During your visit to the site about 4/13/99 you outlined the methods available to me to eliminate the problem of the shed being in the required 20' setback: 1)Remove the shed. You stated this needed to be accomplished prior to end of the one- year period of the original permit. 2)Relocate the shed on the property. Relocation to the area west of the driveway is possible, as it would not be in the setback. You offered re-permit at a reduced cost. 3) Obtain a variance. I am using the first method above and expect to have moved the shed well before 11/16/99. The move is coincidental with my moving from this residence. The shed is not included in the sale of my property. I have received a letter from Don Messmer of your office requesting me to apply for a variance in 5 days. We authorized this shed installation in mid 1998 after the owner indicated in a telephone conversation with a representative of the Architectural Control Committee that the shed would be located"within the setbacks" set by the City. Since the shed has been erected we notice it is not within the setbacks. It is partially in the 20-foot easement strip between the property line and any allowed structure. It is our understanding that you have been in contact with the homeowner and are evaluating whether or not the installation is legal. If this is correct and you conclude it is not legal, we believe the homeowner could ask for a variance. The Skyline Beach Club would like to go on record as opposing any such variance request. We have received numerous complaints from neighbors stating what an eyesore the shed is. Please do not grant any variance that would allow this shed to remain in this homeowner's front yard.
