cap Sante Park Addition) Mr. Frazier reviewed this petition for vacation: the 12-foot undeveloped right-of-way between Lots 15 and 16 Cap Sante Park Addition, extending from Curtis Drive to undeveloped Crest Drive. Mr. Frazier explained that the additional property added to Lot 16, which he owns, will create more buffering between his residence, on Lot 17, and a new residence on Lot 15. He stated that the right-of-way, as well as Lot 16, rise steeply to a rock ridge about forty feet above the level of Curtis Drive. He has been told that the right-of-way in the original Cap Sante Park plat was intended to provide pedestrian access to a park reserve area at the street below; this accessway is rather impractical because of the steep rock cliff. There were no comments/objections from City Staff; written comments from Mr./Ms. Richardson and Ms. Oliver, neighboring property owners supported the vacation request. Board recommendation to Council moved (Mehler/Wilson) and passed with all ayes: City approve the request for vacation of the undeveloped right-of-way between Lots 15 and 16 Cap Sante Park Addition. The Board agreed that this right-of-way serves no practical purpose. Homestead Northwest Development Company Variance (37t Street & D Avenue area) Ms. Thompson, Homestead Northwest Development Company, introduced this variance request addressing the height of several retaining walls that are included in the proposed design of the 59-unit Homestead at the Ridge development; the walls will exceed the maximum seven feet allowed in the Zoning Ordinance. She stated that, in concept, the walled design allows the buildings in the development to be 'Mucked" into the hillside, thus minimizing view impact from the residences above. The "high-end" project includes three two- story apartment buildings with 41-units and nine single-story duplexes. She commented that the "tucked" design reduces the number of units from 67 units in an approved plat submitted by the previous owner of the property; the buildings in the latter would have been much taller with significant view impact. Mr. Semrau, engineer for the project, explained that the project design is, to some extent, dictated by the large quantity of spoil material deposited on the site from construction of the adjacent The Ridge development. A significant amount of the spoil material will be removed from the site; the subject retaining walls will be used to create three site levels—one parking level and two building site levels. Wall height will range from a few feet to twenty-one feet. Mr. Semaru outlined the location of the retaining walls. Most of the walling is within the site; two at the site boundary are of concern to the adjacent property owners —one, ranging from ground level to twenty-one feet, follows the existing grade along the south side of the property adjacent to The Ridge development; the second, a ten-foot wall along the north side adjacent to the Testerrnan property. He stated that the proposed retaining walls will utilize Ultrablock with an attractive quarry-stone textured finish rather than poured-in-place concrete to be visually attractive as a backdrop for a "wall garden" landscaping design. The present inadequate ground-water drainage collection system at the base of the development will be completely revamped to City requirements. There was considerable public testimony regarding the proposed project summarized as follows: - several stated that neighboring people did not receive notification of the meeting, - safety aspects with respect to 1) adequate yet visually pleasing fencing for protection above the walls, the most critical along the very high south wall, and 2) an adequate system to prevent vehicles from dropping over the upper parking lot wall, �� - minimize the impact on the neighborhood and residents of lighting and noise from the upper parking lot, adequate control of ground water flow critical in design of the high south retaining wall and the drainage collection system at the base of the development, - visual impact from below of the of the twenty-one font high wall. 3. Mr. Testerman expressed concern that the north end of the upper parking would be ten feet above their property with the problems of safety, privacy, and the impact of lighting and noise on their environment. Mrs. Testerman noted, and had a drawing to show, that the original plat agreement included a walkway easement along the north side of the site. Homestead indicated that these issues will be addressed. Mr. Rogsford (?) asked to what extent the City Building Department reviews the project design. Mr. Measamer stated that a geophysical report is required, the design must meet City standards, and the project is followed closely during construction. A motion made (Mehler/Curtis) and passed with all ayes to grant a general variance for proposed retaining walls associated with the Homestead project as defined in the meeting with the City addressing the issues expressed during the meeting concerning: - safety concerns both pedestrian and vehicular relating to drop-off associated with retaining walls, - landscaping design and implementation commensurate with the stated aesthetically pleasing project, - design of the drainage collection system at the base of the development, -walkway easement along the north of the site, - an independent engineering design review of the retaining wall below The Ridge to assure proper ground water control for the integrity of the wall. The variance request also addressed the use of Ultrablock for retaining walls since it is not listed as approved in the present City Code. I spoke with a member of the building department prior to construc- tion and I thought that I had built the fence to be within the codes for the area in which I live.After I built the front span of the fence I received a corrections report from the inspection department for a complaint issued about the fence. It turns out that my fence is eight feet too close to the property line (it is set twelve feet back from the front property line) to be the height it is (4 feet 6 inches tall) and is only allowed to be 2 feet 6 inches tall. I built this fence for a number of reasons,chiefly among them was to cut down on road noise from pass- ing cars and to reduce the amount of garbage being thrown into my yard from passersby. I live just northeast of the intersection at 41st and 0 avenue.This short section of road sees a great deal of traffic (especially during the school year). Many of the cars that drive by come from the stop sign on 41st and accelerate rapidly along 0 avenue often burning off creating a great deal of noise.As you can see from the photos I have included the fence is just high enough to block the headlights, exhaust and tires from our home. So far, the fence has done a wonderful job in reducing the amount of noise.Also, the amount of garbage in our yard has been eliminated(we had been finding broken bottles and other trash prior to the fences construction). In deciding on the type of fence we wanted for our yard my wife and I looked around quite a bit to find some- thing that we thought was beautiful as well as functional to meet our needs.We have had a great deal of com- pliments on the fence and its aesthetic improvement on our home. I have been working very hard to make our home more beautiful and have other plans to continue its improvement. I grew up in Anacortes and I have always loved the beauty of this area. When I built this fence I thought it would fit nicely with the northwest en- vironment.The sunburst pattern on the top of the fence allows me to see the woods in the distance and the solid section hides the down guys for the power lines in the front yard and also hides some of the eight foot fence directly opposite of my property.The side of the street across from our home has a tall fence that is not pretty at all and leans and tilts all along its span(it covers the entire distance along 0 avenue we live on) as well as having quite a bit of unkept grass growing along its base. I hope that you will allow us to keep our fence, I have done my best to build it strong and beautiful. Justification for the variance. My fence is shorter than the ones that my neighbors have and is built more soundly as well as being more aesthetically pleasing. The fence across the street is seven feet tall and is set approximately four feet back off the road(my fence is set seventeen feet back from the paved road). My neighbors fence which is abutting mine to the south is three feet closer to the road than mine. North of me on 0 avenue my neighbor on the corner of 0 and Fidalgo has a six foot fence at about fifteen feet back from the road. and across the street from him that house has a fence along the side which is six feet tall at about four feet back from the road. So, I hope that since my fence is shorter, set further back from the road and is more aesthetically pleasing that you will grant me this variance. I apologize for having made an error in measurement when I constructed it initially, My neighbor to the south had told me the property line was in a different place than it actually is and I spoke to one of the inspectors in the building office and tried to find the monument and thought that I had measured correctly to build the fence and I only found my error after the construction was complete. I built the fence to last, the posts are set three feet deep in concrete and I won't be able to remove them without consider- able effort and it would require quite a bit of re-landscaping.Thank you for your time and consideration in this matter.
