Box 547 Anacortes,WA. 98221 RE: 1616 Georgia Place Dear Mr. Measamer, I am writing in reference to your letter of 3/12/98 regarding ingress&egress across a 30' easement to Lot #1 of Sergeant's short plat No. 91-008,easement of record No. 9111220118. We respectfully formally request the use of the aforementioned easement,as described in Sergeant's short plat No. 91-008,for ingress&egress across said easement for access to Lot#2. The property was represented to us at the time of purchase as having access via said easement. This was one of the things which made this lot appealing to us. It has been our hope to construct an appropriate, but modest home,with as little impact on the environment as possible on this difficult site. Assuming access to the property across the easement,which was our mistake,we have been able to design a home with"Senior friendly features". Please note the living areas and garage are all at the same level and the home has minimum 3'-6"corridors and 3'-0" doorways. Use across the easement for ingress&egress would eliminate the following options: • The need for additional paving of an extended driveway paralleling the easement. • Blasting of solid rock for the above referenced driveway cut. • Blasting for a garage under the N.E. corner of the house. A garage under the house is not desirable as stairways would then be necessary to access the living areas of the home. For the reasons listed above we respectfully request the City of Anacortes grant use of referenced easement to Lot#2 for ingress&egress. We believe this will allow better use of the land for environmentally friendly purposes. Additionally we will pay for any repairs to the driveway paving,due to any construction related damage,and share in any future expenses. Thank you. Sincerely, RECEIVED Paul F. Talbot the driveway we have developed on the 30 ' easement granted to lot #1 , from our gate, continuous with the eastern boundary of our lot , to the cul-de-sac. When the Anacortes City Council in April , 1991 granted lot #1 , Sargent ' s plat #91-008, a 30 ' easement for the purpose of ingress and egress to said lot , it was with the clear under- standing that we were to restore the native trees and shrubs which had been cleared by the developer . During these 7 years we have planted , fed, watered , weeded and protected from the deer , native conifers , Vine Maple , Oregon Grape , Dogwood and ferns planted along this easement . (See photos ) Mr . Talbot has stated his intent to remove several of the native trees from the easement beyond those necessary to blear his driveway. We respectfully request that during preparation for and development of Mr . Talbot ' s driveway only the absolute minimum number of trees and shrubs be cut to allow access across the easement to the existing driveway and that the removal of any additional trees and shrubs be prohibited .
