Members present: Diane Erholm , Brad Snyder , Rosemary Young , George Mehler Staff present: Edwin Frank Minutes of January 3, 1991 meeting ( Young/Snyder ) were approved/passed . Funk Variance ( 1119 King St . ) Mr . Frank reviewed this request for a variance from the one-story limitation of an accessory building to a two-story building . The new structure ( approximately 1300 sq ft ) will be a combination living quarters ( an extension of the existing residence ) and garage-shop accessory building . He further explained that the request may be moot because the lower level is classified a basement under the Uniform Building Code , but not explicitly addressed in the Zoning Ordinance . Mr . Funk detailed the building plan, stating that the first floor ( garage ) will be 6 - 7 feet below ground level and at the approximate grade of the front property line . The living area ( guest room ) , bath , and shop are on the second level . He emphasized that the former is not a second living unit . City Staff comments mistakenly addressed a second living unit question , understandably because of the difficulty in interpreting the variance application . A motion to grant the variance to a two-story accessory building was made (Snyder/Young) and passed . A second motion ( Mehier/Snyder ) was made and passed , stipulating variance approved on condition that an existing shop structure in the rear yard be removed before completion of the proposed building . The Board cited that the Uniform Building Code definition of a single story building with basement , in lieu of information in the Zoning Ordinance , was the basis for approval . Wright Vacation ( 907 35th St ) Mr . Frank reviewed a Petition for Alley Vacation: portion of the 16-foot alley in Block 6 Beales Maple Grove Addition abutting Lots 5 and 6; State Highway 20 also abuts the alley . The portion of the alley adjacent to Lots 7 - 10 had been vacated in 1973 . The alley is presently used for garbage collection and contains a City sanitary sewer line . Mr . Wright explained that a recent survey revealed that an existing garage/shed on his property encroaches approximately three feet into the alley and also had a 2-foot side-yard setback from Lot 7; this situation may create a problem should he sell the property . Alley vacation would avoid the encroachment . He has already purchased a 3-foot strip from the adjacent Lot 7 to comply with setback requirements; this purchase included the 3-foot strip of alley previously vacated to Lots 7 - 10 . City Engineering Staff noted truck and utility easement requirement , and expressed concern about potential future homeowner grief from property disruption should sewer line maintenance be necessary . Also , owners of Lots 1 - 4 may respond in kind from a precedent setting action . In discussion , Mr . Wright was not interested in petitioning for a 3-foot encroachment easement into the alley as resale may remain clouded . The Board suggested vacation of a 3-foot strip of alley adjacent to the property but Mr . Wright was concerned this would create a irregular shape for the vacated alley when added to the full 16-foot vacated alley from the purchased portion of Lot 7 . The Roard recommendation to Council moved ( Mehler/Snyder ) and passed states: City to vacate a 3-foot portion of the alley abutting Lots 5 and 6 in an even monetary exchange for receipt of a deed for that portion ( 13 feet ) beyond 3 feet of the previously vacated alley in the portion of Lot 7 purchased by Mr . Wright ( ie . create a uniform 3-foot property line extension abutting Lots 5 , 6 , and portion of Lot 7 ) . Engineering Dept should be asked for a truck and utility easement recommendation . The Board reasoned that Mr . Wright has made a sincere effort to correct a hardship and clear title to his property . Lovric Vacation ( 3022 Oakes Ave . ) Mr . Frank reviewed a Petition for Street Vacation: Georgia Avenue adjacent to Block 601 ( Lot 6 ) and Block 701 ( Lot 1 ) Northern Pacific Addition . The undeveloped street drops steeply from Oakes Avenue ( at the dip) to the waterfront area occupied by Lovric Sea-Craft . Mr . Lovric owns the abutting aforementioned Lots . Mr . Lovric stated that he plans to develop a portion of the vacated street and Lots 1 - 3 Block 701 ( recently purchased ) into an employee parking lot with access from the existing drive ( Road 1913 ) to his industrial area . City Engineering Staff comments focused primarily on a potential conflict between the parking lot plan and the present storm outfall system installed on this portion of Georgia Avenue; the recently revised system is a key element in the Little Cranberry Lake drainage basin . Also , stability of Oakes Avenue ROW bank and the residential property west (Block 701 Lots 5-8 ) of the proposed parking lot must be considered . The general area is listed as unstable land in the Coastal Zone Study . Staff specified three conditions for approval : - A recognized and competent Engineering firm ( approved by City Engineering ) must be retained at Mr . Lovric 's expense , to evaluate plans vis-a-vis the storm outfall system and soil stability; no construction will begin until final approval be City Staff . - City will have any and all easement access necessary to inspect the entire storm outfall system and to demand system maintenance performed basis previous contractual responsibility . - Cost of modifications made to the present storm outfall system to accommodate the proposed parking development will be borne by Mr . Lovric . The Board recommendation to Council moved ( Mehler/Young ) and passed: City to grant Georgia Avenue vacation as petitioned with the three conditions specified by Engineering Staff; City Staff should , if deemed appropriate , also solicit comments from the Washington State Highway Dept . As basis for this recommendation , the Board recognized the parking needs as a component in Mr . Lovric 's master plan to develop the Sea-Craft site . And did not feel that a resolution of the potentially insurmountable engineering obstacles was necessarily a tantamount consideration in vacating an otherwise useless right-of-way . 4 Thomas Vacation ( Block 32 Kellog & Ford Addition ) -_ Mr . Frank reviewed a Petition for Street/Alley Vacation: alley in Block 32 Kellog & Ford Addition , and a portion of 36th Street between Blocks 25 and 32 Kellog & Ford Addition . Mr . Thomas owns Block 32; VISTA TOO owns and occupies Block 25 . Mr . Thomas presented a suggested five-lot layout for Block 32 , all with access to 37th Street , a designated arterial ; the applicant requires the alley vacation for this site plan . He stated that the plan meets a minimum 250-foot traffic sight distance for entering 37th Street from each lot . Block 32 contains eight potential building sites , but to gain the three added sites would require the expense of developing B Avenue and 36th St . The suggested lot layout was described as a "developer 's dream" . An augmented plan requests the vacation of the south 65-foot portion of 36th Street , less an irregular shaped area that borders City utility lines crossing the street . This plan provides an additional lot - the vacated portion of 36th Street - which would not be developed until B Avenue is completed . The remaining 15-foot north portion of 36th Street gives City access to the utility lines . Mr . Thomas noted that 36th Street dead-ends at ACFL and is not used for access to the VISTA TOO development; VISTA TOO has agreed to transfer their interest in vacated 36th Street to Mr . Thomas . City Engineering Staff comments addressed a ) a 15-foot utility access along 36th Street is inadequate , b) closeness of the planned driveway spacing , c ) water/sewer latecomers agreement in effect in that area , d ) the complex lot description as planned may be simplified by replatting . The Board recommendation to Council moved ( Snyder/Mehler ) and passed: City to grant the alley vacation and deny 36th Street vacation . The Board ' considered that the alley vacation would provide Mr . Thomas the flexibility to use fully the entire Block 32 in his development at this time . The 36th Street vacation denial is based on utility access concern and would severely limit future flexibility in potential development of the adjacent area . Meeting adjourned at 9: 10PM .
